5, After personal assurances from Defendant as to Defendant's
competence as a builder, Plaintiffs executed a certain written agreement for the
construction of a custom swimming pool ("the swimming pool") upon Plaintiffs'
property ("the Agreement"), The Agreement was dated October 11, 1995, A true
and correct copy of the Agreement is attached as Exhibit "A."
6, Plaintiff's execution of the Agreement was based upon the
representations and oral warranties of Defendant and its representatives as to
Defendant's competence and ability to perform its obligations under the Agreement.
7, The Agreement provided, inter alia, that the swimming pool built by
Defendant for Plaintiff would include a deck constructed of reinforced concrete,
8, Under "Conditions and Terms" of the Agreement, all work was to be
completed in a workmanlike manner according to standard practices,
9, Mr. Melby, sales manager for Defendant, assured Plaintiffs that the
swimming pool would be covered by a warranty which provided, inter alia, that the
concrete deck surrounding the swimming pool ("the concrete deck") was guaranteed
for ten (10) years after the construction of the swimming pool.
10, According to the Agreement, Defendant was to construct Plaintiffs
swimming pool in early November, 1995,
11, Defendant began constructing the sWimming pool in late 1995, but
postponed construction during the winter of 1995-1996,

31, The large cracks in the concrete deck which Plaintiffs have encountered
by virtue of the shoddy performance by Defendant and Mike's Concrete were the
result of the negligence of Defendant which included, inte[ alia:
(a) negligently failing to supervise their employees, agents,
subcontractors or other servants;
(b) negligently failing to follow reasonable and customary building
practices for concrete decks of the type built for Plaintiffs;
(c) negligently failing to discover the problems with the concrete
when the concrete deck was being constructed;
(d) negligently failing to remedy problems in the construction of the
concrete deck which they knew or should have known would lead to the large cracks
in the concrete deck;
(e) negligently failing to carry out the performance of their obligations
to Plaintiffs which led to the development of the large cracks in the concrete deck;
32. As a result of the negligence of Defendant and Mike's Concrete,
Plaintiffs have substantial damages including:
(a) the cost of repairs necessary to correct the deficiencies;
(b) the difference in value of Plaintiffs' property as a result of
Defendant's breach;
(c) the difference in fair market value between the swimming pool as
constructed and as warranted under the Agreement;

according to slllldard practices. Any alteration or deviation from specificatiol15 involving extra COSlS or changes
in this conll'3ct will be execuled only upon writlCll 'orders, and will become an extra charge over and above the
original price of this contract and will become the Buyers total responsibility. All agrccments contingent upon
strikes, IICcidcnlS or delays beyond our control. The Seller shall not be responsible for any delays ocC:JSiohed by
reason of weather conditions, lockouts, fire accidents, actS of God or any other contingencies beyond its conuol.
The Buyer shall be rc..~ponsib1e for all zoning requirements and for the pool location being within his property
lines and clear of set.baclC lines or other rtStrictions. Buyer will provide access to the pool site for delivery, and
the Seller shall not be responsible for any damage caused by ingress or egress of equipment, supplies or motor
vehicles, The Buyer will clear and prepUll site for pool including removal of trees, or other vegetation, pipes
or pipc lines or other improvements affected by this construction, unless otherwise specified herein, and if any
extra labor or material is required thereof, the S8llle will be the total responsibility of the Buyer and paid for by
the Buyer. Buyer agrees to apply for and obtain and deliver any ncccssazy building permits. Ten pcrcent (lO%)
resrockiDg charge if cancclled after three (3) day recision notice. If not contracted in Buyers residence, recision
notice i3 void. The Buyer is totally responsible for building permit, water, fence, electrical connection and
bonding (grounding) the pool deck only, The price on this contract docs not include the cost of removal of any
underground obstac:les. The price 011 this COlltra.ct docs not include the COSt of ground or the transponatioll of
auch ground to !he pool site. Thc amount of such costs shall be paid totally by thc Buyer directly to the excavator
upon completion of such hauling, Removal of any excess c:xcavaled soil is included in the price of !he contract
lIlld distance to be at the di=etion of the Seller. Excavated site will be rough graded. Top soil, swiing or Iand-
scapmg in any Conn is the total r~ponsibility of the Buyer. The Seller is nOl responsible and is held totally
harmless for any construction or installa~on damage by any o!her COl1tractor. '
