Petitioner's prayer lor relief in his original Petition for Custody, Petitioner requested that he be
allowed to spend time with the child during the weekend either immediately bclore or following the
Conciliation Confercnce.
S, During the initial telephone conversations between Plaintiff and Respondent's counsel,
Petitioner advised Respondent again of his intention to spend time with the child during his trip to
Pennsylvania.
9. Respondent conditionally agreed to allow a visit to occur on the weekend immediately
following the Conciliation Conference, The specific conditions attached by Respondent included that
the child would not stay over night with the father, that visits would not occur during school hours
or during scheduled activities for the child, and that transportation including all costs associated with
transportation would be the sole responsibility of the father.
10, The father accepted these conditions.
II.Respondent was advised through her attorney that even though the Conciliation
Conference was being rescheduled to a later date, it was still Petitioner's intention to visit with the
child on the weekend of February 19, 1999 due to the fact that he had already purchased airline
tickets in anticipation of attending the Conciliation Conference and visiting with his son.
12. Petitioner arrived as agreed upon on Febmary 19, 1999 and was denied,all access to his
son during the period of time from Febmary 19, 1999 until his departure on February 21, 1999.
13. Petitioner was caused to expend large sums of money as well as missing work to enable
himself to be available for this visit. Petitioner's wife also was forced to miss work due to this visit
as well.

COMES NOW, the Petitioner, ALAN A. UNANGST, through his attorneys, JamesJ. Kayer,
Esquire, and who does hereby aver as follows:
], The Petitioner, Alan A. Unangst, is an adult individual residing at 940 Duncan Circle,
Woodland, California 95776.
2, The Respondent, Holly L. Burkholder, is an adult individual residing at 13 C Creekside
Lane, Carlisle, Pennsylvania 170 I 3.
3, On or about January 22, ] 999, the Petitioner filed a Petition for Custody.
4, A Conciliation Conference was scheduled in this matter for February 17, ] 999 at ] 0:30
a.m.
5. Respondent, by her attorney, Michael Hanft, Esquire, advised Petitioner's counsel of his
involvement in the case by telephone and requested that the Conciliation Conference for FebrualY 17,
1999 be postponed due to a conflict in his schedule.
6. At the mutual agreement of the parties and with the assistance of the Conciliator's stall:
the Conciliation Conference was postponed until April 9, 1999 at 9:30 a.m.
7. Prior to Attorney Hanft's involvement and based upon the fact that the Conciliation
Conference was scheduled for February 17, 1999, the Petitioner made travel arrangements to attend
the conference and to spend extra time in Pennsylvania to visit with the subject child, John. In the
Petitioner's prayer for relief in his original Petition for Custody, Petitioner requested that he be
allowed to spend time with the child during the weekcnd either immediately before or following the
Conciliation Conference.
