No responsive plcading is required, 9, Denicd. It is specifically denied that the Plaintiff renovated the Defendant's home. The Defendant agreed to pay thc Plaintiff for time and materials required to dry wall two rooms in her home at a cost 01'$3,000.00. 10. Denied. It is specifically dcnied that that set forth in Exhibit "B" was a final bill in that the Plaintiff accepted final payment on or about November 4, I 998 in the amount 01'$569,04, II, Denied, The averments contained in paragraph eleven (II) are conclusions of law to which no rcsponsive plcading is requircd. 12. Admitted. WHEREFORE, thc Dcfcndant respectfully requests that this Honorable Court entcr judgment in her favor and againslthe Plaintiff. NEW MATTER 13. In or about July 1998, the Plaintiff submitted a bid to dry wall two rooms of the Defendant's home at a cost of$3,000.00. 14. At the Defendant's request, the Plaintiff reduced his bid to writing so that it could be submitted to the Defendant's lender. 15. When the Plaintiff submitted that which is attached to Plaintift"s Complaint as Exhibit "A" to the Defendant, the Defendant questioned the discrepancy between the $3,000.00 oral estimate she had received and the $5,000.00 quote set forth in said document. 16, The Plaintiff replied to the Defendant's inquiry as set forth in paragraph fifteen above by stating this was a "high number" quoted for the purpose of submitting the proposal to Defendant's lender. 17. Upon receiving the Plaintiffs second billing bringing his total charge to $5,317.72, the Defendant complained about the billings had now exceeded the Plaintiffs original estimate, 18, The Plaintiff responded to the Defendant's inquiry as set forth above by stating that the remaining charge to be complete the project would be approximately $500.00, 19. The Defendant authorized the completion of the project provided that would not exceed $500.00 in additional costs bringing the total project cost to $5,817.72. defendant had cxpandcd thc scopc of thc work to include finishing a bay window and installing duct work for air conditioning as well as framing for a ncw front door. 16. Thc avcnnents of fact contained in paragraph sixteen (16) are specifically denied. The defendant kncw that the work she requested would be on a time and material basis. The estimate was preparcd in order for hcr to be able to borrow the estimated cost of the work she wanted perfonned at that time. 17. The avennents offact contained in paragraph seventeen (17) of the New Matter are admitted. 18. The avennents of fact contained in paragraph eighteen (18) of the New Matter are admitted in part and denied in part. It is admitted that the plaintiff did give her an estimate of approximately Five Hundred and no/I 00 ($500.00) Dollars. It is denied that the estimate of Five Hundred and no/IOO ($500.00) Dollars was from the last billing. In fact, there were materials and timc for which the defendant had not yct been billed when the additional Five Hundred and no/I 00 ($500,00) Dollar estimate was givcn, 19, The avcnnents of fact contained in paragraph nineteen (19) of the New Matter are denied.
