6. Plaintiff Joscph Brcski, upon returning, onthc arorcsaid datc, to Saylor's Markct to advisc
of his having bit into a hard noodlc bakcd into thc donut, was adviscd by an cmploycc of
Saylor's Market, in the bakcry dcpartmcnt, that thc donut in qucstion had bccn "hand
proccsscd and bakcd on prcmiscs and that a noodlc must havc gone into thc battcr."
7. As a result of thc injuries sustaincd, Plaintirf Joscph Breski will be required to undergo
dcntal rcstoration on a periodic basis into the future at a cost anticipatcd to cxceed $3,000.00.
8. Also as a rcsult of the aforesaid injury, Plaintirfis anticipated to requirc root canal therapy
at an anticipated cost of $700.00.
9. As a further rcsult of the aforesaid injury, Plaintiff has sustained past pain and surfering,
humiliation, loss orlife's pleasures and medical cxpcnses endeavoring to treat himself and
will in the ruture incur the same losscs.
10. Solely as a rcsult of the injuries sustained by her husband, Plaintirr Nancy Breski has
sustained the loss of the society and companionship ofhcr husband for which damages are
claimcd.
COUNT I - NEGLIGENCE
II. Plaintirf incorporatcs all previous allegations as though set forth here at length.
12. Dcfcndant held itself out as, intcr alia, producer and seller orsafc and edible baked goods.
13. The incidcnt and injurics complaincd ofwcrc causcd solely by thc negligence of Defendant
Saylor's Markct, acting through its cmployccs, agcnts and/or scrvants as rollows:
a. By allowing a hard unbakcd noodlc to comc into contact with donut batter;
b. In failing to isolate hard forcign substanccs not intended to be baked into donuts to
comc into contact with donut battcr;
COUNT 1- NEGLIGENCE

reference, as if fully set forth at length, Paragraphs 1 - 10 of the Answer to Plaintiffs' Complaint.

21. Defendant Saylor's Market, Inc. d/b/a Saylor's Market incorporates herein by
reference, as if fully set forth at length, Paragraphs 1 - 20 of the Answer to Plaintiffs' Complaint.
22. II is admilled that Defendant Saylor's Market sells some donuts that are hand-
processed on its premises. It is unknown to Defendant what kind, if any, donut was purchased
by Plaintiff Joseph Breski.

24. Denied as a legal conclusion and pursuant to Pa.R.C.P. 1029(e).
