Dinger, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Lot 99, Good Hope Farms South, 5505 Barbara Drive, Mechanicsburg, Hampden Township, Cumberland County, Pennsylvania NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to McNaughton Homes in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered ~sence of ALL THAT CERTAIN piece, parcel or lot of land, together with improvements, situated in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Northern right-of-way line of Barbara Drive (50.00 feet wide), said point being located at the Southeastern corner of Lot No. 304; thence along the Eastern boundary line of Lot No. 304, and along the centerline of a 15.00 foot wide pedestrian easement, North 10 degrees 59 minutes 07 seconds West, for a distance of 125.00 feet, to a point on the Southern right-of-way line of Skyport Road (50.00 feet wide); thence through said 15.00 foot wide pedestrian easement, and along said right-of-way line of Skyport Road, North 79 degrees 00 minutes 53 seconds East, for a distance of 100.00 feet, to a point at the Northwestern corner of Lot No. 306; thence along the Western boundary line of Lot No. 306, South 10 degrees 59 minutes 07 seconds East, for a distance of 125.00 feet, to a point on the Northern right-of-way line of Barbara Drive (50.00) feet wide); thence along said right-of-way South 79 degrees 00 minutes 53 seconds West, and through said 15.00 foot wide pedestrian easement, for a distance of 100.00 feet, to a point and the place of BEGINNING. CONTAINING approximately 12,500.00 square feet of land, has an address of 5505 Barbara Drive, Mechanicsburg, Pennsylvania 17050, and is known and numbered as Lot No. 305 on the Final Subdivision Plan for Good Hope Farms South - Phase V, which is recorded in Cumberland County in Plan Book 79, Page 91. UNDER AND restrictions, way of record. SUBJECT to any and all covenants, conditions, reservations, easements, agreements, and rights of BEING THE SAME PREMISES WHICH The McNaughton Company, a Pennsylvania corporation, by their deed to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto David L. Dinger and Nancy J. Dinger.
