Joseph B. McCorkel is an adult individual currently operating a construction company known as McCorkel Homes and Remodeling with a business address of 1405 Zimmerman Road, Carlisle, Cumberland County, Pennsylvania. 2. Daniel and Susan Stott are adult individuals currently residing at 198 Clay , Road, Carlisle, Cumberland County, Pennsylvania. 3. In November, 1997 the Defendants hired the Plaintiff to perform extensive repairs on their barn and water system at their home located at the address above. 4. Following this engagement, the Plaintiff did undertake the work pursuant to the Defendants' direction and request and provided labor, materials as well as ongoing supervision and control on this project. 5. The Plaintiff issued a bill dated November 12, 1997 to the Defendants indicating an initial amoLlnt due of $25,084.89. On this initial invoice the Defendants have paid $21,084.89 leaving a balance due of $4,000.00, A copy of this invoice and record of payments is attached hereto and marked "Exhibit A", 6, On January 8, 1998 the Plaintiff provided the Defendants an additional invoice for additional time authorized by the Defendants on this project in the amount of $15,624.21. Subsequently the Defendants paid a total of $4,000.00 on this invoice leaving a balance due of $11 ,624.21, 7. Dcnied. Plaintiff undertook certain work on thc propcrty as was agreed to by the partics at thc inception of the contract. Subsequcntly, Plaintiffsought to modifY the scope of work. Defendants did not agree to modifications sought by Plaintiff apart from work which Plaintiffperformcd to ercct a replaccment wall for a part of the barn on the Defendants' propcrty. Plaintiff represcnted that this work was necessary and that the condition of the barn wall was such that a collapse could be expected without replacement. Plaintiff further represented that the additional work to be pcrformed by him would not exceed a specific dollar amount. Additionally, Defcndants did agree to have Plaintiff replace a garage door on the home of Defendants at a charge not to exceed $200.00. 5. Admitted in part and denied in part. It is admitted only that Plaintiff presented a bill dated Novcmber 12, 1997 to the Defendants in the face amount of$25,084.89. Defendants incorporate paragraph 3 as though set forth at length. It is denied that the work performed by Plaintiff was worth the amount of this bill or that Plaintiff was entitled to reeeive this amount from Defendants. Nonetheless, Defendants paid this sum to Plaintiff in an effort to resolve the claims presented by Plaintiff dcspite their belief that thesc charges were excessive, were not authorized by Defendants, were well beyond the cstimates providcd by Plaintiff and were not retleetive of the work performed by Plaintiff. 6. Admitted in part and denied in part. It is admitted only that Plaintiff submitted an additional invoice to Defendants dated January 18, 1998 setting forth an amount allegedly due of $11,624.21 over and above the previous invoice provided by Plaintiff. It is denied that Defendants ever authorized work which would or could form the basis for thcse exorbitant 2 charges. Further, it is denied that Defendants are liable to PlaintitT on this invoice. Defendants never made a payment against this invoice, the $4,000.00 payment refereneed by PlaintitTwas a payment by Defendants to complete payments against the prior invoice. 7. Denied. To the contrary, at no time prior to the initiation of work by PlaintitTdid he inform Defendants that an interest charge would apply. 8. Denied. There is no amount due on the invoices. To the contrary, PlaintitTis not entitled to the charges he has forwarded to Defendants. WHEREFORE, Daniel and Susan Stott respeetfully request that judgment be entered in their favor and against PlaintitT together with costs and interest. NEW MATTER 9. Defendants are justified in refusing to pay the charges alleged to be due by Plaintiff. 10. PlaintitTis estopped from making the claims now presented having represented to the Defendants the amounts that would be incurred for the services to be rendered and the detrimental reliance of Defendants upon PlaintitTs representations. 11. The PlaintitT has never provided services or materials whieh would substantiate the amounts allegedly due. 12. An accord and satisfaction has been reached in this matter with Defendants paying to PlaintitT all amounts due pursuant to said accord and satisfaction. 13. Defendants have paid PlaintitTthe amount which eould be due him based upon the agreements of the parties. 3 ... ..._ol.. 19. Plaintiff agreed that the work he would perform pursuant to these estimates was being charged on a time and material basis and that he would not add any additional costs to the materials. 20. After Plaintiff commenced to perform this work on the property, he informed Dan Stolt that rock had been encountered in digging the water trench. As a result, Dan and Susan Stott redesigned the direction and layout for the water trench reducing the lenl,'lh of the trench from the original design of approximately 600 lineal feet to approximately 275 lineal feet. The trench actually dug by Plaintiff was less than one-half the length upon which he had originally estimated the project cost. 21. Plaintiff informed Dan Stott that stone dust should be placed over the water lines to be laid in the trench to protect them from crushing. Dan Stott agreed to this additional material cost which, as reflected in the invoices of Plaintiff, was $574.44. Additionally, Plaintiff gave a quote to perform certain minor repairs all at a cost not to exceed approximately $1,500.00. 22. While performing work on the property, Plaintiff represented to Dan and Susan Stott that one stone wall of the barn was in danger of collapsing and that the only appropriate means to address this danger was to remove the existing wall and replace it with a new wall. 23. Plaintiff informed Dan and Susan Stott that the cost to remove the existing wall and install a new wall would be $10,000.00. Plaintiff subsequently amended this amount to $12,000.00. 5 JOSEPH B. There was never any discussion with Defendants as to any additional charge that Plaintiff would place on the costs of materials. 20, Admitted and denied.
