The Plaintiff, Lawrence Jensen, is an adult individual residing at 5 Raspberry Drive, Mechanicsburg, PA 17055. 2. The Defendant, Getinge Castle is a Delaware corporation with its principal place of business located at PO Box 92640, Rochester, NY 14692-0640, and a registered office in Pennsylvania c/o Corporation Service Company, 319 Market Street, Harrisburg, Dauphin County, Pennsylvania 17101. 3. The Plaintiff Jensen was employed by the Defendant Getinge Castle in a number of capacities, for approximately 12 years, when he was discharged from his employment on or about March 13, 1998. At the time of his discharge, the Defendant categorized the Plaintiff as an exempt salaried employee, and the Plaintiff was working for the Defendant out of an office situate in his home located at 5 Raspberry Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055. 4. At the time that the Defendant terminated the Plaintiff, he was receiving a weekly salary of $1,039.50, plus commissions. 5. The Defendant, through its then Northeast Regional Manager, Charlie Wentworth, terminated the Plaintiff's employment on March 13, 1998, under the pretext of the Plaintiff's inability to handle the responsibilities of his position. 6. Contrary to this pretext, the Plaintiff was performing all his assignments competently and as best as could be reasonable expected under the circumstances. Plaintiff was terminated without proper cause because Wentworth made the Plaintiff a scapegoat for Wentworth's failures as Northeastern Regional Manager. Eventually, the Defendant realized that Wentworth was not competent and terminated his employment on or about July 1, 1998. COUNT I In Contract 7. Paragraphs 1 through 6 above are incorporated by reference herewith as if fully set forth. 8. In addition to his base salary of $1,039.50 per week, the Plaintiff was also entitled to various commissions, according to a predetermined schedule as established by the Defendant. 9. At the time of the termination of Plaintiff's employment by the Defendant, the Plaintiff had sold MP kits to four customers, for which he was entitled to commissions totalling $761.08, the itemization for which appear on Exhibit "A", attached hereto. The Defendant has refused to pay such commissions to the Plaintiff. 2 10. At the time of his employment was terminated by the Defendant, the Defendant had recently implemented Personnel Policy No. 485.2, entitled Salary/Wage Continuation, attached hereto as Exhibit "B". According to said personnel policy, exempt salaried employees who had worked for the company between 11 to 15 years, would receive salary/wage continuation for 20 weeks, and also would receive out-placement assistance. 11. Contrary to Personnel Policy No. 485.2, after terminating the Plaintiff, the Defendant only paid to him wage continuation payments of $14,033.25, instead of the $20,790 (20 weeks x $1,039.50 per week) as specified in the aforementioned personnel policy. 12. In addition, contrary to Personnel Policy No. 485.2; the Defendant did not provide the Plaintiff with the aforementioned out-placement assistance, the fair market value of which is believed, and therefore averred, to be $7,500. 13. One of the reasons why the Plaintiff continued his employment with the Defendant, and did not seek other employment opportunities prior to his termination, was his reliance upon the aforementioned wage continuation policy, or its predecessor policy, which also provided for the same post-termination salary/wage continuation payments. 3 WHEREFORE, the Plaintiff demands judgment in his favor, and against Defendant, in the amount commission totaling $761.28, wage $6,756.75, and $7,500 for unprovided plus prejudgment interest from March 13, 1998, of $15,018.03, (for unpaid continuation payments of out-placement assistance), plus costs of suit. COUNT II Pennsylvania Wage Payment and Collection Law (43 P.S. §260.1 et seq.) 14. Paragraphs 1 through 13 above are incorporated herein by reference as if fully set forth. 15. The aforementioned commissions, wage continuation payments, and out-placement assistance remained unpaid for a period beyond 30 days after the Plaintiff's first regularly scheduled pay day following his termination on March 13, 1998. 16. The Defendant has no good faith contest or dispute as to the aforementioned claims of the Plaintiff. WHEREFORE, the Plaintiff seeks judgment in his favor in the amount of $15,018.03, prejudgment interest from March 13, 1998, plus liquidated damages of $3,766 {25% of the total amount of "wages" due), plus reasonable counsel fees, and costs of suit. Defendant specifically denies the stated allegation and demands proof thereof in that: (a) Mr. Jensen was not entitled to any of the commissions listed on Exhibit A, because it was Getinge's customary practice to pay commissions only after any installation had taken place; (b) Mr. Jensen was not eligible for any of the alleged commissions, in part because he was terminated before any installation had taken place; (c) the Water Saver Kit was never installed for the Delaware Valley College account; (d) Getinge has no record of the Miscellaneous Competitor Table Accessories which Mr. Jensen attributed to the Sunbury Community Hospital account; and (e) Getinge denies the stated allegation based on such other reasons as may appear during discovery or at trial. 10. The Plaintiff has maintained that he was performing satisfactorily but that he was terminated by his Sales Manager, Charlie Wentworth, as a scapegoat for Mr. Wentworth's job performance deficiencies. 8. On or about April 19, 2000, the Plaintiff served his First Request for Production of Documents on the Defendant, a true and correct copy of which is appended hereto as Exhibit 9.
