COMPLAINT
1. The Plaintiff, Lawrence Jensen, is an adult
individual residing at 5 Raspberry Drive, Mechanicsburg, PA 17055.
2. The Defendant, Getinge Castle is a Delaware
corporation with its principal place of business located at PO Box
92640, Rochester, NY 14692-0640, and a registered office in
Pennsylvania c/o Corporation Service Company, 319 Market Street,
Harrisburg, Dauphin County, Pennsylvania 17101.
3. The Plaintiff Jensen was employed by the Defendant
Getinge Castle in a number of capacities, for approximately 12
years, when he was discharged from his employment on or about March
13, 1998. At the time of his discharge, the Defendant categorized
the Plaintiff as an exempt salaried employee, and the Plaintiff was
working for the Defendant out of an office situate in his home
located at 5 Raspberry Drive, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
4. At the time that the Defendant terminated the
Plaintiff, he was receiving a weekly salary of $1,039.50, plus
commissions.
5. The Defendant, through its then Northeast Regional
Manager, Charlie Wentworth, terminated the Plaintiff's employment
on March 13, 1998, under the pretext of the Plaintiff's inability
to handle the responsibilities of his position.
6. Contrary to this pretext, the Plaintiff was
performing all his assignments competently and as best as could be
reasonable expected under the circumstances. Plaintiff was
terminated without proper cause because Wentworth made the
Plaintiff a scapegoat for Wentworth's failures as Northeastern
Regional Manager. Eventually, the Defendant realized that Wentworth
was not competent and terminated his employment on or about July 1,
1998.
COUNT I

7. Paragraphs 1 through 6 above are incorporated by
reference herewith as if fully set forth.
8. In addition to his base salary of $1,039.50 per
week, the Plaintiff was also entitled to various commissions,
according to a predetermined schedule as established by the
Defendant.
9. At the time of the termination of Plaintiff's
employment by the Defendant, the Plaintiff had sold MP kits to four
customers, for which he was entitled to commissions totalling
$761.08, the itemization for which appear on Exhibit "A", attached
hereto. The Defendant has refused to pay such commissions to the
Plaintiff.

10. At the time of his employment was terminated by the
Defendant, the Defendant had recently implemented Personnel Policy
No. 485.2, entitled Salary/Wage Continuation, attached hereto as
Exhibit "B". According to said personnel policy, exempt salaried
employees who had worked for the company between 11 to 15 years,
would receive salary/wage continuation for 20 weeks, and also would
receive out-placement assistance.
11. Contrary to Personnel Policy No. 485.2, after
terminating the Plaintiff, the Defendant only paid to him wage
continuation payments of $14,033.25, instead of the $20,790 (20
weeks x $1,039.50 per week) as specified in the aforementioned
personnel policy.
12. In addition, contrary to Personnel Policy No. 485.2;
the Defendant did not provide the Plaintiff with the aforementioned
out-placement assistance, the fair market value of which is
believed, and therefore averred, to be $7,500.
13. One of the reasons why the Plaintiff continued his
employment with the Defendant, and did not seek other employment
opportunities prior to his termination, was his reliance upon the
aforementioned wage continuation policy, or its predecessor policy,
which also provided for the same post-termination salary/wage
continuation payments.

WHEREFORE, the Plaintiff demands judgment in his favor,
and against Defendant, in the amount
commission totaling $761.28, wage
$6,756.75, and $7,500 for unprovided
plus prejudgment interest from March 13, 1998,
of $15,018.03, (for unpaid
continuation payments of
out-placement assistance),
plus costs of suit.
COUNT II
Pennsylvania Wage Payment and Collection Law
(43 P.S. §260.1 et seq.)
14. Paragraphs 1 through 13 above are incorporated
herein by reference as if fully set forth.
15. The aforementioned commissions, wage continuation
payments, and out-placement assistance remained unpaid for a period
beyond 30 days after the Plaintiff's first regularly scheduled pay
day following his termination on March 13, 1998.
16. The Defendant has no good faith contest or dispute
as to the aforementioned claims of the Plaintiff.
WHEREFORE, the Plaintiff seeks judgment in his favor in
the amount of $15,018.03, prejudgment interest from March 13, 1998,
plus liquidated damages of $3,766 {25% of the total amount of
"wages" due), plus reasonable counsel fees, and costs of suit.

his job. Contrary to plaintiff's allegations, Getinge did not
terminate Mr. Wentworth's employment because he was incompetent.

commissions listed on Exhibit A, because it was Getinge's
customary practice to pay commissions only after any installation
had taken place;
(b) Mr. Jensen was not eligible for any of the
alleged commissions, in part because he was terminated before any
installation had taken place;
(c) the Water Saver Kit was never installed for
the Delaware Valley College account;
(d) Getinge has no record of the Miscellaneous
Competitor Table Accessories which Mr. Jensen attributed to the
Sunbury Community Hospital account; and
(e) Getinge denies the stated allegation based on
such other reasons as may appear during discovery or at trial.
10. Admitted in part; denied in part. The Personnel
Policy No. 485.2, attached to the complaint as Exhibit B, speaks
for itself. To the extent plaintiff's allegations in paragraph
10 are at variance with the terms of the policy, such allegations
are specifically denied and proof thereof is demanded. Contrary
to Mr. Jensen's allegation, the policy had been in effect for
several years at the time Mr. Jensen's employment was terminated.
11. Admitted in part; denied in part. Admitted that
Getinge terminated Mr. Jensen and paid him wage continuation
payments of $14,033.25. The remaining allegations are
specifically denied and proof thereof is demanded in that:
(a) Mr. Jensen was paid in accordance with
Personnel Policy No. 485.2, and received all wage continuation
payments due under such policy; and
(b) Mr. Jensen was terminated because of his
inability to satisfactorily perform his job; therefore, he was
only entitled to 75 percent of the severance pay indicated on the
schedule attached to the complaint as Exhibit B.
12. Denied. Getinge specifically denies the stated
allegation and demands proof thereof in that:
(a) Getinge complied with its personnel policy by
offering Mr. Jensen outplacement assistance; attached as Exhibit
~A" is a March 20, 1998 letter from Charlie Wentworth, Regional
Manager, specifically stating that if Mr. Jensen wished to
receive outplacement assistance, he should contact Shelly Knapp
of the company;
(b) despite Getinge's offer of outplacement
assistance, Mr. Jensen never contacted the company to seek such
assistance, and has waived any damage claim or entitlement to it;
(c) even if Mr. Jensen is able to establish that
Getinge failed to offer outplacement assistance, such failure
cannot support a monetary damage claim; alternatively, the fair
market value of such outplacement service is significantly less
than Mr. Jensen's claim of $7,500.00.
13. Denied. Getinge specifically denies the stated
allegation and demands proof thereof in that:
(a) Count I attempts to state a contract claim
based on Getinge's personnel policy;
(b) Mr. Jensen is bound by the express terms of
the policy, and he has not alleged and cannot establish any
implied obligations arising from that policy; and
(c) Mr. Jensen's alleged reliance is irrelevant
and unreasonable under the circumstances.
WHEREFORE, defendant requests that the complaint be
dismissed with prejudice, with all costs taxed against plaintiff.
COUNT II
PENNSYLVANIA WAGE PAYMENT AND COLLECTION LAW
(43 P.S. ~260.1 et seq.)

reference herein.
15. Denied. Getinge specifically denies the stated
allegation and avers to the contrary that Mr. Jensen received all
commissions and wage continuation payments to which he was
entitled. Additionally, Getinge offered outplacement assistance
to Mr. Jensen but he has waived such assistance or has not
bothered to accept it.
16. Denied. Getinge specifically denies the stated
allegation and avers to the contrary that it has satisfied its

obligations and has raised a good faith contest or dispute to Mr.
Jensen's alleged claims.

21. Plaintiff's claims are barred by impossibility of
performance and failure of consideration.

22. Mr. Jensen has not alleged and cannot establish
the requisite elements of his contract claim and his claim under
the Wage Payment and Collection Law, 43 P.S. §260.1, ~.
23. Getinge has fully satisfied its monetary and any
other obligations owed to Mr. Jensen. Alternatively, Getinge has
a good faith defense to any wages or other damages legitimately
claimed by Mr. Jensen under contract or statutory law.
24. Since the amount in controversy does not exceed
$25,000.00, plaintiff's action must be submitted to arbitration
under Local Rule 1301-1.
WHEREFORE, defendant requests that the complaint be
dismissed with prejudice, with all costs taxed against plaintiff.

This letter will outline the compensation provisions related to your termination of
employment from GetingedCasfle, Inc., effective March 13, 1998.
Your salary/wage continuation payments will commence on March 14, 1998 and will
continue through July 31, 1998. Per the Policy No.485.2 Salary/Wage Continuation,
'Any employee who is terminated because of his/her inability to satisfactorily perform
his/her job shall, upon termination, receive outplacement assistance and seventy-five
percent (75%) of the continuation pay..."
You will be paid for any unused hours of vacation earned through March 31, 1998.
Should you wish to receive outplacement assistance, please contact Shelly Knapp
(Telephone: '/16-272-5050).
If you participate in a Company sponsored Medical Insurance Plan, your coverage will
be continued through the calendar month following the month in which your
employment was terminated. The Company will continue to pay the cost it normally
bears for this period of time. Your share of the cost for this coverage will be deducted
from your salary/wage continuation payment(s) in advance.
In you participate in a Company sponsored Dental Insurance Plan, your coverage will
cease on the date on which your employment was terminated. You are entitled to
benefit payments under this plan for procedures which were performed prior to the date
on which your employment was terminated and for procedures which are performed
within 31 days following the date on which your employment was terminated if such
procedures resulted from an examination which was performed prior to the date on
which your employment was terminated.
Under the provisions of the Consolidated Budget Reconciliation Act ("COBRA"), you
have the right to continue your medical and/or dental insurance coverage. Information
about coverage continuation is enclosed.

1. The Plaintiff, Lawrence Jensen, is an adult
individual, currently residing at 5 Raspberry Drive,
Mechanicsburg, Pennsylvania 17055.
2. The Defendant, Getinge Castle, is a Delaware
corporation, with its principal place of business located at Post
Office Box 92640, Rochester, New York 14692-0640, with a
registered office in Pennsylvania c/o Corporation Service Company,
2704 Commerce Drive, Harrisburg, Dauphin County, Pennsylvania
17110.

satisfactorily but that he was terminated by his Sales Manager,
Charlie Wentworth, as a scapegoat for Mr. Wentworth's job
performance deficiencies.
8. On or about April 19, 2000, the Plaintiff served
his First Request for Production of Documents on the Defendant, a
true and correct copy of which is appended hereto as Exhibit
9. In order to obtain evidence of Plaintiff's
satisfactory job performance, the Plaintiff sought copies of the

eventually realized that it was Mr. Wentworth whose performance
was deficient and therefore the Plaintiff made request #7:

therefore, from the Defendant."
11. On or about May 31, 2000, the Defendant filed
certain answers and objections to the Plaintiff's First Request

5, 6 and 7. A true and correct copy of the Defendant's
Objections are attached hereto as Exhibit KB".
12. Efforts by Plaintiff's Counsel and Defense
Counsel to try to resolve these objections had been unavailing.

Court order the production of documents requested at numbers 5,
6 and 7, and order such other relief, as this Court deems

not be reasonably calculated to lead to the discovery of

6. OBJECTION. Paragraph 6 of plaintiff's request
fails to comply with Rule 4009.11(b), because it does not
describe the item or category with reasonable particularity.
Plaintiff's paragraph 6 does not specify whether plaintiff is
seeking monthly operating reports authored by him or by all
employees reporting to Charlie Wentworth. Additionally,
production of any available information would require a
burdensome and unreasonable investigation by defendant. If
produced, the information would not be reasonably calculated to
lead to the discovery of admissible evidence.
7. OBJECTION. Paragraph 7 seeks the discovery of
documents relating to Charlie Wentworth, a former Getinge/Castle
employee who is not a party to this proceeding. The requested
information is privileged and confidential, and is not reasonably
calculated to lead to the discovery of admissible evidence.
8. ANSWER. Although the Water Saver Kit was shipped
to Delaware Valley College, it was never installed and was
subsequently picked up and returned to the company. Copies of
documents pertaining to this pickup are attached as Exhibit ~D."
