5. Alternating hOlidays from 8:00a.m. to 7:00p.m. The holidays shall be New
Year's Day, Easter, Memorial Day, 4th of July, Labor Day and Thanksgiving Day.

AND NOW, comes Petitioner, Douglas Bohn, by and through his counsel of record,
Bradley L. Griffie, Esquire, and petitions the Court as follows:
COUNT I - CONTEMPT
1. Your Petitioner is the above named Defendant, Douglas Bohn, an adult individual currently
residing at 6 Trine Avenue, Mt. Holly Springs, Cumberland County, Pennsylvania.
2. Your Respondent is the above named Plaintiff, Dee Ann JBohn, an adult individual whose
current address is not specifically known to Petitioner, but whose last known address was 436
Mill Race Road, Carlisle, Cumberland County, Pennsylvania, and who is believed to continue
to reside in the Carlisle/South Middleton area.
3. The parties are the natural parents of two children, namely, Shane Michael Bohn, born
September 23, 1990, and Amanda Danielle Bohn, born AprilS, 1993.
4. The parties are subject to an Order of Court dated February 2, 1999, a copy of which is
attached hereto and incorporated herein by reference as EJdUbit "N', detailing the terms of
legal and physical custody of the children.

5. Since the entry of the aforementioned Order, Respondent has failed and refused to comply
with the terms of the Order by failing to provide for the children to be with Petitioner during
his periods of physical custody as set forth in paragraph 4 of the Custody Order.
6. Respondent's refusal to require the children to be in Petitioner's custody to comply with the
Court's Order is willful contempt of the Order on Respondent's behalf.
7. Respondent has claimed that the children do not wish to spend time with Petitioner, but
Respondent has failed and refused to provide the children to Petitioner for purposes of
engaging in appropriate counseling that could resolve any claimed difficulties in the
relationship between Petitioner and the children.
8. Respondent has chosen, rather, to engage in some type of counseling with the children and her
current husband with a counselor unknown to the Petitioner, whose address and phone
number are unknown to Petitioner and who is not a counselor that was agreed upon.
9. Respondent's conduct is a willful violation of the shared legal custody provisions of the
Order.
10. Respondent has, on at least 2 occasions, out of anger at Petitioner, made false claims of abuse
against Petitioner to Cumberland County Children & Youth Services.
WHEREFORE, Petitioner requests your Honorable Court to find the Respondent In
contempt of the Court's Order of February 2, 1999.
COUNT n
11. Paragraphs 1 through 10 of Petitioner's Petition are incorporated herein by reference as if set
forth in their full text.
12. The parties' present work and school schedules do not provide for an accommodation ofthe
Court's Order of February 2, 1999, which requires a modific:ation of the Order.
13. Petitioner wishes to spend greater uninterrupted periods of time with the children, particularly
during the Summer vacation months, which would be to the children's best interest.
14. Petitioner believes and, therefore, avers that a shared physical custody arrangement would be
in the children's best interest and could easily be accommodated by the parties.

natural parents.
4. Primary physical custody of the children shall be in the mother subject to
the following periods of partial custody with the father:
a. Every other weekend from Friday at 5:00p.m. through Sunday at
5:00p.m.
b. One to two evenings per week from 5:00p.m. until 8:00p.m.
5. Alternating holidays from 8:00a.m. to 7:00p.m. The holidays shall be New
Year's Day, Easter, Memorial Day, 4th of July, Labor Day and Thanksgiving Day.

6. The parties 'shall alternate the Christmas holiday. The father shall have
custody of the children from 6:00p.m. Christmas Eve until 3:00p.m. Christmas Day in
odd numbered years and the mother shall have this period in even numbered years.

6:00p.m. December 26 in odd numbered years and the father shall have this period in

consideration of the attached Custody Conciliation Report, it is ordered and directed as
follows:
1. The prior Order of Court dated February 2, 1999 is hereby vacated.
2. The Mother, Dee Ann (Bohn) Paulus, and the Father, Douglas Bohn, shall
have shared legal custody of Shane Michael Bohn, born September 23, 1990 and Amanda
Danielle Bohn, born April 8, 1993. Each parent shall have ,m equal right, to be exercised
jointly with the other parent, to make all major non-emergency decisions affecting the
Children's general well-being including, but not limited to, all decisions regarding their
health, education and religion.
3. The parties shall commence family counseling with Sally Rooney, or
another counselor satisfactory to both parties, as soon as pradicable and Ms. Rooney's
schedule permits. The parties shall cooperate in the submission of invoices for
counseling to their respective insurance companies. Father shall pay any unreimbursed
counseling expenses.
4. Mother shall have primary physical custody of the children.
5. Father shall have the following periods of partial physical custody and will
make every effort to exercise said physical custody:
A. Beginning the weekend of October 12,2001, alternating weekends from
Fridays at 5:00 p.m. to Sundays at 8:00 p.m. In the event Father is unable
to meet the 5 :00 p.m. pick up time, he is to provide reasonable notice to
Mother.
B. When Father's military reserve duty falls on one of his weekends for
custody, he shall be entitled to the immediately following weekend.
C. Father shall be entitled to two non-consecutive weeks in the summer,
provided he notifies Mother of the weeks by May 1 of every year.
6. The parties shall alternate the following holidays from 9:00 a.m. to 7:00
p.m. beginning with Father having the Thanksgiving holiday in 2001: Thanksgiving, New
Year's Day, Easter, Memorial Day, 4th of July and Labor Day. When one of said
holidays falls on a Monday following Father's weekend custody, Father shall also have
custody overnight on Sunday.
7. The parties shall alternate the Christmas Holiday which shall be divided
into two Blocks. Block A shall be from Christmas Eve at 6:00 p.m. to Christmas Day at
3:00 p.m. Block B shall be from Christmas Day at 3:00 p.m. to December 26 at 6:00
p.m. Father shall have Block A in odd numbered years and Block B in even numbered
years. Mother shall have Block A in even numbered years and Block B in odd numbered
years.
8. Mother shall have physical custody of the children on Mother's Day from
9:00 a.m. to 7:00 p.m. Father shall have physical custody of the children on Father's Day
from 9:00 a.m. to 7:00 p.m.
9. The parties shall share transportation such that the party receiving custody
shall provide transportation, unless otherwise agreed by the parties.
10. The parties shall keep each other advised immediately relative to any
medical care or medical emergencies concerning the children and shall further take any
necessary steps to ensure that the health and well being of the children is protected.
During such illness or medical emergency, both parents shall have the right to visit the
children as often as he/she desires consistent with the proper medical care of the children.
II. Neither parent shall do or say anything nor let anyone in the children's
presence to say or do anything that may estrange the children from the other parent,
il1iure the opinion of the children as to the other parent or hamper the free and natural
development of the children's love and respect for the other parent.
13. This Order is entered pursuant to an agreement of the parties at a Custody
Conciliation Conference. The parties may modifY the provisions of this Order by mutual
consent. In the absence of mutual consent, the terms of this Order shall control.

I. Your Petitioner is the above-named Defendant, Douglas Bohn, an adult individual

herein by reference as Exhibit "A."
5. Since the entry of the prior Order, the children have eontinued to reside in the primary
custody of Respondent at the address indicated with Respondent's husband, Todd
Paulus.
6. Petitioner resides at his address with his wife, Kristine K. Bohn, and her two children,
Madison Hyer and MacKenzie Hyer.
7. The children have continued to reside with Respondent in Cumberland County,
Pennsylvania, thereby continuing to vest jurisdiction over the issue of custody in this
matter in the Court of Common Pleas of Cumberland County.
8. Since the entry of the prior Order the parties' situations have changed such that it is in
the best interest and permanent welfare of the children to modify the prior Order and
provide for the parties to have shared physical and I,egal custody of the children.
WHEREFORE, Petitioner requests your Honorable Court to enter an Order providing for

it is hereby directed that parties and their respective counsel appear before Ja"queline M. Verney, Esq. ,the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesd:.y, June 08, 2004 at 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to appear at the conference may
provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and aU existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

ORDER OF COURT
AND NOW, this Clf~ day of ~ ,2004, upon
consideration of the attached Custody Conciliation Report, it is ordered and directed as
follows:
I. The prior Order of Court dated October 21, 200 I shall remain in full force
and effect with the following modifications;
2. Beginning Sunday, June 20, 2004 and continuing until the next
conciliation conference, the parties shall share physical custody ofthe children on a week
on/week off basis. The transfer day and time shall be Sundays at 7:00 p.m. Mother shall
have the first week. In the event that either parent will be out of town overnight any day
during their custodial week, the non-custodial parent shall have physical custody of the
children from after work that day to the following morning.
3. At Father's request, the parties will participate in a custody evaluation to
be performed by Dr. Arnold Shienvold. As Father has made the request for the
psychological evaluation he will pay the costs for the evaluation. Mother has indicated
that she does not believe an evaluation is necessary and does not have the finances to
assist in the cost of an evaluation. Both parties will fully cooperate and participate in the
evaluation as required by Dr. Shienvold's office. Father reserves the right to request of
the Court that the Court require Mother to provide financial contribution for the cost of
the evaluation.
4. This Order is entered pursuant to an agreemeont of the parties at a Custody
Conciliation Conference. The parties may modify the provisions of this Order by mutual
consent. In the absence of mutual consent, the terms of this Order shall control. Another
conciliation conference is scheduled for August 19,2004 at 8:30 a.m.

2. A Conciliation Conference was held in this matter on June 8, 2004, with
the following individuals in attendance: The Father, Douglas Bohn, with his counsel,
Bradley 1. Griffie, Esquire and the Mother, Dee Ann (Bohn) Paulus, with her counsel,
Thomas J. Williams, Esquire.
3. A prior Order of Court, dated October 21, 200 I, was entered by the
Honorable Edward E. Guido, provided for shared legal custody with Mother having
primary physical custody and Father having periods of partial physical custody on
alternating weekends, and a holiday schedule. Father filed a Petition to Modify Custody
requesting shared physical custody.

The parties agreed to entry of an Order in the form as attached.

PLAINTIFF'S COMPLAINT TO CONFIRM CUSTODY
I. Plaintiff is Dee Ann (Bohn) Paulus, an adult individual currently residing at 16 Enck
Drive, Boiling Springs, Cumberland County, Pennsylvania.
2. Defendant is Douglas Bohn, an adult individual currently residing at 105 Ian Drive,
Mount Holly Springs, Cumberland County, Pennsylvania.
3. Plaintiff seeks primary custody of the children: Shane Michael Bohn, born
September 23, 1990, and Amanda Danielle Bohn, born April 8, 1993. The children were not born
out of wedlock.
4. The relationship of the Plaintiffto the children is that of mother. She is married and
living separately. The Plaintiff currently resides with the following:

5. The relationship of the Defendant to the children is that offather. He is married and

6. Plaintiff wishes to confirm the actual custody arrangement that has existed since
February 18, 2005.
7. Plaintiff does not know of any person not a party to these proceedings who claims to
have custody or visitation rights with respect to the children.
WHEREFORE, Plaintiff requests your Honorable Court to set a time and place for a hearing
at which Plaintiff requests the Court to grant her the Custody Order. Pending said hearing, Plaintiff
requests temporary custody.
