THIS AGREEMENT made the /~dayof ~ , 2003, by and
between RINE & R1NE BUILDERS (hereinafer referred to as "CONTRACTOR"), and CHET R.
SHANK and MICHELLE R. SHANK, husband and wife, (hereinafter referred to as "OWNER").
The parties have entered into an agreement (herein "AGREEMENT") whereby the CONTRACTOR
undertook and agreed to erect and construct a dwelling house on that certain lot of ground owned by
OWNER and situate in Southampton Township, Cumberland County, Pennsylvania, more
particularly described in Deed dated December 27, 2002, and recorded in the office of the Recorder
of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 255, Page 787, which is
incorporated herein by reference, and which is simultaneously here with being deeded to
OWNER'S.
NOW THEREFORE, THIS AGREEMENT WlTNESSETH: That the CONTRACTOR,
for and in consideration of the sum of One Hundred Seventy-One Thousand, Two Hundred
($171,200.00) Dollars to CONTRACTOR in hand paid by OWNER, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the Agreement between the parties, for
CONTRACTOR and CONTRACTOR'S subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by
CONTRACTOR or any of them against the buildings and the lot of ground appurtenant thereto (as
referred to above) for or on account of any work done or materials furnished by CONTRACTOR or
any of them under the Agreement or otherwise, for, towards, in, or about the erection and
construction of the building(s) on the lot above described, and the CONTRACTOR, for
CONTRACTOR, all subcontractors and others under them, hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the buildings or lot (or
any of them), and agree that this instrument, waiving the right of lien, shall be an independent
covenant.

BEGINNING at an existing railroad spike in the center of Township Route
323 (Walnut Dale Road) at corner of land now or formerly of Stewart E
Herritt; thence by lands of Herritt, North 04 degrees 26 minutes 41 seconds
East, 353.80 feet to an iron pin in line of Herritt at corner of other lands of
Gerald E Stafford; thence by lands of Stafford, South 85 degrees 40 minutes
19 seconds East, 184.68 feet to a concrete monument in line of lands of
Stafford at corner of Lot No. 2 on the aforesaid subdivision plan; thence by
Lot No. 2, South 04 degrees 19 minutes 41 seconds West, 430.22 feet to a
railroad spike in the center of Walnut Dale Road; thence with the center of
said road, North 63 degrees 16 minutes 08 seconds West, 200.54 feet to a
railroad spike in the center of said road, the point and place of BEGINNING.
