Petitioner is Daniel M. Strom, Defendant/Petitioner (hereinafter referred to as "Father"), who currently resides at 1800 Hunter Drive, Mechanicsburg, Cumberland County, Pennsylvania and is represented by Michelle L. Sommer, Esquire, of Abom & Kutulakis, L.L.P. 2. Respondent is Michelle L. Strom, Plaintiff/Respondent (hereinafter referred to as "Mother"), who currently resides at 268 Redwood Lane, Carlisle, Cumberland County, Pennsylvania. 3. On or about February 24, 1999, the parties entered into a Stipulation for Custody, wherein the parties share legal custody of Gwendolyn I. Strom (hereinafter referred 1?cTly ? 70.0O PD CPd4lq to as the "Minor Child") and Mother and Father agreed that Mother would have primary physical custody of the Child and Father would have partial physical custody. 4. The Order was signed by the Honorable Judge Edward E. Guido on March 1, 1999. (A true and correct copy of the Order of Court is attached hereto as "Exhibit A"). 5. Paragraphs one (1) through four (4) of this Complaint are incorporated herein by reference as though set forth in full. 6. This Agreement should be modified because: a. Mother was injured while at work in the of Fall 2006 and now suffers from a debilitating injury known as Reflex Sympathetic Dystrophy (RSD) and as a result suffers from extreme pain and is primarily committed to a wheelchair. i. Due to her injury, Mother is unable to perform the day-to-day functions of caring for the Minor Child in question; and as a result, now only has partial custody of her other child (Mallory McNulty, age 7) to her ex-husband. 1. Visitation with the other child consists of every Wednesday evening and three (3) weekends per month from Friday until Sunday. 2. However, the half-sister's visitation must be supervised per Court Order, stating that there must be an adult over the age of 18 present during the half-sister's visitation. 3. The supervising person usually is both the Minor Child's and half-sister's Grandmother, Mother's mother, Joyce Brewer. ii. Mother suffers from extreme pain and takes three (3) different pills on a daily basis to deal with the excruciating pain and two (2) anti- depressants, which causes her to sleep a significant amount of the time throughout the day and evening; whereby allowing the Minor Child to care for herself, Mother and their home. iii. The large amount of medication that Mother is currently taking causes her to hallucinate; however, when confronted about this she never remembers these visions. b. The Father can both provide a stable home for the Minor Child; as well as, continuity in her life while she is in school, so that she can prosper and grow not only with her educational studies, but in her family life. c. Father will be able to ensure that the Minor Child will maintain a relationship with her half-sister as he and Mother's ex-husband, Patrick McNulty, have a good relationship and will ensure that the half-sisters maintain the same custodial schedule when visiting Mother; as well as, the same holiday schedule since the half-sisters are extremely close. i. The Minor Child's half-sister visits every Wednesday evening and three (3) weekends per month from Friday to Sunday. d. The Minor Child has expressed a recent desire to relocate to Father's residence as she and Mother are in conflict. i. The Minor Child has expressed to Father that she has assumed the role as caretaker of not only herself, but of Mother and her half-sister when she is there for her custodial visits due to Mother's limited abilities to perform her parental duties. ii. The Minor Child and Mother are fighting on a regular basis over the parental duties she now has to perform on Mother's behalf and this is causing the Minor Child an enormous amount of stress and Father has noticed a change in her personality. e. Father will both be able to ensure the Minor Child's safety and care while she is living with him and his fiancee, Amy Dutka. f. The Minor Child has a psychological bond with the Father and his fiancee, Amy Dutka. i. In fact, the Minor Child is extremely close to her soon-to-be Step- Mother and is very involved in the wedding planning; as well as being a bridesmaid in the wedding planned for June 25, 2011. g. Father can provide for the Minor Child both financially and emotionally while she is in his care. h. Father and Mother only live approximately ten (10) miles apart and Father can ensure that the Minor Child will be able to visit Mother not only on her scheduled visitation weekend, but also any additional days she may want to see her Mother and will provide the necessary transportation as Mother is unable to drive due to her medical condition. i. Due to Mother's medical condition from her recent injury in the Fall of 2006 has forced her to become dependent to pain medication which now causes an inability for Mother to function with normal day-to-day parenting skills one should be able to successfully be able to accomplish. i. The limited mobility of Mother due to the excruciating pain on her knee has caused Mother to take high doses of pain medication. ii. The large amount of medication and variety that Mother is currently taking causes her hallucinations; however, Mother never remembers these visions and becomes very angry when she is confronted about the hallucinations by the Minor Child and her own mother. iii. Mother's limited mobility and excruciating pain in her knee has also caused her to become dependent on the Minor Child to help with not only Mother's care, but to help with the day-to-day household responsibilities as well. j. Father has the flexibility to modify his work schedule to accommodate additional time with the Minor Child and any extra-curricular activities she may want to become involved in throughout the year. The parties will share joint legal custody of Gwendolyn Ivy Strom. The parties agree that major decisions concerning their Child, including, but not necessarily limited to, the Child's health, welfare, education, religious training and upbringing, shall be made by them jointly, after discussion and consultation with each other, with a view 2 .r toward obtaining and following a harmonious policy in the Child's best interest. Each party agrees not to impair the other party's rights to shared legal custody of the Child. Each party agrees not to attempt to alienate the affections of the Child from the other party. Each party shall notify the other of any activity or circumstance concerning their Child that could reasonably be expected to be of concern to the other. Day to day decisions shall be the responsibility of the parent then having physical custody. With regard to any emergency decisions, which must be made, the parent having physical custody of the Child at the time of the emergency shall be permitted to make any immediate decisions necessitated thereby. However, that parent shall inform the other of the emergency and consult with him or her as soon as possible. In accordance with 23 Pa.C.S.A. §5309, each party shall be entitled to complete and full information from any doctor, dentist, teacher, professional or authority and to have copies of any reports or information given to either party as a parent as authorized by statute. Mutual agreement should be made, in advance, regarding the following matters: enrollment or termination in a particular school or school program, advancing or holding the Child back in school, authorizing enrollment in college, authorizing their Child's driver's license or purchase of an automobile, authorizing employment, authorizing either Child's marriage or enlistment in the armed forces, approving a petition for emancipation, authorizing foreign travel, passport application or exchange student status. 2. PHYSICAL CUSTODY: a. Father will have primary physical custody of the Child. b. Mother will have partial physical custody of the Child as follows: 1. Mother will have custody of the Child three (3) weekends per month from 3 Friday evening at 3:00 p.m. until Sunday at 4:00 p.m. 2. Mother will also have visitation of the Child on Wednesday evening from 3:00 p.m. until 7:00 p.m. c. Should the Child decide that she would like to spend additional time with her Mother, an agreement can be reached at anytime by the parties and the Child. 3. HOLIDAYS: a. Shall be by agreement of the parties. 4. TELEPHONE CONTACT: a. Each parent shall be entitled to reasonable telephone contact with the Child which shall not be excessive as well as daily contact via e-mail with the Child when in the custody of the other parent. 5. The parents shall organize ways for their Child to maintain their friendships, extracurricular activities, and other special interests, regardless of which household they may be in. It is also suggested that toys, clothes, etc. not become matters of contention. Major gifts should be discussed and coordinated between the parents. 6. The parents shall permit and support the Child's access to all family relationships. Special family events such as weddings, family reunions, family gatherings, funerals, graduations, etc. shall be accommodated by both parties with routine visitations resuming immediately thereafter. Each parent shall have the option of proposing time or date variations to the other parent when special recreational options or other unexpected opportunities arise. Each parent must confer with the other parent before arranging regularly occurring extracurricular activities for the Child which might interfere with regular visitation. 7. During any period of custody or visitation, the parties to this Order shall not possess or 4 JF" use any controlled substance, nor shall they consume alcoholic beverages to the point of intoxication, nor smoke cigarettes inside the residence or vehicle. The parties shall likewise assure, to the extent possible, that other household members and/or houseguests comply with this prohibition. 8. NO CONFLICT ZONE: a. Each parent agrees not to attempt to alienate the affections of the Child from the other and will make a special conscious effort not to do so. Both parents shall establish a no-conflict zone for their Child and refrain from making derogatory comments about the other parent in the presence of the Child and, to the extent possible, shall not permit third parties from making such comments in the presence of the Child, whether the Child is sleeping or awake. Each parent shall speak respectfully of the other whether it is believed the other reciprocates or not Each parental figure shall refer to the other by the appropriate role name such as Mom, Dad, your grandmother, etc. Each parent should agree to refrain from encouraging the Child to provide reports about the other parent. Communication should always take place directly between parents, without using the Child as an intermediary. Each parent should encourage their Child to send the appropriate holiday cards to the other parent. 9. FUTURE MODIFICATIONS: a. Mother and Father shall be free to mutually agree to alter and/or change the terms of this agreement. If the alteration and/or agreement is permanent and/or a change which will occur on numerous occasions, the parties agree the alteration and/or change shall be in writing and signed by both parents. 5 10. JURISDICTION: a. The parties desire that this Stipulation and Agreement be made an Order of Court of the Court of Common Pleas of Cumberland County, and further acknowledge that the Court of Common Pleas of Cumberland County does, in fact, have jurisdiction over the issue of custody of the parties' minor Child, who has resided for at least the past six (6) months in Cumberland County, Pennsylvania. 11. The parties stipulate that in making this Agreement, there has been no fraud, concealment, overreaching, coercion, or other unfair dealing on the part of the other party. 12.
