Over the past three years, I have sustained water damage
to my condo due to leaking skylights. Due to the neglect and
indifference of the association and their contractor. (calls
not returned. no-~hows. etc.) and a faulty diagnosis of the
real problem (that the skylights needed to be repl?ceg - not
just caulked from time to time). th~ association. ~e~ing ~hei(
!~,!:'!:Rr....., agreed IN WRITING, to pay for the inside drywall damage
and painting,
[ acquired two estimates, the LOWER of which I gave to
Mr", Harpst.er, the association's president. Believing this
estimate to be too high, Mr. ,Harpster wanted to get: his own.
(After three years of this. I figured "what's another week?")
After a week and a half of hearing nothing from Harpster - not
even a status repart(which I asked for) - I left him a message
asking him for the status within the next (4) days or I would
,
assume my estimate was O.K. with him and I would schedule the,
work,
I never heard a word. I got it done myself. Now. they
refuse to pay for it.
At the District Justice hearing, Mr. Harpster's only
defense was that he. "trying to be a nice gUY. didn't have to pay
for ANY of this in the first place."
The FACT is. he promised to - IN WRITING.
That. along with District Justice Elder's personal phone
call to PROPERTY MANAGEMENT. who told her I had called many. many
times over the past year(lheir records only gO back one year),
seemed to be major factors in her rendering her decision for me
in the amount I asked.
In his heart. Mr. Harpster is well "ware I am entitled
to that which was promised me. It is he, and he ALONE. that
has brought forth. this ordeal to its
