The Defendant is James Heffelfinger, an adult individual residing at 209 South Second Street, Wormleysburg, Cumberland County, PA 17043. 3. Plaintiff, at all times relevant hereto, is and has been the owner of the premises known as 209 South Second Street, Wormleysburg, PA. 4. The Defendant has been occupying said premises pursuant to a lease, dated February 1, 2003, which provided inter alia, for payment of $700.00 monthly rent, in advance. 5. The Defendant has failed to pay rent for April, May, June and July, 2003, and continues to occupy the property without paying rent. 6. The Defendant is liable for payment of said rent, as well as 10% late penalties and other penalties and damages in accordance with the lease and the law. 7. Defendant has also breached other terms and conditions of the lease. WHEREFORE, the Plaintiff demands judgment against the Defendant for eviction of Defendant, possession of premises, and damages, in accordance with the above, plus costs, interest and attorney fees.
