COMPLAINT IN MORTGAGE FORECLOSURE
Plaintiff, Allegra Credit Company ("Allegra"), states the following Complaint against
Defendant, Cynthia G. Lush alk/a Cynthia G. Lush-Middleton:
I. Altegra is a corporation organized under Pennsylvania law with offices located at
116 Allegheny Center, IDC 23-521, First Floor, Pittsburgh, Pennsylvania 15212.
2. Defendant, Cynthia G. Lush alk/aI Cynthia Lush-Middleton, is an adult individual
with a residence located at 5985 Eberly Drive, Mechanicsburg, Cumberland County,
Pennsylvania, 17055.
3. On or about February 5, 1997, Defendant Cynthia G. Lush alk/aI Cynthia Lush-
Middleton made, executed and delivered to Altegra Credit Company a promissory note to pay
Altegra ONE HUNDRED THIRTY THOUSAND ONE HUNDRED AND 00/100
($130,100.00), together with interest at the rate set forth therein (the "Note"). A true and correct
copy of the Note is attached hereto, made a part hereof, and marked as Exhibit "A".
4. On or about February 5, 1997, Defendant Cynthia G. Lush alk/aI Cynthia Lush-
Middleton made, executed and delivered to Altegra a Mortgage upon the real property located at
5985 Eberly Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. (the "Mortgaged
Property") as security for payment of all sums due under the Note (the "Mortgage"). The

Mortgage is recorded in the Omce of the Rccorder of Deeds in and for Cumberland County,
Pennsylvania in Mortgage Book Volume 1364, Page 364 etc, A true and correct copy of the
Mortgage is attached hereto, made a part hereof, and marked as Exhibit "8".
5. The Mortgage covers the property as more fuIJy described on Exhibit "A" which
is attached to the Mortgage and made a part thereof.
6. Pursuant to the Note, Defendant Cynthia G. Lush alkJaI Cynthia Lush-Middleton
is required to make mortgage payments of principal and interest in the amount of ONE
THOUSAND FOUR HUNDRED NINETY-NINE AND 40/100 DOLLARS ($1,499.40) on the
10T!l day of each month, beginning on April I 0, 1997 and continuing each successive month
thereafter until March 10,2027, the maturity date.
7. Defendant Cynthia G. Lush alkJaI Cynthia Lush-Middleton has defaulted on her
obligation to make timely mortgage payments by failing to make mortgage payments due for
August of 1998 through January, 1999.
8. Under the Note and Mortgage, upon Defendant Cynthia G. Lush alk/aI Cynthia
Lush-Middleton's failure to make mortgage payments when due, Allegra is entitled to declare all
the sums secured by the Mortgage due and payable and foreclose upon the Mortgage.
9. Altegra has complied with the notice provisions of Act 6, 41 P.S. glOI el. seq.
and Act 91, 35 P.S. gI680A01(c) el. seq. as to Cynthia G. Lush alk/aI Cynthia Lush-Middleton.
A true and correct copy of the notice sent to Defendant Cynthia G. Lush alk/aI Cynthia Lush-
Middleton pursuant to Act 6 is attached hereto, made a part hereof, and marked as Exhibit "C".
A true and correct copy of the notice sent to Defendant Cynthia G. Lush alkJaI Cynthia Lush-
Middleton pursuant to Act 91 is attached hereto, made a part hereof, and marked as Exhibit "0".
