pennsylvania;
e. Fern M. Gutshall, an adult individual, who resides at 34
Hamilton Road, Boiling springs, Cumberland county,
pennsylvania; and
f. Timothy Q. Murphy, an adult individual, who resides 'at
1215 old Gettysburg pike, Dillsburg, York county,
Pennsylvania.

The Defendant, Elizabeth B. smith, is the owner of record of
the land which is the subject of this action according to the
public records of cumberland county, Pennsylvania.

By Deed dated January 4, 1898 and recorded in the office of
the Recorder of Deeds, in and for Cumberland county, pennsylvania
on March 17,1947 in Deed Boo]c "~I", Volume 13, Page 72, William A.
coffey, assignee, for the benefit of the creditors of Daniel V. 'Ahl
and Thomas W. Ahl, Executor of the Estate of carrie W. Ahl conveyed
the land, which is the subject of this action, unto Elizabeth B.
smith. A copy of said Deed is attached hereto, marked as Exhibit
"A", and incorporated herein by reference.

plaintiffs aver that the said Elizabeth B. Smith is deceased,
having died Intestate, on July 2, 1900.

Plaintiffs believe and therefore aver that Elizabeth B. Smith
had several children and heirs, of whom only one is known, that
being Martin L. Smith, who died, Testate, on May 28, 1950.

Under the terms of the Last will and Testament of Martin L.
Smith, heir of Elizabeth B. Smith, dated March 28, 1947, .the
homestead, after the death of his wife, Ida F. Smith, and their
daughter, Ella May Smith, was to be distributed among his children,
Oma Seaman, Mary Ocker, Marshall L. Smith, Stella Whitcomb, Ida I.
Murphy, Lester A. Smith, Gretta Foose, Beulah V. Waggoner and
Kenneth Smith. A copy of the Last will and Testament of Martin L.
smith is attached hereto, marked as Exhibit "B" and incorporated
herein by reference.

The terms of the Last will and Testament of Martin L. smith
further provide that should any of his children be deceased at the
time of his death, or at the time of distribution, then the share
bequeathed to that child was to pass to their children who are
surviving at the time of distribution.

All of the above children of Martin L. smith and Ida F. Smith,
his wife, are now deceased.
9.
The deceased children of Martin L. Smith and Ida Fo Smith were
survived by the following children:
a. Oma Seaman - had two children, both of whom are deceased.
b. Mary Ocker - had seven children who are identified as:

Cumberland County, Pennsylvania;
3. Terry C. Murphy, 38 Old Town Road, Gardners,
Cumberland county, Pennsylvania;
4. Fay R. Finkey, 59 East South Street, Carlisle,
Cumberland county, Pennsylvania;
5. Fern M. Gutshall, 34 Hamilton Road, Boiling
Springs, Cumberland County, Pennsylvania; and
6. Timothy Q. Murphy,
Dillsburg,
York
County,
Pennsylvania.

Plaintiffs believe and therefore aver that Ella May Smith,
daughter of Martin L. Smith and Ida F. Smith, died without issue.

Upon the death of Martin L. Smith, his son, Lester A. Smith,
paid all real estate taxes due and owing on the mountain land which
is the subject of this action until his death on April 13, 1971.

Thereafter, from 1971 and up to and including 1994, Ida I.
Murphy, mother of the Plaintiffs, paid all real estate taxes on
said mountain land and, during said time, had no trespassing signs
and a chain placed at the entrance to said land, and Plaintiffs cut
wood and hunted on said land.

Since the death of Ida I. Murphy in 1995, the Plaintiff,
Patrick L. Murphy, on behalf of himself and the other Plaintiffs,
has been paying said taxes and seeking to keep trespassers off said
property as best he can.

Cumberland County real estate information setforth in the tax
assessment office, in and for Cumberland County, Pennsylvania
reflects that the land at issue consists of approximately five (5)
acres on Kuhn Road, situated in Monroe Township, Cumberland County,
Pennsylvania and that the owner of the land at issue is the Estate
of Martin L. Smith, care of Patrick L. Murphy, 106 Third street,
Box 175, Boiling Springs, PA 17007.

The Plaintiffs are in actual possession of the mountain land
which is the subject of this action, which land is more
particularly bounded and described as follows:
ALL THAT CERTAIN piece or parcel of land situate in the
Township of Monroe, County of Cumberland and state of Pennsylvania,
bounded and described as follows to wit.
BEGINNING at a post a corner in the line of Geo. B. Strock
thence by same North 25 degrees West 24 perches to a post, thence
by lands of Jacob Hoffort, South 85 degrees West 31 7/10 perches to
a post, thence by land of party hereto of the first part South 25
degrees East 37 perches to a post, thence North 57 degrees East 5
perches to a corner of John stammel, thence North 68 degrees East
23 perches to the place of Beginning, containing five acres and one
hundred and five perches.

The Plaintiffs and their deceased mother, Ida I. Murphy, have
been in actual, exclusive, and adverse possession of the property
above described, continuously for at least twenty-one (21) years
prior to the filing of this complaint, claiming to own the same in
fee against the whole world, and have paid all taxes of every kind
levied or assessed against the property during the period of
twenty-one (21) years continuously next preceding the filing of
this complaint, have cut wood and hunted on said property, while
also attempting to keep out trespassers.

A prior action to Quiet Title was filed in the Court of Common
Pleas in Cumberland County, Pennsylvania to No. 2150 civil 1992 and
was purged on october 29, 1996.
WHEREFORE, Plaintiffs pray that Defendants, and also all other
persons unknown, claiming any right, title, estate, lien, or
interest in the real property described in the Complaint adverse to
Plaintiffs' ownership, or any cloud upon Plaintiffs' title thereto,
may be required to set forth the nature of their several claims,
that all adverse claims of Defendants or any of them may be
determined by a decree of this Court; that by said decree it be
declared and adjudged that Plaintiffs are the owner of said
premises and that Defendant, her heirs and assigns have no estate
or interest whatever in or to said land and premises; that
Defendant, her heirs and assigns, be forever barred from asserting
any claim whatever in or to said land and premises adverse to
Plaintiffs, and for such other and further relief as to equity
shall seem meet.

Murphy, by his attorney, Anthony L. DeLuca, Esquire, and complains
of Defendants above named, and also all other persons unknown,
claiming any right, title, estate, lien, or interest in the real
property described in the complaint adverse to Plaintiff's
ownership, or any claim upon Plaintiff's title thereto, and for the
claims of action alleges:
1.
The Plaintiffs are:
a. Patrick L. Murphy, an adult individual, who resides at
106 Third street, Boiling springs, Cumberland county,
pennsylvania;
b. Jane Myers, an adult individual, who resides at 620
Gutshall Road, Boiling springs, Cumberland County,
Pennsylvania;
c. Terry C. Murphy, an adult individual, who resides at 38
Old Town Road, Gardners, Cumberland county, Pennsylvania;
d. Fay R. Finkey, an adult individual, who resides at 59
East South Street, carlisle, Cumberland County,
Pennsylvania;
e. Fern M. Gutshall, an adult individual, who resides at 34
Hamilton Road, Boiling springs, Cumberland county,
Pennsylvania; and
f. Timothy Q. Murphy, an adult individual, who resides at
1215 Old Gettysburg Pike, Dillsburg, York county,
Pennsylvania.

The Defendant, Elizabeth B. smith, is the owner of record of
the land which is the subject of this action according to the
public records of Cumberland county, Pennsylvania.

By Deed dated January 4, 1898 and recorded in the Office of
the Recorder of Deeds, in and for Cumberland County, Pennsylvania
on March 17, 1947 in Deed Book "M", Volume 13, Page 72, William A.
Coffey, assignee, for the benefit of the creditors of Daniel V. Ahl
and Thomas W. Ahl, Executor of the Estate of Carrie W. Ahl conveyed
the land, which is the subject of this action, unto Elizabeth B.
smith. A copy of said Deed is attached hereto, marked as Exhibit
"A", and incorporated herein by reference.

Plaintiffs aver that the said Elizabeth B. smith is deceased,
having died Intestate, on July 2, 1900.

Plaintiffs believe and therefore aver thot Elizabeth B. Smith
had several children and heirs, of whom only one is known, that
being Martin L. Smith, who died, Testate, on May 28, 1950.
6.
Under the terms of the Last Will and Testament of Martin L.
Smith, heir of Elizabeth B. Smith, dated March 28, 1947, ,the
homestead, after the death of his wife, Ida F. Smith, and their
daughter, Ella May Smith, was to be distributed among his children,
Oma Seaman, Mary Ocker, Marshall L. Smith, Stella Whitcomb, Ida I.
Murphy, Lester A. Smith, Gretta Foose, Beulah V. Waggoner and
Kenneth Smith. A copy of the Last Will and Testament of Martin L.
Smith is attached hereto, marked as Exhibit "B" and incorporated
herein by reference.

The terms of the Last Will and Testament of Martin L. Smith
further provide that should any of his children be deceased at the
time of his death, or at the time of distribution, then the share
bequeathed to that child was to pass to their children who are
surviving at the time of distribution.
8.
All of the above children of Martin L. Smith and Ida F. Smith,
his wife, are now deceased.
9.
The deceased children of Martin L. Smith and Ida F. Smith were
survived by the following children:

Plaintiffs believe and therefore aver that EllLl May Smith,
daughter of Martin L. Smith and Ida F. Smith, died without issue.

Upon the death of Martin L. Smith, his son, Lester A. Smith,
paid all real estate taxes due and owing on the mountain land which
is the subject of this action until his death on April 13, 1971.

Thereafter, from 1971 and up to and including 1994, Ida I.
Murphy, mother of the Plaintiffs, paid all real estate taxes on
said mountain land and, during said time, had no trespassing signs
and a chain placed at the entrance to said land, and Plaintiffs cut
wood and hunted on said land.

Since the death of Ida I. Murphy in 1995, the Plaintiff,
Patrick L. Murphy, on behalf of himself and the other Plaintiffs,
has been paying said taxes and s~eking to keep trespassers off said
property as best he can.

Cumberland County real estate information setforth in the tax
assessment off ice, in and for Cumberland County, Pennsylvania
reflects that the land at issue consists of approximately five (5)
acres on Kuhn Road, situated in Monroe Township, Cumberland County,
Pennsylvania and that the owner of the land at issue is the Estate
of Martin L. Smith, care of Patrick L. Murphy, 106 Third Street,
Box 175, Boiling Springs, PA 17007.

The Plaintiffs are in actual possession of the mountain land
which is the subject of this action, which land is more
particularly bounded and described as follows:
ALL THAT CERTAIN piece or parcel of land situate in the
Township of Monroe, County of Cumberland and state of Pennsylvania,
bounded and described as follows to wit.
BEGINNING at a post a corner in the line of Geo. B. Strock
thence by same North 25 degrees West 24 perches to a post, thence
by lands of Jacob Hoffort, South 85 degrees West 31 7/10 perches to
a post, thence by land of party hereto of the first part South 25
degrees East 37 perches to a post, thence North 57 degrees East 5
perches to a corner of John Stammel, thence North 68 degrees East
23 perches to the place of Beginning, containing five acres and one
hundred and five perches.

The Plaintiffs and their deceased mother, Ida I. Murphy, have
been in actual, exclusive, and adverse possession of the property
above described, continuously for at least twenty-one (21) years
prior to the filing of this complaint, claiming to own the same in
fee against the whole world, and have paid all taxes of every kind
levied or assessed against the property during the period of
twenty-one (21) years continuously next preceding the filing of
this complaint, have cut wood and hunted on said property, while
also attempting to keep out trespassers.

1215 Old Gettysburg pike, Dillsburg, York county,
Pennsylvania.

The Defendant, Elizabeth B. smith, is the owner of record of
the land which is the subject of this action according to the
public records of Cumberland County, Pennsylvania.

By Deed dated January 4, 1898 and recorded in the Office of
the Recorder of Deeds, in and for cumberland County, Pennsylvania
on March 17, 1947 in Deed Book "M", Volume 13, Page 72, William A.
coffey, assignee, for the benefit of the creditors of Daniel V. 'Ahl
and Thomas W. Ahl, Executor of the Estate of carrie W. Ahl conveyed
the land, which is the subject of this action, unto Elizabeth B.
smith. A copy of said Deed is attached hereto, marked as Exhibit
"A", and incorporated herein by reference.

plaintiffs aver that the said Elizabeth B. smith is deceased,
having died Intestate, on July 2, 1900.

Plaintiffs believe and therefore aver that Elizabeth B. Smith
had several children and heirs, of whom only one is known, that
being Martin L. Smith, who died, Testate, on May 28, 1950.

Under the terms of the Last will and Testament of Martin L.
Smith, heir of Elizabeth B. Smith, dated March 28, 1947, ,the
homestead, after the death of his wife, Ida F. Smith, and their
daughter, Ella May Smith, was to be distributed among his children,
Oma Seaman, Mary Ocker, Marshall L. Smith, Stella Whitcomb, Ida I.
Murphy, Lester A. Smith, Gretta Foose, Beulah V. Waggoner and
Kenneth Smith. A copy of the Last Will and Testament of Martin L.
Smith is attached hereto, marked as Exhibit "B" and incorporated
herein by reference.

The terms of the Last will and Testament of Martin L. Smith
further provide that should any of his children be deceased at the
time of his death, or at the time of distribution, then the share
bequeathed to that child was to pass to their children who are
surviving at the time of distribution.

All of the above children of Martin L. smith and Ida F. Smith,
his wife, are now deceased.
9.
The deceased children of Martin L. Smith and Ida F. smith were
survived by the following children:

Plaintiffs believe and therefore aver that Ella May Smith,
daughter of Martin L. Smith and Ida F. Smith, died without issue.

Upon the death of Martin L. Smith, his son, Lester A. Smith,
paid all real estate taxes due and owing on the mountain land which
is the subject of this action until his death on April 13, 1971.
12.
Thereafter, from 1971 and up to and including 1994, Ida I.
Murphy, mother of the Plaintiffs, paid all real estate taxes on
said mountain land and, during said time, had no trespassing signs
and a chain placed at the entrance to said land, and Plaintiffs cut
wood and hunted on said land.

Since the death of Ida I. Murphy in 1995, the Plaintiff,
Patrick L. Murphy, on behalf of himself and the other Plaintiffs,
has been paying said taxes and seeking to keep trespassers off said
property as best he can.
14.
Cumberland County real estate information setforth in the tax
assessment office, in and for Cumberland County, Pennsylvania
reflects that the land at issue consists of approximately five (5)
acres on Kuhn Road, situated in Monroe Township, Cumberland County,
Pennsylvania and that the owner of the land at issue is the Estate

Box 175, Boiling Springs, PA 17007.

The Plaintiffs are in actual possession of the mountain land
which is the subject of this action, which land is more
particularly bounded and described as follows:
ALL THAT CERTAIN piece or parcel of land situate in the
Township of Monroe, County of Cumberland and State of Pennsylvania,
bounded and described as follows to wit.
BEGINNING at a post a corner in the line of Geo. B. Strock
thence by same North 25 degrees West 24 perches to a post, thence
by lands of Jacob Hoffort, South 85 degrees West 31 7/10 perches to
a post, thence by land of party hereto of the first part South 25
degrees East 37 perches to a post, thence North 57 degrees East 5
perches to a corner of John Stammel, thence North 68 degrees East
23 perches to the place of Beginning, containing five acres and one
hundred and five perches.

The Plaintiffs and their deceased mother, Ida I. Murphy, have
been in actual, exclusive, and adverse possession of the property
above described, continuously for at least twenty-one (21) years
prior to the filing of this complaint, claiming to own the same in
fee against the whole world, and have paid all taxes of every kind
levied or assessed against the property during the period of
twenty-one (21) years continuously next preceding the filing of
this complaint, have cut wood and hunted on said property, while
also attempting to keep out trespassers.

East South street, Carlisle, Cumberland county,
Pennsylvania;
e. Fern M. Gutshall, an adult individual, who resides at 34
Hamilton Road, Boiling springs, Cumberland County,
Pennsylvania; and
f. Timothy Q. Murphy, an adult individual, who resides at
1215 Old Gettysburg Pike, Dillsburg, York county,
Pennsylvania.

The Defendant, Elizabeth B. smith, is the owner of record of
the land which is the subject of this action according to the
public records of Cumberland County, Pennsylvania.

By Deed dated January 4, 1898 and recorded in the Office of
the Recorder of Deeds, in and for Cumberland County, Pennsylvania
on March 17, 1947 in Deed Book "M", Volume 13, Page 72, William A.
coffey, assignee, for the benefit of the creditors of Daniel V.Ahl
and Thomas W. Ahl, Executor of the Estate of Carrie W. Ahl conveyed
the land, which is the subject of this action, unto Elizabeth B.
smith. A copy of said Deed is attached hereto, marked as Exhibit
"A", and incorporated herein by reference.

Plaintiffs aver that the said Elizabeth B. Smith is deceased,
having died Intestate, on July 2, 1900.
5.
Plaintiffs believe and therefore aver that Elizabeth B. Smith
had several children and heirs, of whom only one is known, that
being Martin L. smith, who died, Testate, on May 28, 1950.
6.
Under the terms of the Last will and Testament of Martin L.
Smith, heir of Elizabeth B. smith, dated March 28, 1947, ,the
homestead, after the death of his wife, Ida F. Smith, and their
daughter, Ella May Smith, was to be distributed among his children,
Oma Seaman, Mary Ocker, Marshall L. Smith, stella Whitcomb, Ida I.
Mur.phy, Lester A. Smith, Gretta Foose, Beulah V. Waggoner and
Kenneth smith. A copy of the Last will and Testament of Martin L.
smith is attached hereto, marked as Exhibit "B" and incorporated
herein by reference.

The terms of the Last will and Testament of Martin L. Smith
further provide that should any of his children be deceased at the
time of his death, or at the time of distribution, then the share
bequeathed to that child was to pass to their children who are
surviving at the time of distribution.
8 .
All of the above children of Martin L. Smith and Ida F. smith,
his wife, are now deceased.
9 .
The deceased children of Martin L. smith and Ida F. smith were
survived by the following children:

Plaintiffs believe and therefore aver that Ella May smith,
daughter of Martin L. smith and Ida F. Smith, died without issue.

Upon the death of Martin L. Smith, his son, Lester A. smith,
paid all real estate taxes due and owing on the mountain land which
is the subject of this action until his death on April 13, 1971.
12.
Thereafter, from 1971 and up to and including 1994, Ida I.
Murphy, mother of the Plaintiffs, paid all real estate taxes on
said mountain land and, during said time, had no trespassing signs
and a chain placed at the entrance to said land, and Plaintiffs cut
wood and hunted on said land.

since the death of Ida I. Murphy in 1995, the Plaintiff,
Patrick L. Murphy, on behalf of himself and the other Plaintiffs,
has been paying said taxes and seeking to keep trespassers off said
property as best he can.

Cumberland County real estate information setforth in the tax
assessment! office, in and for Cumberland County, Pennsylvania
reflects that the land at issue consists of approximately five (5)
acres on Kuhn Road, situated in Monroe Township, Cumberland County,
Pennsylvania and that the owner of the land at issue is the Estate
of Martin L. Smith, care of Patrick L. Murphy, 106 Third street,
Box 175, Boiling Springs, PA 17007.

The Plaintiffs are in actual possession of the mountain land
which is the subject of this action, which land is more
particularly bounded and described as follows:
ALL THAT CERTAIN piece or parcel of land situate in the
Township of Monroe, County of Cumberland and state of Pennsylvania,
bounded and described as follows to wit.
BEGINNING at a post a corner in the line of Geo. B. Strock
thence by same North 25 degrees West 24 perches to a post, thence
by lands of Jacob Hoffort, South 85 degrees West 31 7/10 perches to
a post, thence by' land of party hereto of the first part South 25
degrees East 37 perches to a post, thence North 57 degrees East 5
perches to a corner of John Stammel, thence North 68 degrees East
23 perches to the place of Beginning, containing five acres and one
hundred and five perches.

The Plaintiffs and their deceased mother, Ida I. Murphy, have
been in actual, exclusive, and adverse possession of the property
above described, continuously for at least twenty-one (21) years
prior to the filing of this complaint, cla~ming to own the same in
fee against the whole world, and have paid all taxes of every kind
levied or assessed against the property during the period of
twenty-one (21) years continuously next preceding the filing of
this complaint, have cut wood and hunted on said property, while
also attempting to keep out trespassers.
