Plaintiff is a National Banking Association located in Tilton, New Hampshire. As of January 1, 1998, Providian National Bank was merged into First Deposit National Bank, and the resulting entity took the name Providian National Bank." The account that is the subject of this lawsuit may have been either a First Deposit National Bank account or a Providian National Bank account prior to the merger, but is now an account of the new" Providian National Bank, which is the plaintiff herein. 2. Defendant is an individual whose address is 784 Lancaster Avenue, Enola, Cumberland County, PA 17025. 3. At a specific instance, the Defendant applied for and was granted credit by the Plaintiff at the terms and conditions agreed upon by the parties, as is more specifically shown by the Account Application and Agreement, true and correct copies of which are attached hereto, marked Exhibit A" and made a part hereof. 4. Defendant made purchases and/or received cash advances using said credit. 5. Plaintiff avers that the terms of the Agreement provide for acceleration of the entire balance due and owing upon Defendant's breach of the Agreement. 6. Thereafter, in breach of obligations under the Agreement, the Defendant failed to make payments as they became due. 7. Plaintiff avers that the balance due amounts to $6,657.77. 8. Plaintiff avers that interest has accrued at the rate of 6.00% per annum on the balance due from December 19, 1998. 9. HOKE Defendant(s) STIPULATION FOR ENTRY OF JUDGMENT AND SETTLEMENT AGREEMENT BETWEEN PROVIDIAN NATIONAL BANK AND KIRBY B. HOKE Defendant, Kirby B. Hoke and Plaintiff, Providian National Bank stipulate and agree as follows: WHEREAS, Plaintiff has instituted a Civil Action in Assumpsit at No. 1999-900 in the Court of Common Pleas of Cumberland County, Pennsylvania seeking the principal amount of $6,657.77, plus interest at a rate of 6% per annum from December 19,1998 and attorneys fees at the rate of 33 1/3% of the debt due; WHEREAS, the parties agree that some amount is due and owing to Plaintiff and n.re desirous of amicably ~ett!ing the ar:tion; WHEREAS, Defendant has expressed a desire to effectuate settlement through a monthly payment plan to Plaintiff, through the offices of Plaintiff's counsel; WHEREAS, Plaintiff is willing to accept tender of payments in settlement of Plaintiff's claims against the Defendant, provided that the tender of said monies be in the manner and at the times set forth below and provided that Defendant fully comply and perform all other terms and conditions set forth in the within Agreement. WITNESSETH: In consideration of the amicable settlement of the aforementioned Civil Action, and the promises and covenants hereinafter set forth, Plaintiff and Defendant agree and stipulate as follows: FIRST A Judgement shall be entered in the Court of Common Pleas of Cumberland at Case No. 1999-906 in the amount of $9,265.18 plus interest and costs. That Defendant shall pay to the Plaintiff the slim of $9,265.18, together with interest at the rate of 6% per annum over the life of the payment term, in settlement of this matter. SECOND THIRD That payment of the aforementioned sum of $9,265.18, plus interest shall be made by Defendant through the tender of consecutive monthly payments of $304.00, due on the 25th day of each and every month, commencing on February 25, 1999, and continuing monthly thereafter, until the sum of $9,265.18 plus interest and costs is paid in full. Defendant is to make all remittances to the offices of the Plaintiff's attorney. FOURTH That each and every date for payment stated herein shall be construed with TIME BEING OF THE ESSENCE without extension, waiver, or delay. FIFTH That should Defendant be in default under any of the terms or conditions heretofore listed, Plaintiff shall enter execution on the Judgment amount, less any payments actually made by the Defendant, together with legal interest at the rd.te of 6% pel' d.nnUl(, and costs. SIXTH That Plaintiff and Defendant are competent to execllte this agreement and accept full responsibility therefore, and that the within agreement constitutes the entire agreement between the parties hereto, and that no modification, alteration or waiver of any term or condition appearing herein shall be effective unless contained in a writing signed by the parties. Plaintiff and Defendant warrant that no promise or inducement has been offered except as herein set forth, that this agreement is executed withollt reliance upon any statement or representation concerning the nature and extent of the claims and damages or legal liability therefore. SEVENTH That upon payment in full of the amount of $9,265.18 plus interest at 6% per annum, Plaintiff shall Satisfy the action filed at Case No. 1999-906 in the Court of Common Pleas of Cumberland County.
