COM P L A I N T
1. Plaintiff, COUNTRYWIDE HOME LOANS, INC. D/B/A AMERICA'S
WHOLESALE LENDER, is a corporation, with an address of 6400
Legacy Drive, PIano, Texas, 75024-3632.
2. Defendant, DAVID B. PEPPERMAN, is an adult individual
whose last known address is 430 ORRS BRIDGE ROAD, CAMP HILL,
PENNSYLVANIA 17011. Defendant, CHRISTINE A. PEPPERMAN, is an
adult individual whose last known address is 430 ORRS BRIDGE
ROAD, CAMP HILL, PENNSYLVANIA 17011.
3. On or about April 4, 1996, the said Defendants executed
and delivered a Mortgage Note in the sum of $123,400.00 payable
to AMERICA'S WHOLESALE LENDER. The said Note is not accessible
to Plaintiff and is believed to have been lost. In further
answer thereto, a copy is believed to be in the possession of
Defendants.
Plaintiff also avers that the within Mortgage
foreclosure complaint is based upon the Mortgage and that the
attachment of a copy of the Note is unnecessary pursuant to Rules
1019(h) and 1141(a) of the Pennsylvania Rules of Civil Procedure.
4. Contemporaneously with and at the time of the execution
of the aforesaid Mortgage Note, in order to secure payment of the
same, Defendants made, executed, and delivered to original
Mortgagee, a certain real estate Mortgage which is recorded in

the Recorder of Deeds Office of the within County and
Commonwealth in Mortgage Book 1314, Page 32 conveying to original
Mortgagee the subject premises. Countrywide Home Loans is doing
business as America's Wholesale Lender. Said Mortgage is
incorporated herein by reference.
5. The land subject to the Mortgage is: 1680 HIGH STREET,
CAMP HILL, PENNSYLVANIA 17011 and is more particularly described
in Exhibit "A" attached hereto.
6. The said Defendants are the real owners of the land
subject to the Mortgage.
7. The Mortgage is in default due to the fact that
Mortgagors have failed to pay the installment due on April 1,
1998 and all subsequent installments thereon, and the following
amounts are due on the Mortgage:
(a) Unpaid principal balance $ 121,399.24
(b) Interest at $27.44 per day
from 3/1/98 to 3/1/98
(based on contract rate of 8.250%)
(f) 5% Attorney's Commission

*Together with interest at the per diem rate noted in (b) above

The attorney's fees set forth above are in conformity with
the Mortgage documents and pennsylvania law, and will be
collected in the event of a third party purchaser at Sheriff's
WHEREFORE, Plaintiff demands judgment in Mortgage
foreclosure "IN REM" for the aforementioned total amount due
together with interest at the rate of 8.250% ($27.44 per diem),
together with other charges and costs including escrow advances
incidental thereto to the date of Sheriff's Sale and for
foreclosure and sale of the property within described.

Postcr and Dcscription in thc above entitled action upon the propcrty of David B.
Pcpperman and Christinc A. Pcppermanlocatcd at 1680 High Street, Camp Hill,
Cumberland County, Pennsylvania, according to law.
Michael E. Barrick, Deputy Sheriff, who being duly sworn according to law, says on
July 29,1999 at 3:16 o'clock P.M. EDST, he served a true copy of Real Estate Writ
Notice Poster and Description in the above entitled action upon one of the within named
defendants to wit: David B. Pepperman, by making known unto David Pepperman at
1901 State Street. Camp Hill Cumberland County, Pennsylvania, its contents and at the
same time handing to him personally the said true and attested copies of the same.
Michael E. Barrick, Deputy Sheriff who being duly sworn according to law, says on
July 29,1999 at 3:25 o'clock P.M. EDST, he served a true copy of Real Estate Writ
Notice Poster and Description, in the above entitled action upon one of the wihtin named
defendants to wit: Christine Pepperman, by making known unto Paul Duggan, Father at
2803 Columbia Avenue, Camp Hill, Cumberland County, Pennsylvania, its contents and
at the same time handing to her personally the said true and attested copies of the same.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says he served the
above Real Estate Writ Notice Poster and Description in the following manner: The
Sheriff mailed a notice of the pendency of the action to one of tile within named
defendants to wit; David Peppenman by regular mail to his last known address 2102
Foxfire Drive, Camp Hill, Pennsylvania. This letter was mailed under the date of July 29,
1999 and returned to the Sheriff's Office on August 4, 1999 with reason checked No
Such Number.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says he served the
above Real Estate Writ Notice Poster and Description in the following manner: The
Sheriff mailed a notice of the pendency of the action to one of the within named
defendants to wit: Christine Pepperman by regular mail to her last known address 2803
Columbia Avenue, Camp Hill, Pennsylvania. This letter was mailed under the date of
July 30, 1999 and never returned to the Sheriff's Office.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says after due and
legal notice had been given according to law, exposed the within described premises at
public venue or outcry at Court House, Carlisle, Cumberland County, Pennsylvania, on
September 1,1999 at 10:00 o'clock A.M. EDST, and sold the same for the sum of
$110,000.00 to Attorney Jill Wineka for Federal National Mortgage Association. It being
the highest bid and best price received for the same Federal National Mortgage
Association of 1900 Market Street, Suite 800, Philadclphia, Pennsylvania being the buyer
in this Execution paid to R. Thomas Kline Sheriff, the sum 01'$ 3,241.59 it being costs.
