it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Thursday" December 16, 2004 at 10:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to appear at the conference may
provide grounds for entry of a temporary or permanent order.

PETITION TO MODIFY CUSTODY
AND NOW, this 17th day of November, 2004, comes the Petitioner, Ann M. Barker, by and
through her attorneys, Hanft & Knight, P.C., and files the following Petition to Modify Custody and
in support thereof avers as follows:
1. The Petitioner is Ann M. Barker, an adult individual residing at 713 Evergreen Lane,
Milford, Delaware, 19963.
2. The Respondent is Brian 1" Chronister, an adult individual residing at 1694 Newville
Road, Carlisle, Pennsylvania, 17013.
3. Petitioner seeks a modification of the Order of Court dated April 9, 1999, a copy of
which is attached hereto and made a part hereof and is marked as Exhibit "A."

Said children were born out of wedlock.
The children are presently in the physical custody of the Respondent.
In addition to Respondent's present address, during the past five years, the children have
resided with the following persons at the following addresses: None.
The mother of the children is the Petitioner, Ann M. Barker, who resides at 713 Evergreen
Lane, Milford, Delaware, 19963.
The father of the children is the Respondent, Brian L. Chronister, who resides at 1694
Newville Road, Carlisle, Pennsylvania, 17013.
5. The relationship of Petitioner to the children is that of mother. She is unmarried. The
Petitioner currently resides with her fiance, Harry Weber, her nieces, Pebbles Smith and Heather
Smith and her nephew, Michael Smith.
6. The relationship ofthe Respondent to the children is that offather. He is unmarried.
The Respondent currently resides with the children and his brother, Michael Chronister and his
mother, Barbara Chronister.
7. The Petitioner has previously participated in litigation concerning custody of the
above-named child in this Court at the above-referenced docket. An Order of Court was entered on
April 9, 1999 Said Order is cited in Paragraph 3 above and is attached hereto as Exhibit "A" and by
reference incorporated herein.
The Petitioner has no knowledge of any custody proceedings concerning the custody of the
children pending before this or any other Court.
The Petitioner does not know of a person not a party to the proceedings who has physical
custody of the children or claims to have custody or visitation rights with respect to the children.
8. The best interests and permanent welfare of the children will be met if the custody
order is modified to grant Petitioner specific periods of partial custody because:
a) The Petitioner is a fit parent who can best take care of the children;
b) The Petitioner can provide the children with a home with adequate moral, emotional
and physical surroundings as required to meet the childrens' needs;
c) The Petitioner is, and has always been, willing to accept partial custody of the
children;
d) The Petitioner continues to exercise parental duties and responsibilities and enjoys
the love and affection of the children; and
e) The previous Order does not reflect a specific period of partial custody granted to the
Petitioner; and
f) The Parties have been unable to agree on a custody schedule for Petitioner, and
Respondent has refused to provide Petitioner with custodial time.
9. Each parent whose parental rights to the children have not been terminated and the
person who has physical custody of the children have been named as parties to this action. There
are no other persons who are known to have or claim a right to custody or visitation ofthe children.
WHEREFORE, the Petitioner respectfully requests Your Honorable Court modify the
Custody Order dated April 9, 1999, and grant Petitioner specific periods of partial custody of said
children.

I. The prior Order of Court dated April 9, 1999 is hereby vacated.
2. The Mother, Ann M. Barker, and the Father, Brian L. Chronister shall
have shared legal custody of Shannon Lynn Chronister, born March 19, 1990, Karinna
Lynn Chronister, born March 6,1993, and Lauren L. Chronister, born February 4,1994.
Each parent shall have an equal right, to be exercised jointly with the other parent, to
make all major non-emergency decisions affecting the Children's well-being including,
but not limited to, all decisions regarding their health, education and religion.
3. Father shall have primary physical custody of the Children.
4. Mother shall have periods of partial physical custody as follows:
A. The third weekend of every month from Friday at 7:00 p.m. to Sunday
at 7:00 p.m., unless Mother has visits with the Children otherwise
during that month as follows.
B. One week in June, July and August, from Friday to Friday at 7:00 p.m.
For 2005 those weeks shall be June 17-24, July 15-22, and August 12-
19. In future years the parties shall agree to the weeks by May 1 of
that year.
C. Every Thanksgiving from Wednesday at 7:00 p.m. to Sunday at 7:00
p.m.
D. Christmas from December 26 at 10:00 a.m. to January 1 at 7:00 p.m.
E. Alternating Easters from Friday at 7:00 p.m. to Sunday at 7:00 p.m.
Mother shall have Easter in 2006. It is understood that ifKarinna is
performing at church, she will not be required to visit with Mother, but
the other two Children will.
F. Mother's Day weekend from Friday at 7:00 p.m. to Sunday at 7:00
p.m.

G. In the event Mother is in Carlisle for any reason, she shall be entitled
to two hours with the Children, unless they have prescheduled
activities.
5. Transportation shall be shared such that the parties will meet at the
Lancaster McDonald's off ofRt. 283/30. There shall be a 30-minute grace time for both
parties. Mother or the Children shall contact Father when they are leaving Delaware.
6. Neither party shall use illegal drugs or permit the children to be exposed to
illegal drugs, nor partake in alcoholic beverages to the point of intoxication while the
Children are in their physical custody.
7. Mother shall not permit the Children to be in the presence of her bothers.
8. The Children are not permitted while in Mother's physical custody to
travel to Michigan. Mother will insure that Children's clothing transfers with the
Children. The Children will not go on sleepovers while in their Mother's custody.
9. This Order is entered pursuant to an agreement of the parties at a Custody
Conciliation Conference. The parties may modify the provisions of this Order by mutual
consent. In the absence of mutual consent, the terms of this Order shall control. Another
Conciliation Conference is scheduled for September 1,2005 at 8:30 a.m.
