The facts of the most recent incident of abuse are as follows: On February 12, 1999 at about 12:00p.m. at the parties' residence at Bellaire Avenue, Apt.#l, Carlisle,PA, the defendant, plaintiff and their children were outside in front of their house. The defendant got angry because he was trying to make Rebecca come to him and she would not. He got angry with the plaintiff and threw a small board at her, which missed. He then threw a small rock at her, which hit her in the hip and caused substantial pain. The plaintiff contacted the police, who filed harassment, simple assault, and terroristic threat charges against defendant. 12. Defendant has committed prior acts of abuse against Plaintiff, as follows: when such acts of abuse occurred: a) On or about February 8, 1999, the plaintiff was bathing the children and Rebecca was upset because she did not want her hair washed. The defendant was angry because the children were making noise. The defendant punched the plaintiff in her ribs, causing her substantial pain. b) On or about January 15, 1999, at 205 West Main St., Newburg, PA, the plaintiff was fixing the children's hair while sitting on the floor. The defendant got angry with the plaintiff because he said she was wasting time. He punched her in the head and kicked her in the ribs, causing her substantial pain. c) Sometime in the beginning of January, 1999, in Newburg, the defendant was angry with his employment situation. He kicked the plaintiff in her shins while wearing steel toe work boots. This caused her substantial pain. d) Sometime after December 25, 1998, the plaintiff was hiding from the defendant in the bathroom. He came in, hit her in the face twice, causing her head to hit the wall. All of this caused plaintiff substantial pain. e) Sometime around December 25, 1998, in Newburg the plaintiff and the defendant were working with a band saw they had just purchased. He got angry with her because she was not using the saw the way he wanted her to use it and hit her in the head with a small piece of wood, causing substantial pain. f) Sometime around December 25, 1998, in Newburg, the defendant got angry at plaintiff and threw a blue marker at the her. It missed but ripped through a canvas painting on the wall. He then threw the marker again and hit her in the face, causing a cut on her forehead. g) Sometime between March and September, 1998, in North Carolina, while living at the Surf Condos, the defendant got angry because he thought the plaintiff had his bankcard. She was upset and screaming. He grabbed her and tried to hold her nose and mouth shut so she would be quiet, then bit her in the forehead, causing substantial pain and drawing blood. h) Sometime between October 1995, and February 1996, while living in Panama City, Florida, the defendant got angry with the plaintiff. He threw her on the bed while she was holding their oldest daughter, Cecilia, and started choking her. He was choking her so hard that she could not control her bodily functions and she urinated on herself. i) Sometime between 1991 and 1994, the defendant was so angry with the defendant that he bit herlll so hard that it blackened both of her eyes and caused her substantial pain. j) In the past six months, defendant has threatened to kill plaintiff if she tried to put him in jail or have the children taken from him. He has told her that "if you take the children away, I will fucking kill you" and he would follow her no matter where she went and find and kill her. 13. Identify the police department or law enforcement agency in the area in which Plaintiff lives that should be provided with a copy of the protection order: Shippensburg & Carlisle Police Departments 14. There is an immediate and present danger of further abuse from the Defendant. Without admitting the allegations of abuse, the defendant agrees that the Court shall enter an Order containing the following terms: 1. Defendant shall not abuse, cause reasonable fear of abuse, threaten with violence, or harass plaintiff, whether personally or through his agents. 2. Defendant shall not enter any of plaintiff's future places of employment. 3. Except for contact pertaining to the minor children, Cecilia and Rebecca, defendant agrees not to trespass at plaintiff's residence, currently 6 Koser Road, Shippensburg, PAc 4. Defendant shall not to harass or stalk plaintiff or plaintiff's relatives. 5. Except for contact pertaining to the minor children, the defendant shall not have any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications. 6. Plaintiff shall have general physical and legal custody of Cecilia and Rebecca Shughart. Defendant shall have temporary partial custody the minor children for three (3) days per week, as agreed upon by the parties. On weekdays, such visits shall be from 6:00 p.m. to " 9:00 p.m. On weekends, such visits shall be from noon to 9:00 p.m. The defendant will be responsible for the transportation. Defendant shall not take the children out of the State of Pennsylvania without express consent of the plaintiff. 7. The parties agree that these provisions shall be considered a temporary custody order that can be modified pursuant to further agreement or after petition and hearing. 8. The Carlisle and Shippensburg Police Department shall be provided with a certified copy of this Order by the plaintiff's attorney. This Order shall be enforced by any law enforcement agency where a violation occurs, by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the police officer. In the event that an arrest is made, under this section, the defendant shall be taken without necessary delay before the court that issued the order. When that court is unavailable, the defendant shall be taken before the appropriate district justice. (23 P.S. ~6113). 9.
