1. Petitioner is Defendant, TONIA J. WATSON-ELLIOTT, who currently resides at
1447 Olde Oak Court, Mechanicsburg, Cumberland County, PA 17050.
2. Respondent is Plaintiff, WILLIAM J. FLANNERY, who currently resides at
5121 Creek Drive, Harrisburg, Dauphin County, PA 17112.
3. Petitioner and Respondent are the natural parents of the following child:

4. A custody order was entered on February 25, 1999, in the Cumberland County
Court of Common Pleas. A stipulation for order was entered on May 17, 2000. A copy of the
custody orders are attached.
5. Petitioner seeks to modify the custody order because: The current custody order is
severely outdated. Defendant currently has custody weekdays with plaintiff having Tuesday and
Thursday overnight visitation. Minor child no longer wishes to continue the current weekday
visitation visits with plaintiff. Minor child was seeing a school counselor during the school year
and is currently under outpatient treatment with Dr. Sally Rooney and has asked for her
assistance in changing custody order.
6. Petitioner believes the custody order should be changed as follows: Defendant
will have custody of the minor child Sunday 7:00 pm through Friday 4:30 pm. Plaintiff will have
custody on alternate weekends from Friday at 4:30 pm to Sunday at 7:00 pm. g-3'00 P&(

AND NOW, TO WIT, this
1999, by agreement of the parties, WILLIAM JOHN
FLANNERY, Plaintif, and TONIA WATSON, Defendant, the following is entered as an ,
Order of the Court of Common Pleas of Cumberland County:
1. The Plaintiff and the Defendant shall have joint legal custody of the minor child
BRIANNA JORLYNN WATSON, born November 13, 1996 in Berks County,
Pennsylvania.

2. The Plaintiff and the Defendant shall have shared physical custody of the minor
child, with the Defendant having primary physical custody of the child.
3. The Plaintiff shall have partial physical custody of the minor child as follows:
A. Monday through Friday from 7:30 A.M. until 4:30 P.M;
B. On alternate weekends, commencing with the 7:30 A.M. partial
custody Friday morning until Sunday at 6:00 P.M;
C. In 2000 and even years thereafter from 9:00 A.M. until 9:00 P.M. on
the following holidays: New Year's Day, Easter, July 4 and Thanksgiving. In 1999 and
odd years thereafter from 9:00 A.M. until 9:00 P.M. on the following holidays:
President's Day, Memorial Day, and Labor Day;
D.. In 1999 and odd years thereafter from 3:00 P.M. on December 24 until
1:00 P.M. on December 25. In 2000 and even years thereafter, from 1:00 P.-M. December
25 until 6:00 P.M. on December 26;
E. For a period of six(6)weeks during the summer vacation months which
may be divided into three (3) separate two week periods. Written notice as to dates
desired shall be provided to the Defendant by the Plaintiff on or before April 1 of any
given year. The Defendant shall also have the right to three (3) separate two (2) week
periods of physical custody of the minor child during the summer months for vacation
purposes; and
F. For such additional periods of time as the parties may agree upon by ,
and between themselves.
4. Notwithstanding any other provision of this Order the Plaintiff shall have the
minor child on Father's Day and the Defendant shall have the minor child on Mother's Day.
The parties shall make arrangements by and between themselves so that each party has the
opportunity to spend a minimum of four (4) hours with the minor child on the child's
birthday.
5. Both parties shall have reasonable telephone calling privileges with the minor
child while the child is in the physical custody of the other party. Both parties shall have
access to report cards and other relevant information concerning the progress of the minor
child in school, and shall be informed and advised in advance of all school functions,
conferences and events. Both parties shall have the right to secure information concerning
the same directly from the child's school. Both parties shall have the right to full and
complete access to the minor child's medical records and shall be informed in advance of
all medical app6intments,' treatments ana proceaures, and immediate)iittorfnea U1 the
event of any medical emergency or treatment.
6. The parties agree the instant.Order by Agreement shall be entered as an Order
by the Court of Common Pleas of Cumberland County, Pennsylvania, which Court shall

it is hereby directed that parties and their respective counsel appear before Dawn S. Sunday,Esq. , the conciliator,
at 39 West Main Street,Mechanicsburg,PA 17055 on Tuesday,July 16,2013 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished,to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders,and Custody orders to the conciliator 48 hours prior to scheduled hearing.

consideration of the attached Custody Conciliation Report, it is ordered and directed as follows:
1. The prior Order of this Court dated May 22, 2000 shall continue in effect without
modification.
2. The parties shall not use the Child as a messenger between themselves but shall instead
communicate directly between themselves on all issues concerning the Child.
3. No party shall be permitted to relocate the residence of the Child which significantly impairs
the ability to exercise custody unless every individual who has custodial rights to the Child consents to
the proposed relocation or the Court approves the proposed relocation. A person proposing to relocate
MUST comply with 23 Pa. C.S. § 5337.

IN ACCORDANCE WITH CUMBERLAND COUNTY RULE OF CIVIL
PROCEDURE 1915.3-8,the undersigned Custody Conciliator submits the following report:
1. The pertinent information concerning the Child who is the subject of this litigation is as
follows:

2. A custody conciliation conference was held on August 22, 2013, with the following
individuals in attendance: the Father, William J. Flannery, and the Mother, Tonia J. Watson-Elliott
The Child, Brianna Watson, who is 16 years old, also attended at the request of the parties and spoke
with the conciliator.
3. The parties agreed that no changes are necessary to the custodial arrangements at this time.
Accordingly, the conciliator recommends an Order in the form as attached.
