AND NOW, this 25th day of July, 2005, comes the Plaintiff, Barbara A. Steigerwalt (now
known as Barbara A. Beam), by her counsel Barbara Sumple-Sullivan, Esquire, and files this
Motion to vacate the Court's Order dated August 14, 2000, which Order constituted an Amended
Qualified Domestic Relations Order. In support thereof, it is averred as follows:
I) Petitioner is Barbara A. Bream, formerly known as Barbara A. Steigerwalt.
2) Respondent is Blaine E. Steigerwalt.
3) The parties have presently reached an agreement to amend their Marital Settlement
Agreement, which agreement provides for an immediate cash payment to Plaintiff ofTen
Thousand Dollars ($10,000.00) in exchange for her relinquishment of certain rights in
Respondent's SERS pension.

WHEREFORE, the Petitioner asks that an order be entered terminating the Domestic

1. Plaintiff and Defendant were married on April 28, 1979 and divorced by this
Court on November 24, 1999.
2. On or about November 3, 1999, Plaintiff and Defendant entered into a Marital
Settlement Agreement settling all claims of their divorce. The Marital Settlement Agreement
provided in Paragraph 8, page 5, that Plaintiff would become Alternate Payee of certain of
Defendant's State Employee's Retirement System Benefits. A copy of said Agreement is
attached hereto as Exhibit "A"

7. The parties' Stipulation and Agreement for entry of a Domestic Relations Order,
as required by Paragraph 8, page 5 of the Marital Settlement Agreement, was entered on April
18, 2000. This Order was later amended and the court adopted the Amended Domestic Relations
Order on August 14,2000. (A copy of the amended Order is attached hereto as Exhibit "B" and
incorporated herein by reference.)

8. The Domestic Relations Order named Plaintiff "Alternate Payee" and awarded
her Twenty-Four and Three-One Hundredths percent (24.03%) of Member's monthly retirement
benefits as of October 1 7, 1998, once Member's benefits went into pay status.
9. Member has not elected to begin receiving r,etirement benefits to date and
Alternate Payee has not received any payments from Member's retirement benefits from the
State Employee's Retirement System.
10. The parties have mutually agreed to amend their Marital Settlement Agreement to
eliminate Plaintiff as an Alternate Payee on Defendant's State Employees' Retirement Pension
upon his payment to her of the lump sum ofTEN THOUSAND DOLLARS ($10,000.00). Said
payment is due and is being made by certified check to Plaintiff Alternate Payee upon the
signing of this Agreement and receipt thereof is acknowledg,~d by the Plaintiff Alternate Payee.
11. In consideration of receipt of the lump sum payment, Plaintiff Alternate Payee
does hereby waive, release and forever relinquish any and all rights which she may have in
Defendant's Member's SERS pension.
12. By execution of this Agreement, the parties agree to stipulate to the entry ofa
court order in the form attached hereto as Exhibit "C" to terminate and rescind the existing
Amended Domestic Relations Order and agree that same should be entered as an order of court.

13. Defendant agrees to reimburse and pay to Plaintiff all attorney fees and legal costs
she has incurred to effectuate the Amendment of the Marital Settlement Agreement, the drafting
of this Agreement and Stipulation, the drafting of the Motion to secure the amended order of
court vacating the existing Domestic Relations Order, as well as serving same on the State
Employee's Retirement System. Said sums shall be reimbursed to Plaintiff within ten (10) days
of presentment of said costs by Plaintiff to Defendant.

MARITAL SETTLEMENT AGREEMENT
THIS AGREEMENT, made this .,yc! day of -h~/a. 1999, by and
between BLAINE E. STEIGERWALT, IT, hereinafter referred to as "HUSBAND", and
BARBARA A. STEIGERWALT, hereinafter referred to as "WIFE".
WITNESSETH, That:
WHEREAS, the parties hereto are husband and wife, having been lawfully joined in
marriage on April 28, 1979, in Lehighton, Carbon County, Pennsylvania.
WHEREAS, one child was. bOrn of this marriage; Blaine R Steigerwalt, III, born 9/6/79.
WHEREAS, it is the mtention of the parties to settle fully and finally their respective
financial and property rights aild obligations as between each other arising out of the marriage
relationship or otherwise, including without limitation (1) the settling of all matters between them
relating to the ownership of real and personal property; (2) the settling of all matters between
them relating to the past, present and future support and/or maintenance of HUSBAND and
WIFE; and (3) the settling of all matters between them relating to any and all rights, titles and
interests, claims and possible claims in or against the estate of the other.
NOW THEREFORE, with the foregoing recitals being hereinafter incorporated by
reference and deemed an essential part hereof in consideration of the foregoing recitals, the
mutual promises, covenants and undertakings herein set forth, and for good and valuable
consideration, receipt of which is hereby acknowledged by each of the parties hereto, HUSBAND
and WIFE, each intending to be legally bound hereby, covenant and agree as follows:

At the time of the refinance, HUSBAND took cash out of the equity of the home in the
amount ofNmeteen Thousand Seven Hundred Eighty-nine imd 89/1 00 ($19,789.89) Dollars. Said
sum has been held in escrow by WIFE's counsel and, upon execution of this Agreement, shall be
released to WIFE, together with any accrued interest, in partial payment of her claims for
equitable distnbution.
7. MOTOR VEHTrT .1<'.S
WIFE shall have sole title and ownership of the partil:S' 1996 Subaru. HUSBAND shall
have sole title and ownership of the parties' 1993 Chevrolet. HUSBAND's vehicle is not
encumbered. WIFE's vehicle is encumbered. WIFE agrees to indemnify and hold HUSBAND
harmless for the debt associated with her vehicle. WIFE agrees to be responsible for all
HUSBAND's attorneys' fees incurred in defense of any claim or suit brought against him arising
from said debt or incurred to enforce this indemnification. The parties agree to execute any and
all documents necessary to effectuate this transfer.
8. PENSION
The marital portion of HUSBAND's SERS pension was valued at $208,073.44. The
parties agree that HUSBAND's SERS pension shall be divided so that WIFE receives $50,000.00
of this asset. This equates to 24.03% of the said monthly pension benefits earned as of October
17, 1998 and HUSBAND shall receive 75.97% ofthe said monthly pension benefit earned as of
October 17, 1998. The parties agree that the Marital CovertUJre fraction is 0.2403. HUSBAND

shall elect joint survivor annuity option so as to insure the payment of WIFE's .2403 portion of
said benefit after his death. If there is a pre-retirement death benefit to the plan, WIFE's interest in
that death benefit will be defined as 24.03% of the marital portion of that benefit.
Counsel for WIFE shall have prepared the necessary Qualified Domestic Relations Order
(or QDRO) and any other necessary orders to effectuate this paragraph by Pension Appraisers,
Inc. All costs associated with the drafting of the QDRO sha:U be shared by the parties. The Court
shall retain jurisdiction over these issues pending finalization of all necessary papers with
HUSBAND's employer. HUSBAND agrees to provide any lmd all information and/or
documentation necessary for the preparation and finalization of the QDRO.
Each party hereby waives all other all claims that he or she may have against the other to
any pension, leave, employee saving or other stock benefit program of the other except for as
provided herein. Specifically, WIFE shall retain her Thrift Savings Plan Account (estimated value
$7I,252.85) and her FERS pension. HUSBAND shall receive his Compensation Program
($4,848.60).
9. BANK ACCOlJNTS AND INVESTMENTS
Each party shall have sole possession of the bank: accolmts in their own names.
10. INSURANCE
Each party shall retain ownership of any life insurance policy in his or her name.

Commonwealth of Pennsylvania.

Alternate Payee for the purpose of equitable dist;ibution of this marital asset.

of Member of SERS, including any lump sum withdrawals or scheduled or ad hoc
increases, but excluding the disability portion of any disability annuities paid to
Member by SERS or any deferred compensation benefits paid to Member by SERS.
Equitable distribution of the marital property component of Member's retirement
benefit, as set forth in Paragraph Seven (7) shall commence as soon as admiflistratively
feasible after Member actually enters pay status and the entry of this Stipulation and
Agreement as a Domestic Relations Order acceptable to SERS, whichever is later.
9. Member hereby norninatesAltemate Payee as an irrevocable beneficiary
to the extent of the Alternate Payee's equitable distribution portion of the Member's
retirement benefit for any death benefrts payable by SERS. This nomination shall
become effective upon approval by the Secretary of the Retirement Board, or his
authorized representative of any Domestic Rel,itions Order incorporating this
Stioulation and Agreement. The balance of anv death benefrt remainina after the
allocation of t'le Alternate Payee's equitable distribution portion ("Balance;;) shall be
paid to the beneficiaries named by the Member on thi;! last Nomination of Beneficiaries
Form filed with the Retirement Board prior to Member's death. .
(a.) If the last Nomination of Beneficiaries Form filed by the Member prior
to Member's death (a) predates any approved Domestic Relations Order incorporating
this Stipulation and Agreement, and (b) names Altemate Payee as a beneficiary, then
(1) the terms of the Domestic Relations Order shall alone govem Alternate Payee's
share of any death benefit, and (2) for purposes of paying the Balance via the last
Nomination of Beneficiaries Form filed with the Retirement Board prior to Member's
death, Alternate Payee shall be treated as if the Alternate Payee predeceased
Member. No portion of the Balance shall be payable to the Alternate Payee's estate.
(b.) In addition, Member shall execute and deliver to the Alternate Payee
an authorization, in a form acceptable to SERS, which will authorize SERS to release
to the Alternate Payee all relevant information concerning Member's retirement
account. Alternate Payee shall deliver the authorizati'~n to SERS which will allow the
.Alternate Payee to check that she has been and continues to be properly nominated under
this paragraph. ..
10. The terms and amount of the Member's re,tirement benefits payable to the
Alternate Payee after SERS approves a Domestic Re,lations Order incorporating this
Stipulation and Agreement is dependent upon which option(s) is (are) selected by
Member upon retirement.. The Member and Altemate Payee expressly agree that
Member shall select Special Option 4, which is a joint and equitable distnbution percent (as
defined in Section 7) annuity payable during the lifetime of the Member with an equitable
distribution percent (as defined in Section 7) of such annuity payable thereafter to his
survivor annuitant, if living at his death, as set forth in 71 Pa.. C.S. Section 5705(a)(4), or any
succeeding statute.
::. The Member shall designate the Alternate Payee as his irrevocable survivor
annuitant. The intent of this Special Option 4 selection is to maintain levelized payments to
the Alternate Payee for her life in the event of the Member's death after retirement. The
Alternate Payee shall receive her equitable distribution pelrcentage of the annuity which is
payable to the Member during his lifetime, so that she shall receive a percentage of the
Member's check during his lifetime and the same amount, all other things being equal, if he
predeceases her after retirernent.

The Member and the Altemate Payee acknowledge that if the Alternate
Payee predeceases the Member prior to receipt of all of her payments payable from
SERS under this Order, including any death benefit, retirement benefit or lump sum benefit
the following will occur under this Special Option 4 selection: (1) the same monthly beneffl
which had been paid or would have been paid to the Alternate Payee during the Alternate
Payee's lifetime will be paid to the Altemate Payee's estate for the duration of the life of the
Member, and (2) any lump sum distributions, whether death benefits or l!Jmp sum
retirement benefits shall be paid directly to the Altemate, Payee's estate.
The Member and the Altemate Payee agree that the Member shall be
permitted, at his sole option, to select an Option 4 lump sum payment of all or part of his
accumulated deductions at the time he retires. The Altemate Payee shall be entitled to her
equitable distnbution portion of said lump sum distribution, calculated pursuant to Paragraph
7 of this Stipulation. The Alternate Payee's share of thl~ lump sum shall be deducted from
the Member's withdrawal and paid to the Alternate Pay€!e.
11. Alternate Payee may not exercise any right, privilege ot option offered by
SERS. SERS shall issue individual tax forms to Member and Alternate Payee for
amounts paid to each.
12. In no event shall Altemate Payee have greater benefits or rights other than
those which are available to Member. Alternate Paye,: is not entitled to any benefit not
otherwise provided by SERS. The Altemate Payee is only entitled to the specific benefits
offered by SERS as provided in this Stipulation and Agreement. All othi;lr rights,
privileges and options offered by SERS not granted to Altemate Payee are preserved for
Member.
13. It is specifically intended and agreed by the parties hereto that this Stipulation
and Agreement:

Does not require SERS to provide any type or form of benefit, or
any option not otherwise provided under the Retirement Code;
Does not require SERS to provide increaseCl benefits (determined
on the basis of actuarial value) unless increased benefits are paid
to Member based upon cost of living or increases based on other
than actuarial values. .
14. The parties intend and agree that the terms of this Stipulation and Agreement
shall be approved, adopted and entered as a Domestic Fielations Order.
15. The Court of Common Pleas of Cumberland County, Pennsylvania, shall

AND NOW, the parties, Plaintiff, Barbara A. Steigerwalt (now known as Barbara A.

Court on November 24, 1999.
2. On or about November 3, 1999, Plaintiff and Defendant entered into a Marital
Settlement Agreement settling all claims of their divorce. The Marital Settlement Agreement
provided in Paragraph 8, page 5, that Plaintiff would become Alternate Payee of certain of
Defendant's State Employee's Retirement System Benefits. A copy of said Agreement is
attached hereto as Exhibit "A."

7. The parties' Stipulation and Agreement for entry ofa Domestic Relations Order,
as required by Paragraph 8, page 5 of the Marital Settlement Agreement, was entered on April
18, 2000. This Order was later amended and the court adopted the Amended Domestic Relations
Order on August 14,2000. (A copy ofthe amended Order is attached hereto as Exhibit "B" and
incorporated herein by reference.)

8. The Domestic Relations Order named Plaintiff" Alternate Payee" and awarded
her Twenty-Four and Three-One Hundredths percent (24.03%) of Member's monthly retirement
benefits as of October 17, 1998, once Member's benefits went into pay status.
9. Member has not elected to begin receiving retirement benefits to date and
Alternate Payee has not received any payments from Member's retirement benefits from the
State Employee's Retirement System.
10. The parties have mutually agreed to amend their Marital Settlement Agreement to
eliminate Plaintiff as an Alternate Payee on Defendant's State Employees' Retirement Pension
upon his payment to her of the lump sum ofTEN THOUSAND DOLLARS ($10,000.00). Said
payment is due and is being made by certified check to Plaintiff Alternate Payee upon the
signing of this Agreement and receipt thereof is acknowledged by the Plaintiff Alternate Payee.
11. In consideration of receipt of the lump sum payment, Plaintiff Alternate Payee
does hereby waive, release and forever relinquish any and all rights which she may have in
Defendant's Member's SERS pension.
12. By execution of this Agreement, the parties agree to stipulate to the entry ofa
court order in the form attached hereto as Exhibit "e" to terminate and rescind the existing
Amended Domestic Relations Order and agree that same should be entered as an order of court.

13. Defendant agrees to reimburse and pay to Plaintiff all attorney fees and legal costs
she has incurred to effectuate the Amendment of the Marital Settlement Agreement, the drafting
of this Agreement and Stipulation, the drafting of the Motion to secure the amended order of
court vacating the existing Domestic Relations Order, as well as serving same on the State
Employee's Retirement System. Said sums shall be reimbursed to Plaintiff within ten (10) days
of presentment of said costs by Plaintiff to Defendant.

BARBARA A. STEIGERWALT, hereinafter referred to as "WIFE".
WITNESSETH, That:
WHEREAS, the parties hereto are husband and wife, having been lawfully joined in
marriage on April 28, 1979, in Lehighton, Carbon County, Pennsylvania.
WHEREAS, one child wa~ born of this marriage; Blaine E. Steigerwalt, III, born 9/6/79.
WHEREAS, it is the ititention of the parties to settle fully and finally their respective
financial and property rights aild obligations as between each other arising out of the maniage
relationship or otherwise, including without limitation (1) the settling of all matters between them
relating to the ownership of real and personal property; (2) the settling of all matters between
them relating to the past, present and future support and/or maintenance of HUSBAND and
WIFE; and (3) the settling of all matters between them relating to any and all rights, titles and
interests, claims and possible claims in or against the estate of the other.
NOW THEREFORE, with the foregoing recitals being hereinafter incorporated by
reference and deemed an essential part hereof in consideration of the foregoing recitals, the
mutual promises, covenants and undertakings herein set forth, and for good and valuable
consideration, receipt of which is hereby acknowledged by each of the parties hereto, HUSBAND
and WIFE, each intending to be legally bound hereby, covenant and agree as follows:
At the time of the refinance, HUSBAND took cash out of the equity of the home in the
amount ofNmeteen Thousand Seven Hundred Eighty-nine and 89/1 00 ($ I 9, 789 .89) Dollars. Said
sum has been held in escrow by WIFE's counsel and, upon execution of this Agreement, shall be
released to WIFE, together with any accrued interest, in partial payment of her claims for
equitable distnbution.
7. MOTOR VEHIrl .1<'.S
WIFE shall have sole title and ownership of the parties' 1996 Subaru. HUSBAND shall
have sole title and ownership of the parties' 1993 Chevrolet. HUSBAND's vehicle is not
encumbered. WIFE's vehicle is encumbered. WIFE agrees to indemnify and hold HUSBAND
hann1ess for the debt associated with her vehicle. WIFE agrees to be responsible for all
HUSBAND's attorneys' fees incurred in defense of any claim or suit brought against him arising
from said debt or incurred to enforce this indemnification. The parties agree to execute any and
all documents necessary to effectuate this transfer.
8. PENSION
The marital portion of HUSBAND's SERB pension was valued at $208,073.44. The
parties agree that HUSBAND's SERS pension shall be divided so that WIFE receives $50,000.00
of this asset. This equates to 24.03% of the said montWy pension benefits earned as of October
17, 1998 and HUSBAND shall receive 75.97% of the said monthly pension benefit earned as of
October 17,1998. The parties agree that the Marital Coverture fraction is 0.2403. HUSBAND

shall elect joint survivor annuity option so as to insure the payment of WIFE' s .2403 portion of
said benefit after his death. If there is a pre-retirement death benefit to the plan, WIFE's interest in
that death benefit will be defined as 24.03% of the marital portion of that benefit.
Counsel for WIFE shall have prepared the necessary Qualified Domestic Relations Order
(or QDRO) and any other necessary orders to effectuate this paragraph by Pension Appraisers,
Inc. All costs associated with the drafting of the QDRO shall be shared by the parties. The Court
shall retain jurisdiction over these issues pending finalization of all necessary papers with
HUSBAND's employer. HUSBAND agrees to provide any and all information and/or
documentation necessary for the preparation and finalization of the QDRO.
Each party hereby waives all other all claims that he or she may have against the other to
any pension, leave, employee saving or other stock benefit program of the other except for as
provided herein. Specifically, WIFE shall retain her Thrift Savings Plan Account (estimated value
$71,252.85) and her FERS pension. HUSBAND sha1I receive his Compensation Program
($4,848.60).
9. BANK ACCOUNTS AND INVESTMENTS
Each party shall have sole possession of the bank: accounts in their own names.
10. INSURANCE
Each party shall retain ownership of any life insurance policy in his or her name.

Commonwealth of Pennsylvania.

. 8. Member's retirement benefit is defined as all monies paid to or on behalf
of Member of SEAS, including any lump sum withdrawals or scheduled or ad hoc
increases, but excluding the disability portion of any disability annuities paid to
Member by SERS or any deferred compensation benefits paid to Member by SERS.
Equitable distribution of the marital property component of Member's retirement
benefit, as set forth in Paragraph Seven (7) shall commence as soon as admiftistratively
feasible after Member actually enters pay status and the entry of this Stipulation and
Agreement as a Domestic Relations Order acceptable to SERS, whichever is later.
9. Member hereby nO,minatesAltemate Payee as an irrevocable beneficiary
to the extent of the Aftemate Payee's equitable distribution portion of the Member's
retirement benefit for any death benefits payable by SERS. This nomination shall
become effective upon approval by the Secretary of the Retirement Board, or his
authorized representative of any Domestic Relations Order incorporating this
Stioulation and Agreement. The balance of any death benefIt remaining after the
allocation of t'1e Alternate Payee's equitable distribution portion ("Balance") shall be
paid to the beneficiaries named by the Member on the last Nomination of Beneficiaries
Fonn filed with the Retirement Board prior to Member's death. .
(a.) If the last Nomination of Beneficiaries Form filed by the Member prior
to Member's death (a) predates any approved Domestic Relations Order incorporating
this Stipulation and Agreement, and (b) names Altemate Payee as a beneficiary, then
(1) the terms of the Domestic Relations Order shall alone govern Alternate Payee's
share of any death benefit, and (2) for purposes of paying the Balance via the last
Nomination of Beneficiaries Form filed with the Retirement Board prior to Member's
death, Alternate Payee shall)be treated as if the Alternate Payee predeceased
Member. No portion of the Balance shall be payable to the Alternate Payee's estate.
(b.) In addition, Member shall execute and deriver to the Altemate Payee
an authorization, in a fonn acceptable to SERS, which wil/authorize SERS to release
to the Alternate Payee all relevant information concerning Member's retirement
account. Altemate Payee shall deliver the authorization to SERS which will allow the
Altemate Payee to check that she has been and continues to be properly nominated under
this paragraph. .
10. The terms and amount of the Member's retirement benefits payable to the
Alternate Payee after SERS approves a Domestic Relations Order incorporating this
Stipulation and Agreement is dependent upon which option(s) is (are) selected by
Member upon retirement.. The Member and Altemate Payee expressly agree that
Member shall select Special Option 4, which is a joint and equitable distribution percent (as
defined in Section 7) annuity payable during the lifetime of the Member with an equitable
distribution percent (as defined in Section 7) of such annuity payable thereafter to his
survivor annuitant, if living at his death, as set forth in 71 Pa. C.S. Section 5705(a)(4), or any
succeeding statute.
;- The Member shall designate the Altemate Payee as his irrevocable survivor
annuitant. The intent of this Special Option 4 selection is to maintain levelized payments to
the Alternate Payee for her life in the event of the Member's death after retirement. The
Altemate Payee shall recejve her equitable distribution percentage of the annuity which is
payable to the Member during his lifetime, so that she shall receive a percentage of the
Member's check during his lifetime and the same amount, all other things being equal, if he
predeceases her after retirement.

The Member and the Alternate Payee acknowledge that if the Alternate
Payee predeceases the Member prior to receipt of all of her payments payable from
SERS under this Order, including any death benefit, retirement benefit or lump sum benefit
the following will occur under this Special Option 4 selection: (1) the same monthly beneffl
which had been paid or would have been paid to the Alternate Payee during the Alternate
Payee's lifetime will be paid to the Altemate Payee's estate for the duration of the life of the
Member, and (2) any lump sum distributions, whether death benefits or l!Jmp sum
retirement benefits shall be paid directly to the Altemate Payee's estate.
The Member and the Alternate Payee agree that the Member shall be
permitted, at his sole option, to select an Option 4 lump sum payment of all or part of his
accumulated deductions at the time he retires. The Altemate Payee shall be entitled to her
equitable distnbution portion of said lump sum distribution, calculated pursuant to Paragraph
7 of this Stipulation. The Alternate Payee's share of the lump sum shall be deducted from
the Member's withdrawal and paid to the Alternate Payee.
11. Alternate Payee may not exercise any right, privilege ot option offered by
SERS. SERS shall issue individual tax forms to Member and Alternate Payee for
amounts paid to each.
12. In no event shall Alternate Payee have greater benefits or rights otherthan
those which are available to Member. Altemate Payee is not entitled to any benefit not
otherwise provided by SERS. The Altemate Payee is only entitled to the specific benefits
offered by SERS as provided in this Stipulation and Agreement. All other rights,
privileges and options offered by SERS not granted to Altemate Payee are preserved for
Member.
13. It is specifically intended and agreed by the parties hereto that this Stipulation
and Agreement:

Does not require SERS to provide any type or form of benefit, or
any option not otherwise provided under the Retirement Code;
Does not require SERS to provide increaseCl benefits (determined
on the basis of actuarial value) unless increased benefits are paid
to Member based upon cost of living or increases based on other
than actuarial values. .

14. TJ-,e parties intend and agree that the terms of this Stipulation and Agreement
shall be approved, adopted and entered as a Domestic Relations Order.
15. The Court of Common Pleas of Cumberland County, Pennsylvania, shall
retain jurisdiction to amend any Domestic Relations Order based on this Stipulation and
Agreement, but only for the purpose of establishing it or maintaining it as a Domestic
Relations Order; provided, however, that no such amendment shall require SERS to
provide any type or form of benefit, or any option not otherwise provided by SERS, and
