PETITION OF DEFENDANTS DONALD E. SLlKE AND ROSE MARIE SLlKE
FOR ENTRY OF JUDGMENT OF NON PROS
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, come Defendants Donald E. Slike and Rose Marie Slike by their Attorney,
Robert P. Reed, Esquire, and petition Your Honorable Court for the entry of a judgment
of non pros against the Plaintiffs, Joseph O'Donnell and Connie O'Donnell, his wife, and
in support thereof set forth the following:
I. The present action arises out of an alleged slip and fall occurring on premises owned
by the Defendants, Donald E. Slike and Rose Marie Slike.
2. According the Plaintiffs' Complaint, Count I, paragraph nine, the above incident
occurred on March 2, 1997 in front of the White Mountain Creamery on Simpson
Ferry Road, Mechanicsburg.
3. Plaintiffs delayed the filing of their action until the issuance of a writ of summons on
March 2, 1999.
4. Plaintiffs did not file their Complaint until November 5,2001.
5. A reinstated Complaint was filed on May 28,2002, and on June 26, 2002 Peggy A.
Laman, lessee of the White Mountain Creamery, was joined as an additional
defendant.
6. Defendants were informed for the first time, through Count I, paragraph nine of the
Plaintiffs' Complaint, that Plaintiff Joseph O'Donnell fell on the ramp area of the
subject premises.
7. Subsequent to the incident of March 2,1997, but prior to the filing of the Plaintiffs'
Complaint, said ramp was removed and a macadam ramp substituted therefore.
8. Additional Defendant, Peggy A. Laman, has identified an employee who was
working for her on the date of the Plaintiffs fall as one, David Null, of Marys vi lie.
MI. Null has informed counsel for the defendants that at this point he has only a
"vague recollection" of the events of that day.
9. Additional Defendant Peggy A. Laman's lease of the aforesaid White Mountain
Creamery terminated on February 18,1998, and at some indeterminate time
thereafter, but before her knowledge of the present action, Ms. Laman destroyed her
business records for the enterprise at the White Mountain Creamery.
10. On June 27,2002, counsel for the Defendants served on then-counsel for the
Plaintiffs interrogatories and requests for production concerning the liability and
damage issues raised by the Plaintiffs' Complaint. Plaintiffs did not respond to said
discovery until January 23,2003.
I I. By letter dated March 14,2003, counsel for the Defendants informed then-counsel for
the Plaintiffs of deficiencies in the Plaintiffs' responses to the Defendants' discovery
requests, and received repeated assurances that supplementation responsive to those
deficiencies would be supplied. A copy of the correspondence documenting the
demand for supplementation and assurances of the same are attached hereto
collectively as Exhibit A.
12. To date counsel for the Defendants has never received any supplementation to
interrogatories numbers twenty, twenty-one and twenty-two, as demanded in Exhibit
A.
13. On or about September I, 2004, Plaintiffs then-counsel, Edward J. Zanine, Esquire,
filed a Petition for Leave to Withdraw as counsel for the Plaintiffs alleging therein:
a. That he had attempted on numerous occasions from March, 2003 to July, 2004 to
communicate with his clients;
b. That the attempts included phone calls, letters, and certified letters;
c. That he had filed requests for information under the Freedom of Information Act
with the postmaster to confirnl that he was using the correct address for the
Plaintiffs; and
d. Despite the aforesaid Plaintiffs did not respond to their attorney's efforts to
communicate with them.
14. On September 28,2004, the Honorable Kevin A. Hess entercd a rule upon the
PlaintitTs to show cause why the petition of their attorney for leave to withdraw
should not be granted. A copy of said Rule, which was served on October I, 2004, is
attached hereto as Exhibit B.
15. Plaintiffs failed to respond to the Rule entered by Your Honorable Court (Exhibit B)
and on November 19, 2004, an Order was duly issued by the Honorable Kevin A.
Hess granting leave to Edward J. Zanine, Esquire, to withdraw as counsel for the
Plaintiffs. A copy of said Order dated November 19, 2004 is attached hereto as
Exhibit C.
16. To date no new counsel has entered an appearance on behalfofthe Plaintiffs and they
are currently unrepresented.
17. Defendants believe, and therefore aver, that the Plaintiffs' conduct as set forth above
demonstrates extreme delay and lack of diligcncc in pursuing their claim, which delay
has resulted in loss of evidence with attendant prejudice to Defendants as follows:
a. The alteration of the premises where Plaintiffs claim the husband-plaintiff fell;
b. The loss of business records destroyed through the natural winding up of an
enterprise;
c. The fading of witnesses' memories;
d. Undue and unnecessary delay of the Plaintiffs in responding to discovery and
their failure, despite repeated assurances of their counsel, to supplement their
responses to the same; and
e. Failure to cooperate with or respond to their counsel which conduct ultimately
resulted in counsel's withdrawal from this matter.
18. Defendants believe and therefore aver that Plaintiffs' conduct as aforesaid manifests
an attitude or intention not to pursue the present matter with diligence entitling the
Defendants to the entry of a judgment of non pros.
19. Plaintiffs were infom1ed, at least seven days prior to the presentation ofthis Petition,
of its contents and the Defendants' intention to file the samc.
20. Defendants have sought concurrence in the present petition from Steven Moore,
Esquire, counsel for Additional Defendant, Peggy A. Laman. Mr. Moore indicates
that he concurs in the present petition and joins therein.
WHEREFORE, Defendants pray Your Honorable Court for the issuance of a Rule to be
served upon the Plaintiffs to show cause, if any they have, why the prayer of this petition
should not be granted and a judgment of non pros entered against them.

Dear Ed:
Thank you for the interrogatories and requests for production. I note that the identical set
of interrogatories and requests were made out to each of three defendants, White
Mountain Creamery, Donald Slike, and Rose Slike. I suppose I will have to answer all
three since they did not share identical knowledge of this matter.
I was infonned shortly after this matter was assigned to me that Mr. O'Donnell had called
in to Mr. Slike's office just following the accident and left a voicemail message. I was
not aware until just recently that the tape of that message still exists and I now have that
tape in my possession. I am attaching to you a transcript of that message.
This transcript will, of course, be included in my responses to your discovery.
However, I was unaware of the text ofthis message at the time I crafted my own
discovery to you. Otherwise I would have included a request for additional items among
the documents to be produced. In my interrogatories numbers twenty, twenty-one and
twenty-two, I asked, among other things, for detailed infonnation as to where Mr.
O'Donnell fell, the nature of the defects complained of, and information regarding his
prior knowledge of the conditions. Your responses simply referred me to the complaint.
That complaint states (in paragraph nine) that the incident took place on the ramp, but
does not tell me where on that ramp. Also, nowhere in the complaint is it clearly stated
whether Mr. O'Donnell slipped, tripped, skidded, etc. The complaint also says nothing
about.prior knowledge although the attached statement indicates that Mr. O'Donnell was
aware of conditions there and had even written letters regarding those conditions.
I would ask that you please supplement your answers to interrogatories to supply the
information requested by interrogatories twenty through twenty-two. Additionally, I
grant you that my requests for production do not specifically request copies of the letters
written by Mr. O'Donnell prior to the date of this incident. Would your client supply
copies of those letters in lieu of a formal second request for production?

MOTION FOR ENTRY OF JUDGMENT OF NON PROS
TO THE HONORABLE, THE JUDGES OF SAID COURT:
And now, come Defendants Donald E. Slike and Rose Marie Slike, and move Your
Honorable Court as follows:
1. On January 21, 2005, a petition was presented on behalf of Defendants Donald E.
Slike and Rose Marie Slike requesting the entry of a judgment of non pros for the
reasons stated therein.
2. On January 26,2005, an Order was entered by the Honorable Kevin A. Hess directing
the Plaintiffs to file an answer to the petition within twenty days. A copy of said
Order is attached hereto as Exhibit A.
3. As directed by the foregoing Order, the undersigned served a copy of said Order on
all of the parties to the present action. A copy of said Order with the certificate of
service dated January 28,2005, is attached hereto as Exhibit B.
4. Subsequently the undersigned received a telephone call from Plaintiff Connie
O'Donnell informing that her husband, Plaintiff Joseph O'Donnell, did not reside at
4193 Nantucket Drive, Mechanicsburg, P A 17055, but that he had an address on
Timber Chase Drive, Mechanicsburg.
5. Following the conversation as aforesaid, and realizing that Plaintiff Joseph O'Donnell
may not have actual notice of the filing of the petition and the entry of the Order of
Your Honorable Court, the undersigned mailed a copy of the petition for entry of
judgment of non pros together with a copy of the Court's Order of January 26, 2005,
to Plaintiff Joseph O'Donnell as his new address of 1402 Timber Chase Drive,
Mechanicsburg, P A 17050. A copy of the certificate evidencing said service is
attached hereto as Exhibit C.
6. Since the service of the Court's Order of January 26, 2005 on all parties, a period in
excess of twenty days has passed and as of the presentation of this motion no answer
has been filed by any party or any protest raised to the dismissal of this action.
7. Defendants Donald E. Slike and Rose Marie Slike believe and aver that they have
expressed a meritorious basis for the dismissal of the present matter for Plaintiffs'
failure to prosecute the same in a diligent manner, with resultant prejudice to the
Defendants as set forth in the Petition filed on January 21,2005.
WHEREFORE, Defendants Donald E. Slike and Rose Marie Slike pray Your Honorable
Court to enter a judgment of non pros.
