AND NOW, this I(,~ day of December, 2004, upon consideration of the attached
Custody Conciliation report, it is ordered and directed as follows:
1. A hearing is scheduled in Court Room No.4 of the Cumberland County Court House on
the ~ il ~ day of ~, 2OOb, at 9 ;/Jd ~m. At this hearing, the mother shall be the
moving party and shall p~oceed initially with testimony. Counsel for the parties, or the
parties themselves if they choose to proceed in this case without counsel, shall tile with
the court and the opposing side a memorandum setting forth the history of custody in
this case, the issues currently before the court, a list of witnesses who will be called to
testify on behalf of each party and a SllmmSlry of the anticipated testimony of ,~ch
witness. This memorandum shall be fIled at least five days prior to the mentioned
hearing date.
2. Pending further of this Court, the following temporary custody order is entered:
a. The prior custody orders are modified such that the mother, Natasha J. Swartz, shall
have primary physical custody of Amber R. Metzger, born September 20, 1989.
Father shall continue to enjoy periods of temporary custody of the minor child on
alternating weekends and at such other times as agreed.
The existing order relative to father retaining primary custody of Jalt'ed shall remain
place pending the hearing.

c. The prior order of August 30, 2000 shall also remain in place relative to custody on
holidays and other matters pending a Cmal order of tbis Court.

CONCILIATION CONFERENCE S~[ARY REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF
PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following
report:
1. The pertinent information pertaining to the child who is the subject of this litigation
is as follows:
Jerad A. Metzger, born September 30, 1991 and Amber R. Metzger, born
September 20, 1989.
2. A Conciliation Conference was held on December 9, 2004, with the following
individuals in attendance:
The mother, Natasha J. Swartz, with her counsel, Karl E. Rominger, Esquire, and
the father, Scott A. Metzger, who appeared without counsel.
3. This is the second Conciliation Conference held by tbte Conciliator within the past two
months. Also, the parties have been before the Conciliator at least four times over the
past two years. The prior Order suggests that the father has primary custody of both
minor children. The father is now in agreement for Amber to be in the primary
custody of mother. Mother suggest that Jared wlmts to also be in her primary
custody, but father is not willing to agree to that clumge at this point. Accordingly, a
hearing is required on that issue.
4. Consistent with the agreement of the parties and the requirement of a hearing, the
Conciliator recommends an Order in the form as attached.
