SUMMARY OF ARGUMENT
Based upon the pleadings and an Affidavit in Support of the
Motion for Summilry Judgment, there are no genuine issues oC
material [d~t. Thus, Plaintiff is entitled to summary judgment as
a matter of law.
ARGUMENT
In Pennsylvania, it is well established that a court may grant
summary judgment if the pleadings, depositions, answers to
interrogatories and admissions on file show that there are no
genuine issues of material fact and that the moving party is
entitled to judgment as a matter of law. Hower v. Whitmak
Associates, 538 A.2d 524, 371 Pa. Super. 443 (1988); In re_Estate
oL,Reinart, 532 A.2d 832, 367 Pa. Super. 147 (1987). While the
court must accept as true all well pleaded facts in the non-moving
party's pleadings, the court must ignore controverted facts in the
pleadings and only consider uncontroverted facts contained in the
pleadings. Hower, 538 A.2d at 525; Phaff._v.._Gerner, 303 A.2d 826,
451 Pa. 146 (1973). If the non-moving party fails to file
appropriate affidavits, unless the moving party's evidence in
itself creates a factual question, the court must grant summary
judgment in favor of the moving party. Curry_.v_.___Estate_of
Thompson, 481 A.2d 658, 332 Pa. Super. 364 (1984). Plaintiff
respectfully submits that the facts set forth in Defendants' Answer
do not establish a valid defense to Plaintiff's mortgage
Intention to Foreclone Mortgage in compliance with
Act 6 of 1974; and
g) Plaintiff mailed to Defendants a Notice of
Homeowners' Emergency MOl'tgage Assistance Act of
1983, in compliance with the Homeownero' Emergency
Mortgdge Allsiatance Act, Act 91 of 1983.
In 1987, the Pennoylvania Superior Court held that summary
jUdgment is properly granted in a mortgage foreclosure action where
the mortgagors admitted that they were in default under the terms
of the note and mortgage. New York Guardian Mortgage v. Dietzel,
524 A.2d 951, 362 Pa. Super. 426 (1987). In Dietzel, the mortgagee
filed a Complaint in Mortgage Foreclosure and the mortgagors
answered admitting that they were behind in their mortgage payments
and claimed that they were without knowledge sufficient to form a
belief as to the accuracy of the mortgagee's averments as to the
outstanding balance.
The Court of Common Pleas of Philadelphia
County granted the Motion for Summary Judgment and the defendants
appealed.
In the instant case, Plaintiff has filed a sworn Affidavit
certifying that the Defendants are in default under the terms of
the Note and Mortgage. The testimony is based on the Loan History
Report which is a business record of Plaintiff maintained in the
regular course of business. Additionally, the Affidavit contains
documentation showing precisely how and when all charges were
computed. The Defendants have admitted that they are in default
but deny that Plaintiff is entitled to a judgment in mortgage
foreclosure. They state that Defendants' personal obligation to
repay the Note was discharged under Chapter 7 of the Bankruptcy
Code. While this may be true, this is not a defense to a mortgage
foreclosure action, which action does not seek to obtain a personal
obligation. Rather, an action in mortgage foreclosure is an action
to obtain jUdgment on the property. Where a debtor has been
discharged from in personam liability on mortgage debts under
Chapter 7, the mortgagee no longer holds claim against the debtor,
but only a lien against the debtor's property. Bankruptcy Code 11
U.S.C.A. ll!l101 (4), 102 (2), 701 et seg, , 1301 etseg. A mortgage
foreclosure action is strictly in rem and is not an in personam
claim to enforce personal liability. Pa. R.C.P. 1141-1150,
1141 (a), 42 Pa. C.S.A. and see Newton mVillage,_partnership._v.
Kimmel, 424 Pa. Super. 53, 621 A.2d 1036 (1993) and First_Wisconsin
TrustCo.v. Strausser, 439 Pa. Super. 192, 653 A.2d 688 (1995).
A Motion for Summary Judgment may only be granted if the
pleadings, depositions, answers to interrogatories and admissions
on file, together with the affidavits, if any, show that there is
no genuine issue as to any material fact and that the moving party
is entitled to judgment as a matter of law. Hower, 538 A.2d at
524. In the instant case, Defendants admit that they are in
default but claim they are not liable to Plaintiff due to a Chapter
7 discharge releasing them from personal liability, However, where
a default has occurred, the mortgagee is not prevented from
pursuing an in rem action in mortgage foreclosure to obtain
judgment on the property. The purpose of the action is to obtain
title to the subject premises, not to obtain a monetary judgment,

To support the avermentR in the
Complaint as to the existence of a default, Plaintiff has filed an
Affidavit in Support of its Motion for Summary Judgment. The
Affidavit is based on relevant business records which indicate the
Defendants' Mortgage is substantially in default. The Defendants
have failed to come forth with a defense to Plaintiff's Complaint
in Mortgage Foreclosure and have failed to establish the existence
of any genuine issues of material fact.
For these reasons,
Plaintiff is entitled to judgment as a matter of law.
CONCLUSION
The Defendants have failed to come forth with a valid defense
to the instant in rem proceeding.
Thus, there are no genuine
issues of material fact in support of Defendants I Answer and
Plaintiff is entitled to judgment as a matter of law.
