Cox'; nerelnafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in South Middleton Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhlbit "A" '"hich is attached herAto ..no ,"ade 'l part hereof and known as Lot 47 Derbyshire Drive, Carlisle, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurt.enant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of l~en, shall bp. an independent ~ov~nar.t. FRED' TID~Y BUILDER>, INC. -.- ;:-- SIGNED, SEALED AND DELIVERED IN THE PRESENCE OF C_"-~l5h~~h (lei? / / By: Tiday, President Exhibit "A" ALL THAT CERTAIN lot or parcel of land, situate in South Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at an iron pin on the easterly right of way line of Derbyshire Drive, a 50 foot wide right of way, which said point is more particularly located at the intersection of the easterly right of way line of Derbyshire Drive and the dividing line between Lots Nos. 46 and 47 on the Plan of Lots known as "Final Plan for Mayapple Village, Derbyshire Lots 40-73", thence from said point of beginning along the dividing line between Lots Nos. 46 and 47, North 72 degrees 03 minutes 42 seconds East, a distance of 141.66 feet to an iron pin on the westerly property line of other lands of Mayapple Village; thence from said point along the westerly property line of other lands of Mayapple Village, South 15 degrees 17 minutes 59 seconds East, a distance of 72.37 feet to a concrete monument on the dividing line between Lots Nos. 47 and 48 on the aforesaid Plan of Lots; thence from said point along the dividing line between Lots Nos. 47 and 48, South 56 degrees 18 minutes 36 seconds West, a distance of 125.00 feet to an iron pin on the easterly right of way line of Derbyshire Drive; thence from said point along the easterly right of way line of Derbyshire Drive North 33 degrees 41 minutes 24 seconds West, a distance of 28.46 feet to an iron pin; thence from said point continuing along the easterly right of way line of Derbyshire Drive in a northerly direction on a curve to the right having a radius of 275.00 feet, an arc distance of 79.78 feet along a chord bearing of North 25 degrees, 22 minutes, 43 seconds West, a chord length of 79.51 feet to an iron pin, the place of BEGINNING. BEING Lot No. 47 containing 0.2785 acres on the Plan of Lots known as "Final Plan for Mayapple Village, Derbyshire Lots 40-73", prepared by Statler-Brehm, Engineering and Planning Consultants, dated January 26, 1989, and recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Plan Book 58, page 68-B. BEING the same premises which Dennis J. Cox granted and conveyed to Dennis J. Cox and Mary Ann Cox, husband and wife, Borrowers herein.
