99-1354 EQUITY
7) The one hundred and three (103) acre residual
tract contained substantial frontage along Hanna Road,
including a fifty (SO) foot wide parcel which divided Lot No.
2 and Lot No.3.
8) The aforesaid fifty (SO) foot wide parcel is the
subject of this controversy. It is hereinafter referred to
as the "disputed parcel".
9) The Defendant still owns Lot No.2. Her son owns
Lot No.3.
10) In 1991 Defendant and her husband further
subdivided the residual tract into Lots seven (7) eight (8)
and nine (9).
11) The 1991 subdivision plan was prepared by John R.
Kissinger, registered surveyor, and is recorded in Cumberland
County Plan Book 62 Page 84. By its terms, it was prepared
so that lot No. 7 could be conveyed.
12) Lot No.9 contains 35.05 acres and comprises the
entire northern portion of the tract. Lot No. 7 contains
20.1294 acres in the middle of the tract. Lot No.8 contains
48.38 acres and comprises the remainder of the tract to the
south of Lot No.7.
13) The disputed parcel is part of Lot No, 8.

14) The Defendant and her hUBband intended to make the
dioputed parcel part of Lot No. 2 and Lot No. 3 of the
original subdivision.
15) The Defendant and her hUBband discussed this
possibility with Mr. Kissinger. He said that a further
subdivision was necessary and could be accomplished at any
time.
16) Plaintiffs purchased Lot No. seven (7) from
Defendant and her husband in 1992.
17) Shortly thereafter, Defendant's husband took ill
and, eventually, died.
18) No further subdivision plans were ever prepared or
recorded.
19) When Defendant entered into the agreement of sale
with Plaintiffs on January 10, 1998, she did not intend to
convey the disputed parcel.
20) When Plaintiffs entered into the agreement of
January 10, 1998, they fully intended to buy the disputed
parcel which was clearly part of Lot No. 8 appearing on the
subdivisions of record.
21) The Defendant never discussed the disputed parcel
with her attorney who prepared the deed of conveyance.
22) Pursuant to the written agreement of sale, the Deed
of Conveyance should have included the disputed parcel.

2. Plaintiffs have filed their Complaint in Equity contemporaneously with this
Preliminary Injunction.
3. Since the Plaintiffs purchased Lot No.8 In March 1998, Defendant Kelley
has repeatedly tried to block Plaintiffs' use of said Portion A with physical objects to
prevent Plaintiffs' use of said Portion A.
4. The Defendant's actions in blocking the road have prevented Plaintiffs
from utilizing this Portion A to access a portion of their land for farming purposes,
5. Although there is access to Lot No.8 via Lot No.7, due to topography, the
Plaintiffs are unable to use this method of access when the ground is wet.
6. Defendant's actions in blocking the Portion A has prevented or will prevent
the Plaintiffs from using their land in its fullest capacity for farming.
7. If Defendant is prohibited from alienating the Portion A prior to the Court
decision she will not be harmed in any way that damages could not make her whole.
8. Rights of intervening third parties may cause a final determination for
reformation to be inequitable, therefore, if the Defendant Is not prohibited from
alienating the Portion A prior to the Court decision, the Plaintiff will suffer irreparable
harm that damages could not make them whole.
9. The issuance of the Preliminary Injunction preventing Defendant from
blocking this Portion A is reasonably suited to abate the Defendant's continuing
wrongful acts.
10. The issuance of a Preliminary Injunction will not cause undue
inconvenience or loss to the Defendant, but will prevent irreparable injury to the Plaintiff.
11. Plaintiffs have no adequate remedy at law to redress the continuing harm
and injury caused by the Defendant's wrongful and unauthorized interference with their,
property rights.

AND NOW, this 18th day of March, 1999, the
Defendant having requested a continuance in order to obtain
counsel, and having agreed to allow plaintiff access to Portion
A for the limited purpose of ingress and egress to his fields to
plant this spring, said continuance is granted.

of the Defendant's field, and he may move any stakes, tapes, or
other artificial barriers in his way to gain access. He may not
move dirt, rocks, or other natural obstacles.
The Plaintiff shall post $1,000.00 bond with the
Prothonotary pending the next hearing. No money is to be
distributed to any party from the bond without further order of
court.
In the event that the Court eventually determines the
land belongs to the Defendant and that Plaintiff has no claim
thereto, Plaintiff shall be responsible for a rental of $250.00
per month for each month that he accesses through said property.

negotiations Plaintiffs understood that Portion A was to be conveyed with the purchase of

therefore would not need to be subdivided.

21. Denied. It is denied that Plaintiff had repeatedly tried to discuss this matter in
that their only effort was to forward a proposed corrective deed to include Portion A.
22. Denied. It is denied that Defendant has refused or has a duty to cooperate.
23. After reasonable investigation, Defendant is without sufficient knowledge or
information sufficient to form a belief as to the truth of the averment that Plaintiffs
understood that Portion A was a part of Lot #8 and was therefore to be conveyed with
said lot and therefore demand strict proof thereof.
WHEREFORE, Defendant requests this Court to deny Plaintiffs' request for
Specific Performance and all other relief requested by Plaintiffs.
COUNT II-REFORMA nON

25. Denied. It is denied that Defendant misrepresented the boundaries of lot #8
and Portion A as they were readily ascertainable by an examination of the subdivision
plan duly recorded in the Recorder of Dceds Ollice and specifically refcrred to in the
Agrecmcnt lor the Sale of Real Estate entered into by the parties.

that a response is necessary, it is denied that a misrepresentation took place and also
denied that the mistake entitles Plaintiffs to any rclief.

29. On January 10, 1998, the parties entered into an Agreement for the Sale of
Real Estate, a copy of which is allached hereto as Exhibit" A."
30. Paragraph I 5(A) sets forth that Plaintiffs understand that any representations,
claims, advertising, promotional activities, brochures or plans of any kind made by
Defendant, her agents or their employees are not part of the Sales Agreement, unless
expressly incorporated or stated in thc Sales Agreement.
31. The Sales Agreement in paragraph two sets forth the property to be conveyed
as Lot #8, Hanna Road, Newburg and sets forth the size as 48.38 acres. The subdivision
plan referred to paragraph 12 of Plaintiffs' Complaint sets forth Lot #8 as being composed
of 48.38 acres.
32. Said subdivision plan further excludes Portion A from the description
contained therein.

STATEMENT OF FACTS:
In 1997, George and Janet Kreider-Scott (hereinafter referred to as Scotts)
contracted to purchase Lot 8 from Tania Kelley (hereinafter referred to as Kelley). (See
Def. Ex. 1). The settlement on this contract occurred In March 1997. At that time.
Kelley presented a deed from herself to the Scotts. (See PI. Ex. D). Kelley's attomey
was the scrivener of the deed. It was sometime after the purchase of Lot 8, that the
Scotts became aware that the piece of land that has been Identified as "Portion A" was
not included in their legal description of the deed they received from Kelley. There was
a disagreement between the parties as to what encompassed Lot 8. After repeated
attempts by the Scotts' attorney to reach an amicable resolution with Kelley, this suit
was filed.
In 1982, Charles (now deceased) and Tania Kelley were the owners of
approximately 103 acres of agricultural lands located on Hanna Road, Newburg,
Hopewell Township, Cumberland County. The Kelleys became vested in this property
by Deed recorded in the Recorder of Deed Office at Deed Book 26, Volume Y, Page
182. Also in this year, the Kelleys had six small residential lots, each less than one acre
in size, subdivided off of the remainder of their land. These lots were numbered 1-6
with the remaining land unnumbered. This subdivision was recorded in 1982 at Plan
Book 41, Page 137 (hereafter referred to as 1982 Plan). (See PI. Ex. A-1, A-2). The
remainder of the 103 acres was only identified as "land nlf of Charles J. Kelley 26-Y-
182." Between Lots # 2 and # 3, on the 1982 Plan, there is a strip or portion of land
(hereafter referred to as "Portion A") extending from Hanna Road to the remaining 103
acres. This portion was also labeled as "land nlf of Charles J. Kelley 26-Y-182." Portion
A was not subdivided and constituted a part of the remaining 103 acres in this
subdivision plan.
In 1991, the Kelleys further subdivided the remainder of the 103 acres into three
lots. These three lots were identified as Lot # 7, with an excess of 20 acres; Lot # 8,
with an excess of 48 acres; and Lot # 9 with an excess of 35 acres. This subdivision
was recorded at Plan Book 62, Page 84 (hereafter referred to as the 1991 Plan). (See
PI. Ex. C-1, C-2). Again, Portion A was not subdivided as a stand-alone lot.
At the time of both the 1982 and 1991 subdivisions, Hopewell Township did not
have its own Subdivision and Land Development Ordinances. (See PI. Ex. L.)
Therefore the Cumberland County Planning Commission approved all plans.

DISCUSSION:
An Inaccurate description in a deed may be corrected where there is a mutual
mistake, notwithstanding the statute of frauds and the parol evidence rule. The mistake,
however, must be a mutual mistake or a unilateral mistake with knowledge of the other
party. Pillman v. Fritz. 8 Adams L.J. 9 (Pa.Com.PI. 1966). Therefore, where did the
mistake occur? The contract for this parcel of land refers to Lot 8, Neither party
disputes that the contract Is for Lot 8. The dispute is what constitutes Lot 8. Therefore,
Lot 8 must be Identified and described. At first sight, the 1991 Plan appears to be
subdivision and approval of lots 7, 8 and 9. However, on the second page of the 1991
Plan, the following Notes appear:
5. Lot 7 has existing driveway. Lots 8 & 9 have no existing
driveways. This subdivision approval is for Lot 7 only.
6. Lots 1-6 have previous approval and are recorded in P.B.
41, Pg. 137.
Even if it is deemed that the 1991 Plan was only for the approval of Lot 7, due to
the position of Lot 7, Lots 8 & 9 came into being. Lot 7 was placed directiy In the center
of the remaining 103 acres parcel. This created a remaining parcel to the south of Lot 7
which is numbered and identified as Lot 8; and a remaining parcel to the North of Lot 7
which is numbered and identified as Lot 9. According to the Cumberland County
Planning Records, two new lots were created with a total of three lots resulting from this
plan, namely Lots 7, 8, and 9. (See PI. Ex. N). One is then referred to the 1982 Plan
for the previous approval of Lots 1-6.
In the 1991 Plan, as in the 1982, Portion A was not subdivided from the
remaining lands of the Kelleys. Portion A consliluted a part of the remaining lands to
the south of Lot 7, which lands are identified as Lot 8. Had this subdivision plan divided
Portion A, it would have been numbered, perked and probed in accordance with the
Cumberland County Subdivision and Land Development Ordinance just as Lots 8 & 9
were.
By Mrs. Kelley's own admission, she had never gollen around to subdividing
Portion A from Lot 8. Kelley stated she believed she could transfer the remainder of Lot
8 without Portion A. However, from the record, it is clear that Lot 8 encompasses
Portion A. Kelley denies there is any mistake. This denial this does not relieve Kelley
from the terms of the contract to transfer Lot 8 inclusive of Portion A. Where a mutual
mistake in the description in a deed occurs, reformation of the deed in equity will be
directed to conform It to the intention of the parties notwithstanding an express denial by
the defendant that an error was made. Keller v. Kennedy, 4 Cumb.L.J. 115 (Pa.Com.PI.
1955). II was Kelley's attorney that prepared the Deed. A party who knowingly causes
a written Inslrumentto fail to embody the intent of the other party is estopped from
relying on such defect In the instrument; moreover, where the first party knows what the
other party actually intended, the instrument will be reformed to conform to that

In a case seeking to reform a deed on grounds of mutual mistake, In Re: Estate
of Annemarie G. Missonls. f/klal Annemarle G. Schaffer. an Incaoacitated Derson
Pa.Super. (1998) PICS No. 98-2610-23.00, the Court pointed out that If the Guardians
of Ms. Mlssonis had Intended to convey the property according 10 the terms of the deed,
it would have created an illegal subdivision. Subdivisions require approval before
property is divided. The Court further reasoned that the Guardians had not submitted
any plans for subdivision. To Ihe Court this was clearly the case of error on the part of
the scrivener and the mutual mistake of the parties in conveyance of more land than
was intended. Therefore the Court c'dered that the deed be reformed to reflect the
correct boundaries,
In the instant case, it is a matter of too little land conveyed. The deed from
Kelley to Scott only conveyed the large portion of Lot 8 without the inclusion of Portion
A. If the Court does not reform the deed, and only the large part of Lot 8 remains
conveyed without Portion A, then the land referred to as Portion A would be a
substandard 101. Also, since there has not been a subdivision separating Portion A from
Lot 8, the deed, by ils terms, creates an illegal subdivision. There is also a conflict in
the terms of the deed itself. The being clause identifies the property being conveyed as
"BEING Lot No.8..." The legal description fails to encompass Portion A, More
particularly, the seventh call states:
Thence by Lot Nos. 1,2,3,4,5, and 6, and crossing a right-of-way, North 38
degrees 30 minutes 54 seconds East, 800.57 feet to an existing iron pin;
This call is the survey call for the building setback line as identified on the 1991
plan. This Is not the legal lot line. The lot line encompasses Portion A, replacing the
seventh call with the following:
Thence by Lot Nos. 1 and 2 North 38 degrees 30 minutes 54 seconds East, 250
feet to a concrete monument; thence North 61 degrees, 15 minutes, 36 seconds
West, 228.57 feet to an iron pin; thence by Lot No.2 along a curve 80 degrees
13 minutes, 30 seconds a distance 21.06 feet with a chord bearing North 78
degrees 37 minutes, 39 seconds East a chord length 32.21 feet to an iron pin;
thence by Lot No.2 North 51 degrees, 29 minutes 6 seconds West to a rail road
spike at the right of way line for Route 21043; thence along Route 21043 North
38 degrees, 30 minutes 54 seconds East, 101.47 feet to a rail road spike at the
right of way line for Route 21043; thence by Lot No.3, South 51 degrees, 29
minutes, 6 seconds East, 25 feet to an iron pin; thence by Lot No.3 by a curve 99
degrees, 46 minutes, 30 seconds a distance of 29.68 feel with a chord bearing
South 11 degrees, 22 minutes, 21 seconds, East, 38.24 feet to an iron pin;
thence by Lot No.3 South 61 degrees, 15 minutes, 36 degrees East, 219.96 feet

at 1415 Old Wyomlaslng Road, Reading.
Pomsylvanla. Tho Estate also owned an
adjoining property which hed been created
out 01 a portion 01 the premises at 1415
Old Wyomlsslng Road and a portion 01 an
adjacent property. this reapportionment
created a new parcel In between the older
lots. These changes were recorded In a
1990 subdivision plot plan.
Ms. Marsha Golorth was Interested In
bU)ing the property at 1415 Old
Wyomlsslng Road and came to look at It
on two separate occasions. On her first
visit she concentrated on the Interior 01 the
house located on the property. On her
second visit, during en open house, the
agent on duty pointed out the boundary 01
/Iftle property. By his account, the agent told
~s. Golorth that the boundary was
marked by bushes, pipes and a birdbath
that served as boundary markers.
On March 21, 1997, M~. Golorth bought
the property. When the deed lor the
property was prepared and executed, the
drafter Inadvertentiy Included
approximately one-hall 01 the adjoining lot.
The property description In the deed failed
to recognize the 1990 subdivision which
created the new lot. Initially, this mistake
went unnoticed by both Ms. Mlssonls and
Ms. Goforth. In the meantime, Ms.
Mlssonls was still attempting to sell the
adjacent property. At some point after Ms.
Golorth had bought her property, a
prospective buyer lor the adjacent lot
discussed with Ms. Golorth his plans to
build a house on that lot. After hearing
this, Ms. Golorth Inquired about
purchasing the adjoining lot since she did
not like the Idea 01 having another house
built so close to her house. As a result,
Ms. Mlssonls discussed the possibility 01
reversing the 1990 subdivision with her
attorney. Shortiy thereafter, Ms. Goforth
received a copy 01 the recorded deed from
t-er purchase of 1415 Old Wyomlsslng
~oad and discovered that the deed
covered a portion of the adjoining lot. She
was no longer Interested In buying the
adjoining lot and claimed the portion of the
lot conveyed under this deed. Although she
had signed the deed, Ms. Goforth stated
that this was the nrst time she had
recognized the mistake.
The Guardians 01 the Estate then
petitioned the court to relorm Deed or
rescind sale 01 real estate. Citing Wvslnskl
v Manotta. 472 A.2d 6BO (1964), the
court stated, "when language 01 a deed Is
clear and Iree from ambiguity, the Intent 01
the parties must be determined Irom the
language 01 the deed. In cases 01 Iraud,
accident or mistake, however, the nature
and quantity 01 the real estate Interest
conveyed may be shown by parol. To
permit a variation 01 a deed description
which Is complete and unambiguous on its
face, there must be evidence 01 a mutual
mistake which Is clear precise and
convincing." Then, reciting the law as It
pertains to mutual mistake, the court
stated, "a mutual mistake Is a clear
Impression In the minds 01 the parties as
to the existence 01 a material lact
sufnclent In Importance to Innuence and
govern a man of ordinary Intelligence, and
upon which both parties relied and acted,
which fact did not exist." Quoting Owens v.
Townshlo of Ross, 114 P.L.J. 271 (1966).
The Court lurther opined that Courts 01
equity have jurisdiction to reform deeds
when mutual mistakes appear and the
evidence Is clear.
Using this recitalion 01 the law as a
backdrop, the Court found that there was
clear and convincing evidence that a
mistake had been made In the Instant real
estate transaction and, thus, parol
evidence could be used to prove the real
estate actually conveyed. The resulting
deed conveyed more land than either Ms.
Goforth or the Guardians 01 the Estate of
Annemarle G. Mlssonls had Intended. The
Guardians had no Intention of selling any
portion of the adjacent property to Ms.
Goforth. Ukewlse, Ms. Goforth had no
interest In the adjacent lot and only
claimed that portion of the lot contained In
the deed after she realized the drafter's
mistake.
The facts established that each party
Intended that the only property being
conveyed was the property described In
the 1990 subdivision of 1415 Old
Wyomlsslng Road and no portion of the
adjoining lot. The Court found that It would
be unreasonable to conclude that the
Guardians Intended to s&1I half of the
edJolnlng lot to Ms. Goforth thereby
making It Impossible to ..11 tho lot as a
whole espeelelly In light of the loct thot
there were prospect)vo buyers lor thot lot.
Ms. Golorth rolled on Wvslnsklln which
cas. the deed wes not r.formod. However,
til. Court lound that Wvslnokl was .aslly
distinguished. The deed atlssu. In
Wvslnskl had beon derived Irom . survey
done In 1888. The same description was
lound In deed aner deed through the entire
chain 01 litie and, thus, tho court lound
that the deed description was not the
re~ult 01 mistake.
The Court also pointed out that had It
been the Intention 01 the Guardians to
convey the property according to the terms l..-
01 the deed, It would create an Illegal ~
subdivision. Subdivisions require approval
before property Is divided. The Court
reasoned that the Guardians had not
submitted any plans for subdivision nor did
they have any Intention to submit such tJ
plans. To the Court this was clearly the
case of error on the part of Ule scrivener
and the mutual mistake 01 the parties In

AND NOW, comes the Plaintiffs, George and Janet Scott, by and through their
attorney, Lisa M. Greason, Esquire, and represents the following:
1. George W. Scott, Plaintiff, is an adult individual residing at 85 Hanna
Road, Newburg, Hopewell Township, Cumberland County, Pennsylvania.
2. Janet M. Kreider-Scott, Plaintiff, is an adult individual residing at 85 Hanna
Road, Newburg, Hopewell Township, Cumberland County, Pennsylvania.
3. Tania Kelley, Defendant, is an adult individual residing at 9578 Blue
Spring Road, Mercersburg, Franklin County, Pennslyvania.
4. In 1982, Defendant Kelley, along with her husband, now deceased, were
the owners of certain lands located on Hanna Road, Newburg, Hopewell Township,
Cumberland County. Defendant Kelley became vested in this property by Deed
recorded in the Recorder of Deeds office by and for Cumberland County at Deed Book
26, Volume Y, Page 182.
5. Defendant Kelley had six small lots subdivided off the remainder this
certain piece of land. These six lots were less than one acre each and numbered 1-6.
6. This subdivision was recorded in 1982 in the Recorder of Deeds office by
and for Cumberland County at Plan Book 41, Page 137 (hereafter referred to as the
1982 Plan). A copy of said plan is attached and included herein by reference as Exhibit
"A" for sheet 1 of 2, Exhibit B for sheet 2 of 2..
7. On the 1982 Plan, there is a finger of land, (hereinafter referred to as
Portion A) that lies between Lots # 2 and # 3, extending from Hanna Road to the
remainder of lands retained by Defendant. See Exhibit "B".
8. The Portion A on the 1982 Plan Is labeled as "land nlf of Charles J. Kelley
26-Y-182."
9. Defendant Kelley has subsequently sold Lot # 3 and Lot # 4 of these six
small lots.
10. The remainder parcel retained by Defendant Kelley consisted of
approximately 1 03 acres, more or less.
11. In 1991, Defendant Kelley furlher subdivided the 103-acre remaining lot
into three large lots. These three lots were identified as Lot # 8, with an excess of 48
acres; Lot # 7, with an excess of 20 acres; and Lot # 9 with an excess of 35 acres.
12. This subdivision was recorded in the Recorder of Deeds office by and for
Cumberland County at Plan Book 62, Page 84 (hereafter referred to as the 1991 Plan).
A copy of said plan is attached and included herein by reference as Exhibit "Coo.
13. On March 9, 1992, Defendant Kelley deeded Lot # 7 to the Plaintiffs as
shown in the Deed recorded in the Recorder of Deeds office by and for Cumberland
County at Deed Book 35, Volume N, Page 1061.
14. The Plaintiffs use Lot # 7 as their residence as well as for farming.
15. On March 25, 1998, Defendant Kelley deeded Lot # 8 to the Plaintiffs by
deed recorded in the Recorder of Deeds office by and for Cumberland County at Deed
Book 174, Page 678. A copy of said Deed is attached and included herein by reference
as Exhibit "D".
16. During negotiations for the Plaintiffs' purchase of Lot # 8, the Plaintiffs
understood that Portion A was to be conveyed with the remainder of the Lot.
17. In the Deed for Lot # 8, Defendant Kelley failed to transfer the Porlion A.
18. Portion A has never been subdivided from the remainder of Lot # 8.
19. Portion A fails to meet the requirement of Hopewell Township Ordinances
for a stand-alone lot.
20. Paragraphs 1 - 19 above are included herein by reference as If fully set
forth In its entirety.
21. Plaintiffs repeatedly tried to discuss Portion A with Defendant, Defendant's
attorney, and Defendant's real estate agent.
22. Defendant has refused to cooperate.
23. It was Plaintiffs understanding that Portion A was a part of Lot # 8 and was
therefore to be conveyed with Lot # 8.
WHEREFORE, Plaintiffs request this Honorable Court to find in favor of the
Plaintiffs and cause, or have caused, the correction of the Deed for Lot # 8 from the
Defendant to the Plaintiffs to include Portion A and award costs and attorneys fees.
COUNT 11- REFORMATION
24. Paragraphs 1 - 23 above are included herein by reference as if fully set
forth in its entirety.
25. The Defendant misrepresented the boundary of Lot #8 and Portion A to
the Plaintiffs, that misrepresentation induced a mistake of which the defendant was
aware.
26. Such misrepresentation and mistake entitles the Plaintiffs to reformation of
the deed.
27. Or, in the alternative, mistake of the Scrivener in preparing the deed gives
rise to reformation.
28. Defendant's attorney, Richard K. Hoskinson, Esquire prepared the Deed.
