I. Failing to yield the right of way to the Dodge Caravan; and
m. Failing to keep alert and to maintain a proper lookout for vchiclcs lawfully
using the roadway.
11. Defendant Bins is negligent per se because of hcr violation of thc Pennsyl vanin
Motor Vehicle Code.
12. As a direct and proximate result of the aforesaid negligcnce, recklessness and
carelessness of Defendant Bins, Plaintiff CVM sustained damages to the right front fcnder and
nosepiece of the Dodge Caravan.
13. As a direct and proximate result ofthc negligcncc, carclcssness, and rccklessness
of Defendant Bins, Plaintiff was obligated to repair the Dodge Caravan in the amount of one
thousand seven hUlldred thirty-eight dollars and five cents ($1,738,05).

an agent, servant and/or cmployee of Defendant Crete in the course of her employment and as
such, Defendant Crete is also liable for the damages.
WHEREFORE, Plaintiff demands judgment in the amount of 51738.05 against
Defendants either individually and/or jointly and severally for the aforesaid damages. Said
damages are within the limits of compulsory arbitration in Cumberland County, Pennsylvania.

CRETE CARRIER CORPORATION

at length.
17. At the aforesaid time and place, Defendant Crete had entrusted its vehicle to
Defendant Bins when it knew or should have known that Defendant Bins was incompetent to
operate said vehicle and should not operate said vehicle,

Dcfendants either individually or jointly and severally for the aforcsaid damages. Said damages
are within the limits of compulsory arbitration in Cumberland County, Pennsylvania.

such, Defendant Shaffer is also liable for the damages.

8. The said Donna J. Bins was ncgligent in the following:
a. Turning hcr tractor trailer unit without asccrtaining that the movement
could be made with reasonable safety and without giving thc appropriate signal as rcquired by
Scction 3334 of the Vchicle Codc. 75 Pa,C.S,A. ~ 3334;
b. Turning hcr tractor trailcr unit directly into the path of the Dodgc Caravan,
operated by the said Corey J. Whislcr;
c. Failing to yield the right of way to thc Dodge Caravan, operated by
Whisler; and
d. Failing to keep alert and to maintain a propcr lookout for vehicles lawfully
using the roadway.
9. As a direct and proximate result of the negligence, carelessness, and recklessness
of the said Donna J. Bins, the front of the rear tires of the Defendant's trailer struck the right
front fender and nosepiece of the Dodge Caravan.
10. As a direct and proximate result of the negligence. carelessncss, and recklessness
of the said Donna J. Bins, the Dodge Caravan suffered damages, which the Plaintiff was

pass on the left berm and drove into the vehicle being operated by Donna J. Bins,

Donna J. Bins was operating her vehicle properly at alltimcs, The collision was caused by the
negligence of the operator of the Dodge Caravan.

contrary, she was operating the vchicle properly at all times and the collision was caused by the
negligence of the driver of the Dodge Caravan,

5-6, Denied. Aner reasonable investigation, Defendants are without sufficient knowledge
or information to admit or deny said averments. Proofthereof is demanded.
7-8. Admitted that Dcfendant Bins was operating a tractor trailer owned by Defendant
Crete, but denicd that she was in the right-hand, northbound lane of U,S. Route II or that she turned
directly in the path of said Dodge Caravan which was in the len-hand lane. To the contrary,
Defendant Bins was operating her vehicle properly at all times and was in the len-hand lane of the
two-lane highway. The collision was caused by the negligence of the operator of the Dodge
Caravan.

To the contrary, the accidcnt was caused by the negligence of the driver of the Dodge Caravan.

Pennsylvania Motor Vehicle Code. To the contrary, the accident was caused by the negligence of
the driver of the Dodge Caravan.

g. Failing to operate the vchicle in a reasonable and prudcntmanner under
the conditions and circumstances then and there existing;
h. Otherwise failing to cxercise due care undcr the circumstances;
i. Operating her vehicle in violation of the laws of this Commonwealth;
j, Turning her tractor trailcr unit without ascertaining that the movement
could be made with reasonable safety and without giving the appropriate signal as required by
Section 3334 of the Vehicle Code, 75 Pa,C,S.A. ~ 3334;
k. Turning her tractor trailcr unit directly into the path orthe Dodge Caravan;
I. Failing to yield the right of way to the Dodge Caravan; and
m, Failing to keep alert and to maintain a proper lookout for vehicles lawfully
using the roadway.
II. Defendant Bins is negligent per se because of her violation of the Pennsylvania
Motor Vehicle Code,
12, As a direct and proximate rcsult of the aforesaid negligence, recklessness and
carelessness of Defendant Bins, PlaintiffCVM sustained damages to the right front fender and
nosepicce of the Dodge Caravan,
13. As a direct and proximate result of the negligence, carelessness, and recklessness
of Defendant Bins, Plaintiff was obligatcd to repair the Dodge Caravan in the amount of one
thousand seven hundred thirty-eight dollars and five cents ($1,738,05).
