COMPLAINT
AND NOW, comes the Plaintift, by his attorneys, Wix, Wenger
~nd Weidner and sets forth the following:
1. The Plaintiff is an adult individual residing at CME Lot
116, Newville, Pennsylvania 17241.
2. Defendant Shane M. Thumma, is an adult individual
residing at 141 Amy Drive, CarliSle, Pennsylvania 17013.
3. Defendants, Cheryl D. Rhodes and Robert L. Rhodes, are
husband and wife and are adult individuals residing at 48
Mountainview Road, Newville, Pennsylvania 17241.
4. The facts and occurrences hereinafter related took place
on or about September 4, 1998 at approximately 11:53 p.m.
5. At the time and place aforesaid, Plaintiff was the owner
and operator of a 1998 GMC Truck and was then and there proceeding
south on State Route 233.
6. At the time and place aforesaid, Defendant, Shane M.
Thumma was the operator of a 1997 GEO owned by Defendants, Cheryl
and Robert Rhodes, and he was proceeding northbound on state Route
233.
7. At the time and placo aforosaid, Defondant Thumma took
his eyes from the roadway and allowed the vohicle ho was operating
to cross the center lane striking the Plaintitt' s vehicle and
resulting in extensive damages.
8. The aforesaid accident and damages resulting therefrom
were caused by Defendant Thumma in that he:
a) failed to keep a proper lookout for other vehicles;
b) allowed his vehicle to cross the center line of the
roadway and strike the Plaintiff's vehicle;
c) was negligent in failing to keep a proper lookout;
d) operated a vehicle without having liability insurance in
violation of the laws of the Commonwealth of
Pennsylvania.
9. The aforesaid accident and damages resulting therefrom

were caused by the negligence of Defendants Cheryl Rhodes and
Robert Rhodes in that they:
a) allowed their vehicle to be operated by an individual
that they knew, or should have known, was not a competent
driver;
b) negligently entrusted their vehicle to a driver who they
knew or should have known was not capable of safely
operating a motor vehicle;
c) failed to keep their vehicle properly insured as required

by the laws of the Commonwealth of pennsylvania;
d) negligentlY entrusted their vehicle to an operator whom
they knew, or should have known, was not insured at the
time that he was operating tho vehicle, all of which is
in violation of the laws of the Commonwealth of
Pennsylvania.
10. Solely as a result of the negligence of the Defendants,
Plaintiff'S vehicle sustained damages in the amount of Ten
Thousand, Nine Hundred One and 08/100 ($10,901.08) Dollars, to
date, which damages continue to be incurred.
11. As a result of the aforesaid accident and damages
resulting therefrom, plaintiff was forced to incur rental expenses
for a comparable vehicle while his vehicle was being repaired,
which expenses totaled Eight Hundred Five and 20/100 ($805.20)
Dollars.
12. Solely as a result of the negligence of the Defendants,
plaintiff, Gerald E. Walters, suffered a cervical sprain or strain
and a shock to his nerves and nervous system.
13. Solely as a result of the negligence of the Defendants,
plaintiff, Gerald E. Walters, has undergone, and in the future may
undergo, great mental physical pain and suffering, mental anguish
and humiliation, loss of life's pleasures and a severe limitation

Dear Counsel:
We have found It ever more difficult to schedule arbitration hearings by attempting to
telephone the offices of the attorneys and arbitrators to obtain advance clearance of dates. Most
recently, such efforts have been extremely time consuming and gotten to the point of futile.
Accordingly, we have developed a scheduling procedure similar to that followed by the American
Arbitration Association.
I am enclosing for each of you calendars for the months of October and November. Kindly
mark on those calendars with an "X" those mornings or aftemoons when you will be unavailable
to attend the arbitration in the above referenced matter. Then, please retum the marked up
calendars to me via the enclosed preaddressed envelope, so that I have them by August 31,
1999.
In the event that I do not receive your calendar by that date, I will conclusively presume
that any date will be acceptable to you, and schedule the arbitration aCCOrdingly. I will attempt to
schedule the arbitration for the earliest date available to all arbitrators and counsel involved.
I would also appreciate it if counsel for the parties would note on the calendars that they
return to me the approximate amount of time that they believe that their case will take to present,
and the number of witnesses that they Intend to call, in the spaces provided.
