Davis, is an adult individual residing at 1152 Pheasant Drive North, Carlisle, Cumberland County, Pennsylvania 17013. 3. On or about July 10, 1998/ at approximately 11:48 a.m. Plaintiff was proceeding East on the Carlisle Pike in Hampden Township, Cumberland County, Pennsylvania. 4. As Plaintiff proceed East, he was in the left lane or passing lane on the Carlisle Pike. As he proceeded towards the intersection with Gustin Drive, the vehicle operated by Defendant, Craig M. It is believed and therefore averred that Defendant, Craig M. Davis, was attempting to cross the east bound lanes of the Carlisle Pike, and that in so doing he failed to proceed with caution and yield the right-of-way to the Plaintiff. 6. Plaintiff is without any negligence in this matter, as the accident was caused by the failure of the Defendant to properly yield the right-of-way. 7. As a result of the impact, Plaintiff's vehicle, a 1998 Chevrolet Tracker, sustained damage of $15,000. Additionally, Plaintiff has lost the use of said automobile, due to the fact that he has been unable to operate said vehicle since the date of accident, becasue of the extensive damage caused by the impact, which left it inoperable.
