4. This petition is brought in Cumberland County and the accident also occurred in
Cumberland County, Pennsylvania.
S. The accident occurred when the vehicle driven by Defendant Ann Barnhart backed
into the front end of the vehicle in which Meriua Shipp and Justin Shipp, minors, were the rear
passengers.
6. As a result of the aforesaid incident, Mcrissa Shipp suffered a contusion to her
abdomen.
7. As a rcsutt of the aforesaid incident, Justin Shipp suffered a contusion to the right
side of his forehead.
8. Merissa Shipp and Justin Shipp were treated by the Carlisle Hospital and released
with inSlnlctions to follow up with their family doctor, if necessary.
9. Merissa Shipp and Justin Shipp sought no further care after being released from the
hospital.
10. The following expenses have been incurred for treatment of Merissa Shipp, all of
which have been paid in full by Plaintiff's insurance carrier.

which have been paid in full by Plaintiff's insurance carrier.

12. Counsel wu retained upon a 35% contingent fee buia by Pctitioner and on behalf

13. Counsel was retained upon a 35% contingent fee basis by Petitioner and on behalf
of Justin Shipp. However, counsel has agreed to a 30% fee basis, and has incurred the following

14. Petitioner and counsel recommend approval of the lump sum amount of One
Thousand dollars ($1,000) for each of Merissa Shipp and Justin Shipp with defendant's insurance
company because they believe that it adequately represents a full and complete settlement oflhe
instant claim against this defendant and is equal to or greater than that which may be obtained
should the matter be litigated. See attached Exhibit "B".
15. Petitioner approves the proposed settlement because she considers it faiT and
reasonable and that it adequately compensates the minor children for the injuries they sustained,
and expenses incurred, and she further approves of the proposed distribution set forth in the
Order attached hereto.
