AND NOW, comes Petitioner, Robert P. Miller, by end through his attomeys, Mancke,
Wagner, Hershey & Tully, and makes the fOllOWing averments In support of this License Recall:
1, Petitioner, Robert P. Miller, Is an adult individual and a PennsylvanIa licensed driver
with a residence address of 1306 King Arthur Drive, Mechanlcsburg, Cumberland
County, Pennsylvania 17055.
2. Respondent, Pennsylvania Department of Transportation, Bureau of Driver
Licensing, has a mailing address at Riverfront Office Center, Third Floor, 1101
South Front Street, Harrisburg, Dauphin County, Pennsylvania 17104-2516,
3, Petitioner received a notice of license suspension by way of letter dated February
25, 1999 ftom the Department of Transportation indiceling that his Pennsylvania
driving privileges are to be recalled on April 1, 1999, See Exhibit "A" attached
hereto and incorporated herein by reference,
4, The specific issue complained of by the Department of Transportation was that
Petitioner had cerebral vascular disease that could affect his ability to drive. See
Exhibit "B" attached hereto and Incorporated herein by reference.
5. The Department's notice of January 11, 1999 at '113 indicates that the exam he was
required to take includes vision screening, knowledge of rules of the road, and on
road driving,
6, Petitioner passed the vision screening test and on road driving test.
7, Petitioner did not pass the verbal test pertaining to knowledge of tne rules of the
road due to a medical condition known as expressive aphasia that affects his
speech but is unrelated to his knowledge of rules of the road or his ability to safely
operate a motor vehicle.
8, The Department's exam format pertaining to rules of the road does not
accommodate individuals with expressive aphasia,
9, Willow Lakes Health Center, an occupational therapy provider, evaluated Petitioner
for a behind the wheel assessment December 14, 1998 and determined that
Petitioner satisfactorily performed all primary driving skills and maneuvers without
deficiencies in visual scanning decision making or reaction time and that no moving
violations were observed,
10, Petitioner's primary care physician, Ann Bogdan, M.D" had recommended only that
Petitioner take a driving exam with the spinner knob,
11, The Department's records reflect that a spinner knob was installed on Petitioner's
vehicle and he successfully passed the road portion of the exam,
12, The Department, upon receiving notification that Petitioner did not pass the oral
portion of the exam involving the knowledge of rules of the road, sent him a notice
of license recall with a mail date of February 25, 1999.

Information submi[ted to the Department indicales that you may have a Cerebral Vascular
Disease condition thaI could affecr/limit your abilily to drive. In order 10 determine if you meel
Ihe Department's medical standards for driving, it is necessary that you take a driving
examination. This examination mUSI be conducted by a Driver Licen~e Examiner at any Driver
License Cemer. You may obtain a copy of the Pennsylvania Drive~'s Manual at any Driver
License Cemer. Please be aware of the following:
I. You must schedule an appointment to take the test. If you want to lake the test at any of the
Driver License Centers located in the greater Philadelphia area, you should call 1.800.932-4600.
If you want to take it at any other center, you should contact that center for an appointment.
Check the blue pages of your telephone directory under Transportation for the telephone number.
2. When you lake the test, please bring this notice and a valid insurance card and registration
card for the car you will be using for the test.
3. Your exam will include a vision screening, a test of your knowledge ofmles of the road, and
on-road driving.
4. This letter will allow you three opportunities to take the test. If you take the test and fail, you
will not be retested on the same day,
5, If your driving privilege is suspended, recalled, or expired, this le[ter authorizes you to drive
only during the course of the test. When reporting for the exam, you must be accompanied by a
licensed driver.
