Pursant to the May 1 1, 1999 Order of Court paragraph #8, Plaintiff/Respondent did provide written notification of her intention to move to Lancaster County to Defendant/Petitioner. Said notification provided that Plaintiff/Respondent would be moving the week of July 15, 2000. Plaintiff/Respondent's desire to move to Lancaster County is by no means an attempt to remove herself and the child from the jurisdiction of the Cumberland County Court of Common Pleas. 6. Denied. Plaintiff/Respondent believes and therefore avers that her proposed move will sgnificantly improve her daughter's life and therefore, is in the best interest of the child. 7. Denied. Plaintiff/Respondent's proposed residence in Lancaster County is approximately forty (40) miles from Defendant/Petitioner's current residence with a travel time of approximately forty-five (45) minutes. Under the current Order of Court, Defendant/Petitioner's periods of partial physical custody are every other weekend from Friday after work until Sunday at 6:OOp.m, a midweek Wednesday evening visit following Defendant/Petitoner's weekends, Wednesdays after work until Thursday morning following Plaintiff/Respondent's weekends and additional holiday and vacation time. Plaintiff/Respondent's proposed move would not interfere with Defendant/Petitioner's ability to exercise his current periods of partial physical custody. Thus, Defendant/Petitioner's periods of custody would not be impacted in any negative material way. DefendantlPlaintiff could still exercise all his periods of partial physical custody and continue to play an active role in his child's life. Furthermore, Plaintiff/Respondenthelieves and therefore avers that Defendant/Respondent often travels to Lancaster County with his current employment. 8. Denied. Plowman v. Plowman, 490 Pa.Super. 143, 597 A.2d 701 (1991) directs the Court to hold an evidentiary hearing before the child is moved from the jurisdiction or within a reasonable time thereafter and to examine the factors set forth in Gruber v. Gruber, 400 Pa.Super. 174, 583 A.2d 434 (1990). However, in Beers v. Beers, 710 A.2d 1206 (Pa.Super. 1998), the Court directs that the Gruber analysis is only applicable to intrastate relocation cases where the geographical distance of the proposed move is significant enough to alter the parent/child relationship in a negative material way. In the case at bar, Plaintiff/Respondent is planning a change of residence of approximately forty (40) miles from Defendant/Petitioner's current residence. In light of said geographical distance, Defendant/Peritioner would still be able to exercise all his periods of partial physical custody pursuant to the terms of the current Order. Additionally, Defendant/Petition could still play an active role in his child's life. Thus, Defendant/Petitioner's relationship with the minor child will not be impacted in a negative material way. 9. Denied. Each party shall be entitled to have custody of the Child during the summer vacation each year for two periods of 5 consecutive days which can be tacked on to that party's regular weekend/Monday holiday period of custody for an uninterrupted 7 or 8 day period. Each party shall provide the other party with sixty days advance notice of his or her scheduled periods of custody under this provision. 6. Unless otherwise agreed by the parties, the party receiving custody of the Child shall be responsible to provide transportation for the exchange of custody. 7. In the event either party intends to go out of town and remove the Child from his or her residence for an overnight period or longer, that party shall provide the other parent with the address and telephone number where the Child can be reached in an emergency. 8. Each party shall provide sixty days advance notice to the other party of any intention to relocate his or her residence. 9. The Father shall ensure that the Child attends her regularly scheduled activities during his periods of custody. 10. The parties agree that the Child will attend church during most weekends with either the Mother or the Father. 11. Both parties shall ensure that no unrelated third parties are present during his or her overnight periods of custody with the Child. 12. The parties shall cooperate in adjusting the custody schedule as necessary to ensure that the Child is available to attend events of major significance such as weddings and funerals. 13. Both parties shall ensure that the Child has no access to inappropriate information and materials on the computer during his or her periods of custody. 14. Each party shall have reasonable telephone access to the Child but shall not contact the Child by telephone later than one hour before the Chiid's bed time. 15. In the event either party requires care for the Child for a three hour period or longer during his or her periods of custody, that parent shall first contact the other parent to offer an opportunity for that parent to provide the care before contacting third party caregivers. 16. This Order is entered pursuant to an agreement of the parties at a Custody Conciliation Conference. The parties may modify the provisions of this Order by mutual consent. Plaintiff/Respondent's desire to move to Lancaster County is by no means an attempt to remove herself and the child from the jurisdiction of the Cumberland County Court of Common Pleas. 6. Denied. Plaintiff/Respondentbelievw and therefore avers that her proposed move will sgnificantly improve her daughter's life and therefore, is in the best interest of the child. 7. Denied. Plaintiff/Respondent's proposed residence in Lancaster County is approximately forty (40) miles from Defendant/Petitioner's current residence with a travel time of approximately forty-five (45) minutes. Under the current Order of Court, Defendant/Petitioner's periods of partial physical custody are every other weekend from Friday after work until Sunday at 6:OOp.m, a midweek Wednesday evening visit following Defendant/Petitoner's weekends, Wednesdays after work until Thursday morning following Plaintiff/Respondent's weekends and additional holiday and vacation time. Plaintiff/Respondent's proposed move would not interfere with Defendant/Petitioner's ability to exercise his current periods of partial physical custody. Thus, Defendant/Petitioner's periods of custody would not be impacted in any negative material way. Defendant/Plaintiff could still exercise all his periods of partial physical custody and continue to play an active role in his child's life. Furthermore, Plaintiff/Respondent believes and therefore avers that Defendant/Respondent often travels to Lancaster County with his current employment. 8. Denied. Plowman v. Plowman, 490 Pa.Super. 143, 597 A.2d 701 (1991) directs the Court to hold an evidentiary hearing before the child is moved from the jurisdiction or within a reasonable time thereafter and to examine the factors set forth in Gruber v. Gruber, 400 Pa.Super. 174, 583 A.2d 434 (1990). However, in Beers v. Beers, 710 A.2d 1206 (Pa.Super. 1998), the Court directs that the Gruber analysis is only applicable to intrastate relocation cases where the geographical distance of the proposed move is significant enough to alter the parent/child relationship in a negative material way. In the case at bar, Plaintiff/Respondent is planning a change of residence of approximately forty (40) miles from Defendant/Petitioner's current residence. In light of said geographical distance, DefendantlPetitioner would still be able to exercise all his periods of partial physical custody pursuant to the terms of the current Order. Additionally, Defendant/Petition could still play an active role in his child's life. Thus, Defendant/Petitioner's relationship with the minor child will not be impacted in a negative material way. 9. Denied. The Mother, Diane V. Cahill, and the Father, Duane B. Cahill, shall have shared legal custody of Alexandra L. Cahill, born March 28, 1989. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the Child's general well-being including, but not limited to, all decisions regarding her health, education and religion. Pursuant to the terms of this paragraph each parent shall be entitled to all records and information pertaining to the Child including, but not limited to, school and medical records and information. To the extent one parent has possession of any such records or information, that parent shall be required to share the same, or copies thereof, with the other parent within such a reasonable time as to make the records and information of reasonable use to the other parent. 2. The Mother shall have primary physical custody of the Child. 3. The Father shall have partial physical custody of the Child on alternating weekends, beginning May 14, 1999, from Friday after work through Sunday at 6:00 p.m. During weeks following the Father's weekends, the Father shall also have custody of the Child on Wednesdays from 5:15 p.m. until 7:30 p.m. (beginning May 5, 1999). During weeks following the Mother's weekends, the Father shall have custody of the Child overnight from Wednesday after work through the following Thursday morning, unless the Mother works on that Thursday evening, in which case, the Father shall have an overnight period of custody with the Child from Thursday through Friday morning instead of Wednesday night. 4. The parties shall share or alternate having custody of the Child over holidays as follows: A. CRI2ISTMAS: The Christmas holiday shall be divided into Segment A, which shall run from the last day of school before 'the holiday through Christmas Day at 1:30 p.m., and Segment B which shall run from Christmas Day at 1:30 p.m. through 6:00 p.m. on the day before school resumes. The Mother shall have ' custody of the Child during Segment A in odd numbered years ~, and during Segment B in even numbered years, and the Father ~ f 1 ~ shall have custody of the Child during Segment A in even numbered years and during Segment B in odd numbered years. B. The Thanksgiving holiday shall run from the last day of .school before the holiday through the following Monday at 6:00 p.m. The Father shall have custody of the Child over the Thanksgiving holiday in odd numbered years and the Mother shall have custody of the Child over the Thanksgiving holiday in even numbered years. C. EASTER/SPRING YACATI~T: The Easter/Spring vacation holiday shall run from the last day of school before the vacation holiday through 6:00 p.m. on the day before school resumes. The Mother shall have custody of the Child during the Easter/Spring vacation holiday in even numbered years and the Father shall have custody of the Child during the Easter/Spring vacation holiday in odd numbered years. D. JULY 4TH: The Father shall have custody of the Child on July 4th from 9:00 a.m. until 11:00 p.m. in even numbered years and the Mother shall have custody of the Child over the July 4th holiday in odcl numbered years. OTf~t MONDAY HOLIDAYS: The Father shall have custody of the Child on the Monday holidays which fall immediately following the Father's weekend periods of custody until 6:00 p.m. The Mother shall have custody of the Child on Monday holidays which fall immediately following the Mother's weekend periods of custody. F. MOTHER'S D~iY/FA7.~II2'S DIY: The Mother shall have custody of the Child every year for the Mother's Day weekend and the Father shall have custody of the Child every year for the Father's Day weekend. 5. Each party shall be entitled to have custody of the Child during the summer vacation each year for two periods of 5 consecutive days which can be tacked on to that party's regular weekend/Monday holiday period of custody for an uninterrupted 7 or 8 day period. Each party shall provide the other party with sixty days advance notice of his or her scheduled periods of custody under this provision. 6. Unless otherwise agreed by the parties, the party receiving custody of the Child shall be responsible to provide transportation for the exchange of custody. 7. In the event either party intends to go out of town and remove the Child from his or her residence for an overnight period or longer, that party shall provide the other parent with the address and telephone number where the Child can be reached in an emergency. 8. Each party shall provide sixty days advance notice to the other party of any intention to relocate his or her residence. ~ - i ~ ' ~ ~ , ~~ 9. The Father shall ensure that the Child attends her regularly scheduled activities during his periods of custody. 10. The parties agree that the Child will attend church during most weekends with either the Mother or the Father. 11. Both parties shall ensure that no unrelated third parties are present during his or her overnight periods of custody with the Child. 12. The parties shall cooperate in adjusting the custody schedule as necessary to ensure that the Child is available to attend events of major significance such as weddings and funerals. 13. Both parties shall ensure that the Child has no access to inappropriate information and materials on the computer during his or her periods of custody. 14. Each party shall have reasonable telephone access to the Child but shall not contact the Child by telephone later than one hour before the Child's bed time. 15. In the event either party requires care for the Child for a three hour period or longer during his or her periods of custody, that parent shall first contact the other parent to offer an opportunity for that parent to provide the care before contacting third party caregivers. 16. This Order is entered pursuant to an agreement of the parties at a Custody Conciliation Conference. The parties may modify the provisions of this Order by mutual consent.
