The person who seeks protection from abuse is Suzanne Rena Souders.
Plaintiff resides at 1389 Grandview Court, Carlisle, Cumberland County, Pennsylvania
Defendant resides at 446 North Pitt Street, Carlisle, Cumberland County, Pennsylvania
Defendant's Social Security Number is 190-54-9150.
Defendant's date of birth is 09/16/74.
Defendant's place of employment is Carlisle Tire and Wheel, Ritner Highway, Carlisle,
Cumberland County, Pennsylvania.
Defend~m is Plaimiffs former boyfriend.
Defendant has been involved in the following criminal court action:
Carlisle Police charged Defendant with simple assault and ~fiminal
mischief, and arrested him. Defendant was arraigned before District 'J'u~ice
Correal, who set his bail at $I0,000, and he was taken to Cumberland County
Prison on March 17, 1999, as a result ofthe incident which occurred on or about
March 16, 1999, involving Plaintiff. Defendant remained in prison until he made
bail on or about March 18, 1999. A preliminary heating in the matter is
scheduled before District Justice Correal on Wednesday, March 24, 1999, at 3: 45
p.m.
Defendant has also been charged criminally as follows: May 23, 1998,
public drunkenness; July 24, 1998, of theft (Cumberland County) and placed on
probation from July 24, 1998 to July 24, 1999; October 26, 1998, furnishing
liquor to minors; December 3, 1998, disorderly conduct; December 10, 1998,
public drunkenness; January 9, 1999, disorderly conduct; and February 25, 1999,
driving without a license.
Defendant is on probation and being supervised through Cumberland
County Adult Probation as a result of his theft conviction in July 1998.
The facts of the most recent incident of abuse are as follows:

On or about March 16, 1999
McDonald's Restaurant on Walnut Bottom Road, and
1389 Grandview Court, Carlisle, Cumberland County,
Pennsylvania, Plaintiff's residence
On or about March 16, 1999, while Plaintiff was in McDonald's
Restaurant with her two minor children, Defendant approached her, displayed a
key, told her that he had taken her house key, and threatened her saying, "Don't
think I won't be over tonight." Defendant yelled at Plaintiff calling her "fat
bitch", grabbed her by the arm, and pulled her out the restaurant door despite her
screaming for him to let her go. Restaurant employees telephoned the police.
Defendant left before the Pennsylvania State Police arrived.
Plaintiffand her children left the restaurant and went home. Fearing that
Defendant would follow through with his threat to come to her home, Plaintiff
pushed furniture against her doors to prevent him from entering. At
approximately 11:00 p.m., Defendant used the key he had taken from Plaintiffto
unlock the door, and pushed the door ag~ainst the fus-sfiixtre with such force that
he was able to move it enough to get inside. Once inside Plaintiff's residence,
Defendant threw a vase of flowers on the floor breaking the vase, grabbed
Plainfiffby the neck, choked her, and jerked the telephone cord out of the wall
jack as she tried to telephone for help. Defendant grabbed Plaintiff by the ann
as she tried to nm out the door, pulled her back into the house, choked her again,
and when she ran upstairs to get away from him, he grabbed her by the neck,
drew his arm back and swung his fist to hit her, but missed, and punched a hole
in the wall next to her head. Defendant ran out of the house and Plaintifflocked
the door. When Defendant tried to open the door and found it locked, he
punched his fist through a window in the living room causing broken glass to
spray into the room, left the premises, and telephoned Plaintiff's residence
approximately 10 times leaving messages on her answering machine. Plaintiff
telephoned 911 for help, and the Carlisle Police responded. On March 17, 1999,
Defendant was charged with simple assault and criminal mischief; arrested,
arraigned before District Justice Correal, and placed in Cumberland County
Prison on $10,000 bail, where he remained until March 18, 1999, when he made
bail and was released.
Plaintiff sought medical attention and was treated for injuries she
sustained as a result of this incident which included, but were not limited to,
lacerations, braising, swelling and soreness about her neck, and difficulty
swallowing.
Defendant has committed the following prior acts of abuse against Plaintiff:
a) On or about January 30,1999, Plaintiff arrived at her residence at
approximately 2:30 a.m. and saw Defendant standing in front of her home in
pouring rain waiting for her. As Plaintiffentered her residence, Defendant forced
his way in, yelled at her, tipped her clothing off, grabbed her by the neck and
choked her, causing her to gasp for breath. Plainfi~ sustained swelling and
soreness about her neck, and had difficulty swallowing as a result of this incident.
b) On or about January 9, 1999, Plaintiff was preparing to leave her
residence to go out with friends, when Defendant arrived unexpectedly, became
angry that he was not invited to join in PlaintiWs plans, grabbed a knife from her
kitchen, threatened to stab her with it, then held the knife against his stomach and
tried to force Plaintiffto push the blade into him saying, 'Tm going to make you
kill me so you can spend your life in jail." In an attempt to calm Defendant,
Plaintiff's girlfriend invited him along for the evening. At the end of the evening,
Defendant became angry when Plaintiff drove him to his residence, and refused
to get out of the car. When Plaintiffwent to the door of Defendant's residence
to ask Defendant's grandmother to help get him out of the car, he raced up the
porch steps, picked Plaintiff up offofthe porch, carded her a short distance in
his arms, and dropped her on the concrete porch steps causing her to fail on her
back. Defendant went back to Plaintiff's car, pulled the fuses out of the
dashboard, and threw them into the yard. Neighbors telephoned the police for
help. Carlisle Police charged Defendant with public drunkenness. Plaintiff
sustained abrasions, bruising and soreness about her back as a result of this
incident.
c) On or about December 13, 1998, Plaintifflet~ a local night club and saw
Defendant hiding at the side of the building. When Plaintiff approached her car
in the parking lot, she saw that both sides of the car were dented in several
places. Plaintiff suspected that Defendant damaged her vehicle while she was
inside the club.
d) On or about December 1, 1998, Defendant grabbed Plaintiffby the wrist,
pulled her about the room, shoved her onto the bed, threw her clothing out the
window into the yard, and hid her car keys to prevent her from leaving. Plaintiff
sustained bruising about her wrist and legs as a result of this incident.
9. The following police departments or law enforcement agencyies in the area in which
Plaintifflives should be provided with a copy of the Protection Order: Carlisle Police Department for
Plaimiff's residence and Pennsylvania State Police for Plaintiff's place of employment.
10. There is an immediate and present danger of further abuse from Defendant.
11. Plaintiff is asking the Court to exclude Defendant fi.om the residence located at 1389
Grandview Court, Carlisle, Cumberland County, Pennsylvania, which is rented by Suz_anne Rena
Souders.
12. Plaintiffhas suffered the following out-of-pocket financial losses as a result of the abuse
described above: see attached Exhibit A, incorporated herein by reference.
WHEREFORE, PLAINTIFF REQUESTS THAT THE COURT ENTER A
TEMPORARY ORDER, AND AFTER HEARING, A FINAL ORDER THAT WOULD DO
~ FOLLOWING:
A. Restrain Defenda_nt fi.om abusing threatening, harassing, or stalking Plaintiff in
any place where Plaintiff may be found.
B. Exclude Defendant from Plaintiffs residence and prohibit Defendant from
attempting to enter any temporary or permanent residence of the Plaintiff.
C. Prohibit Defendant from having any contact with Plaintiff and/or her minor
children, either in person, by telephone, or in writing, personally or through third
persons, including, but not limited to, any contact at Plaintiffs place of employment.
D. Prohibit Defendant from having any contact with Plaintiff's relatives and Plaintiffs
children listed in this Petition.
E. Direct Defendant to pay Plaintiff for the reasonable financial losses suffered as
a result of the abuse, to be determined at the heating.
F. Order Defendant to pay the costs of this action, including filing and service fees.
G. Order Defendant to reimburse Cumberland County, a Legal Services fimding
source, $250.00 for the value of the legal services provided to Plaintiff for the cost of
litigating this case if the case goes to hearing.
H. Order the following additional relief, not listed above:
The Defendant is enjoined from damaging or destroying any property owned by
Plaintiff.

Contempt:
1. A Protection from Abuse Order was issued by the Court. A tree and correct

2. The defendant's violation of this Order is averred in the attached criminal

PROBABLE CAUSE BELIEF IS BASED ON THE FOLLOWING FACTS AND CIRCUMSTANCES:
Your affiant is a Detective with the Cumberland County District Attorney's Office, Criminal Investigation Division and been
so employed for the past 2 years.
In information received from Philip R. Banghman, Probation/Parole Office, Cumberland County Adult Probation/Parole, on
6-3-99, while Officer Banghmen was on routine supervision in the Carlisle Borough, Officer Banghmen encountered the grandmother
of the defendant at the defendant's current residence. When asked if the defendant was at home, Officer Baugbman was directed to
the home of the Plaintiff, Suganne Souders at 1389 Grandview Court.
Officer Banghman, along with Officer Brace Althouse went to 1389 G-rendview Court, whereupon Officer Banghman
verified the Protection Order was still valid and that it in fact excluded the defendant from the Plaintiff's home and prohibited the
defendant from having any contact with the plaintiff.
Officer Baughman knocked on the door of the plaintiff's residence and the plaintiff answered the door and upon questioning
from Officer Banghmen stated that the defendant was not present at the residence. Officer Baughman gained permission from the
Plaintiff to look around the reesidence to verify the Defendant was not present. Upon entering the living room, Officer Baughman
asked the Plaintiff's son if the Defendant was present in the residence. The child indicated the Defendant was either in a closet or
upstairs. Officer Baughman yelled upstairs and the Defendant answered and came to the top of the stairs and was then takend into
custody by Officer Althouse for violation of Protection Order 99-1744, Paragraph 3 directing the defendant not to have ANY

money order made payable to The Housing Authority of the County of Cumberland, and
mailed to 60 West Penn Street, Carlisle, PA 17013 (717) 245-0516. Defendant's first payment
shall be due April 15, 1999.
In addition, Defendant shall pay Plaintiffdirectly for her out-of-pocket losses of $88.28
for medical treatment she received as a result of the incident which occurred on or about
March 16, 1999, reference Exhibit A. Payments are to be made in the form of a check or
money order made payable to Plaintiff, and mailed to her residence at 1389 Grandview Court,

defendant shall be placed on probation for a period of six
months on the condition that he pay any costs associated
with this proceeding and that he abide by all other
provisions of our final protection order dated April 13,

cause, whether or not the violation is committed in the presence of the police. 23 Pa.C.S. §6113.
Subsequent to an arrest, the police officer shall seize ail weapons used or threatened to be
used during the violation of the Protection Order or during prior incidents of abuse. The Cumberland
