RHOADS, by and through his attorney, LESLEY J. BEAM, ESQ., and makes the following Petition to Modify the Custody Order: 1. The Petitioner is James C. Rhoads, residing at 1812 Carlisle Road, Camp Hill, Cumberland County, Pennsylvania 17011 (hereinafter "Petitioner" or "Father"). 2. The Respondent is Erin L. Shistle, nee Klein, believed to be residing at 50K Stony Lane, Dover, York County, Pennsylvania 17315 (hereinafter "Respondent" or "Mother"). 3. A current custody order is in effect regarding the custody of the following child: Bryant J. Rhoads, born July 22, 1998 (currently 9 years old) (hereinafter the "child"). This order was dated May 6, 1999, and provided that Mother had primary physical and legal custody of the child. This order did result from a conciliation in which Father was not in attendance. A copy of this Order is attached as Exhibit "A". 4. For the last two years, until approximately two weeks prior to the filing of this Petition, however, the child had been in Father's de facto physical custody. Mother voluntarily placed the child with Father, and for the first four months after said placement, Mother had no contact with the child while in Father's custody. 5. Prior to that time, the child was in Father's custody three to four days per week. 6. Approximately two weeks ago, Mother picked up the child from school, and has not permitted the Father to have custodial time with the child since that point. 7. Mother has been an unstable parent, consistently relocating with the child, and changing the child's school and home environment at a whim. It is believed that this relocation affected the child both emotionally and mentally. 8. While in Father's consistent care for two years, the child flourished. Father has been a consistent parent, and the child benefited from such consistency. 9. Father is respectfully requesting that this Honorable Court issue an Order granting Father primary physical and primary legal custody of the child. 10. Father is also requesting that a conciliation be scheduled as soon as possible, and that a hearing be set in an expedited manner, in order to return the child as quickly as possible to the home in which the child was flourishing. 11. The best interest and permanent welfare of the child will be served by granting the relief requested because: (a) Mother has demonstrated that she is not a consistent or stable parent, in her constant relocation; (b) Mother's current actions, in abruptly removing the child from his Father's care after two constant years in his custody, demonstrate a disregard for the best interest of the child, and the of the relationship between Father and child; (c) Father is more than able to provide a stable home and stable emotional environment for the child; and (d) Father has the facilities to provide for the care, comfort and control of the child, as well as the intention and desire to do so.
