OI t,.¢,10 : CIVIL DIVISION - LAW COMPLAINT The Plaintiff, SUSQUEHANNA VALLEY FEDERAL CREDIT UNION, Formerly Known As WEST SHORE TEACHERS FEDERAL CREDIT UNION, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of TWELVE THOUSAND, THREE HUNDRED THIRTY-FOUR DOLLARS AND NINETY-FOUR CENTS ($12,334.94), along with interest thereon at the rate of 13.50% per annum from October l 1,200 l, upon a cause of action of which the following is a statement: 1. The Plaintiff, SUSQUEHANNA VALLEY FEDERAL CREDIT UNION, is organized and existing under Federal laws, having its principal office and place of business at 1213 Slate Hill Road, Camp Hill, Cumberland County, Pennsylvania 1701 l, and was formerly known as WEST SHORE TEACHERS FEDERAL CREDIT UNION. 2. The Defendant, DENISE M. ANDERSON, is an adult individual residing at 330 South Washington S~eet, Apartment 5, Mechanicsburg, Cumberland County, Pennsylvania 17055, and was formerly known as DENISE M. SZYMCZAK. 3. On or about October 2, 1992, Defendant did complete and execute Plaintiff's Loanliner Application to induce Plaintiff to extend credit to Defendant at various times and for various amounts. A tree and correct copy of said Loanliner Application is attached hereto, marked as Exhibit "A" and made a part hereof. A:~27611COM.WPD:16Oct01 4. To fuaher induce Plaintiff to extend credit to her, Defendant did also execute Plaintiffs Loanliner Credit Agreement. A true and correct copy of said Credit Agreement is attached hereto, marked as Exhibit "B" and made a part hereof. 5. Through extension of credit to Defendant by Plaintiff at various times and for various amounts, with the most recent extension of credit on or about January 3, 2001, as set forth on Plaintiffs Loanliner Advance Request Voucher and Security Agreement hereto attached, marked as Exhibit "C" and made a part hereof, Defendant has created a principal balance due and owing in the amount of Nine Thousand, Six Hundred Eighty-Two Dollars and Thirty-Two Cents ($9,682.32), as set forth in Plaintiffs Statement of Account hereto attached, marked as Exhibit "D" and made a part hereof. 6. Due to Defendant's default in payment of said amount due and owing as aforesaid, interest has been added to said account in the total amount of Five Hundred Thirty-Seven Dollars and Thirty-Two Cents ($537.89), as shown on Exhibit "D" attached hereto and made a par~ hereof. 7. Due to Defendant's default in payment of said amount due and owing as aforesaid, and pursuant to the terms and conditions found on Plaintiffs Exhibits "A", "B" and "C", attorney's fees have been added to said account in the total amount of Two Thousand, One Hundred Four Dollars and Seventy-Three Cents ($2,104.73), as set forth on Plaintiffs Exhibit "D" attached hereto and made a part hereof. 8. The balance due and owing by Defendant to Plaintiff is the sum of Twelve Thousand, Three Hundred Thirty-Four Dollars and Ninety-Four Cents ($12,334.94), as appears by the Statement of Account hereto attached, made a part hereof and marked as Exhibit 9. Plaintiffhas fi'equently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant has refused and neglected and still refuses and neglects to pay said amount of any part thereof. PROMISE TO PAY -- You promise to repay to the credit union all advances made to you under this Plan and any applicable charges described in the Addendum together with interest on what you owe until the total amount has been repaid. The interest rate depends on the subaccount under which the advance is made. The Addendum shows the current interest rates as daily periodic rates and their corre- sponding annual percentage rates. If the interest rate for any or ali advances is a variable interest rate, the Addendum explains how the variable interest rate works. PAYMENTS -- The amount of payments for an advance is determined according to the payment schedule in the Addendum. Payments are due on the last day of each month unless a different date is set by the credit union at the time of an advance. If the Addendum has no payment schedule for a sub- account, the amount and due date of payments will be determined at the time of each advance. Payments must include any amount past due and any amount by which you have exceeded any credit limit you have been given for a subaccount. You may prepay all or part of what you owe at any time without any prepayment penalty. COST OF CREDIT -- The dollar amount you pay for money borrowed is called a finance charge and begins on the date of each advance. The sum of these amounts is the finance charge owed. The balance used to compute the finance charge is the unpaid balance each day after payments and credits to that balance have been subtracted and any new advances have been added. A finance charge will be computed separately for each separate balance under this Plan. SECURITY INTEREST -- You agree that all advances under this Plan will be secured by the shares and deposits in all joint and individual accounts you have with the credit union now and in the future. Additional security will be required depending on the subaccount under which an advance is requested. For example, a subaccount called "New Car Advances" means the security will be a new car. Shares and deposits in an Individual Retirement Account and any other account that would lose special tax treatment under state or federal law if given as security are not subject to the security interest you have given in your shares and deposits. Property given as security under this Plan or for an,/ other loan will secure all amounts you owe the credit union now and in the future. However, for advances made under this Plan, the credit union specifically waives any security interest it may have in your dwellings given through any other mortgages or security agreements. DEFAULT -- You will be in default if you do not make a payment of the amount required when it is due. You will be in default if you break any promise you made under this Plan or if anyone is in default under any security agreement made in connection with an advance under this Plan. You will be in default if you die, file for bankruptcy, become insolvent, if you make any false or misleading statements in any credit application or update of credit information, or if something happens which the credit union believes may substantially reduce your ability to repay what you owe.
