COMPLAINT
I, Plaintiff. Ronald A. Foltz. (hereinafter referred to as "Buyer") is an adult
individual residing at 3510 Fishing Creek Valley Road, Harrisburg, Dauphin County,
Pennsylvania,
2. Defendant, Harrisburg Marine Center (hereinafter referred to as "Seller") is an
entity trading and doing business in Pennsylvania with its principal office located at 333
South Front Street, Wonnleysburg, Cumberland County, Pennsylvania.
3, On January 29, 1997, Buyer entered into a Marine Purchase Agreement with
Seller to purchase a new 1997 Sea-Doo Challenger, title number 5603 CECA2325C797,
for Ten Thousand Six Hundred Ninety-nine ($10,699,00) Dollars plus sales tax, title,
registration and office fees and trailer, for a total purchase price of Eleven Thousand Four
Hundred Fifteen ($11,415.94) Dollars and Ninety-four Cents, A true and correct copy of
the Marine Purchase Agreement is incorporated by reference herein and attached hereto
as Exhibit "A."
4, Prior to entering into the Marine Purchase Agreement, Buyer had advised Seller's
sales representative that he desired to purchase a boat to be used primarily for water
skiing on a lake,
12, On or about June 22, 1997, Buyer attempted to use the boat for water skiing and
discovered the defect was not corrected and the boat continued to hesitate and/or stall
when given gas after idling when attempting to pull a water skier.
13, On or about June 28,1997, Buyer again returned the boat to Seller for service to
correct this defect.
14, Seller serviced the boat under the warranty and Buyer was advised that, after
consultation with the manufacturcr, Seller did the following: "change Rave valve
housings, verify accelerator pump adjustment, water regulator flush and check pop-off
pressure," A true and corrcct copy of the summary of work pcrformed is incorporated by
reference herein and attached hereto as Exhibit "c,"
15, Thereafter, Buyer allempted to use the boat for water skiing and discovered that
the defect was not corrected and the boat continued to hesitate and/or stall when given
gas after idling when allempting to pull a water skier,
16, On or about July 1997, Buyer again returned the boat to Seller for service to
correct this defect.
17 Seller serviced the boat under the warranty and Buyer was advised that, after
consultation with the manufacturer, Seller did the following: "verify timing and advance
1 degree #3 programmer and drop I size pHotjet 625," A true and copy of the summary
of work performed is incorporated by reference herein and allached hereto as Exhibit "c,"
I 8, Thereafter, Buyer allempted to use the boat for water skiing and discovered that
the defect was not corrected and the boat continued to hesitate and/or stall when given
gas after idling when attempting to pull a water skier,

J 9. On or about September 12, 1997, Buyer again retumed the boat to Seller for
service to correct this defcct.
20, Seller serviced the boat under the warranty and Buyer was advised that, after
consultation with the manufacturer, Seller did the following: "check for water restriction,
change muffler and low speed J 1/4tum high-O," A true and correct copy of the
summary of work performed is incorporated by reference herein and attached hereto as
Exhibit "c,"
21, Thereafter, Buyer attempted to use the boat for water skiing and discovered that
the defect was not corrected and the boat continued to hesitate and/or stall when given
gas after idling when attempting to pull a water skier,
22, On or about September 17, 1997, Buyer again retumed the boat to Seller for
service to correct this defect.
23, Seller serviced the boat under the warranty and winterized and stored the boat for
Buyer, After consultation with the manufacturer, Seller did the following: "did
compression test, noticed slight amount of water on spark plug (mag side), remove head
and see slight discoloration in cyl. walls,...remove base gasket and inspect and replace
base gasket and anything necessary to reseal motor," A true and copy of the summary of
work performed is incorporated by reference herein and attached hereto as Exhibit "c,"
24, On or about June 20, 1998, Buyer allempted to use the boat for the first time
during the J 998 season, Buyer discovered the defect had not been corrected and the boat
continued to hesitate and/or stall when given gas after idling when allempting to pull a
water skier,
25, On or about June 23, 1998, Buyer again retumed the boat to Seller for service to
correct this defect.
