The children were not born in wedlock.
The children are presently in the custody of the Plaintiff and Defendant.
The mother of the children is the Defendant who currently resides at 725 Hummel
Avenue, Lemoyne, Cumberland County, Pennsylvania..
The father of the children is the Plaintiff who currently resides at 725 Hummel Avenue,
Lemoyne, Cumberland County, Pennsylvania,
The father is married to Plaintiff, but the parties are separated.
15. The relationship of Plaintiff to the children is that of natural father. The Plaintiff
currently resides with the following persons: Silvia Comes, Defendant; Daniel Comes, son; and
Jennifer Comes, daughter.
16, The relationship of Defendant to the children is that of natural mother. The
Defendant currently resides with the following persons: Gregory A. Comes, Plaintiff; Daniel
Comes, son; and Jennifer Comes, daughter.
17. Since the child's births, the children have resided at and with the following

18. Plaintiff has not Participated as a party, witness, or in any capacity in any other
19. Plaintiffhas no infonnation of any custody proceeding concerning the children
pending in a court of this Commonwealth,
20. Plaintiff does not know of any person not a party to the proceedings who has
physical custody of the children or claims to have custody or visitation rights with respect to the
children.
21. It is in the best interest and welfare of the ehildren to have Plaintift'and Defendant
share Legal Custody, and each Participate fully as a parent in a Joint Physical Custody
arrangement which considers both parties working schedules. For the following rationale:
A. The children love and require the care and nuturing of both parents;
B. At the present time the parties work during different times and have
essentially been participating in a joint custody arrangement prior to their
separation;
C. Although a future change in residence is anticipated, it is in the best
interests of the minor children to have the ability to maintain close relationships
with both of their parents.
WHEREFORE, Plaintiffrespcctfully prays this Honorable Court to grant
Shared Legal Custody and Joint Physical Custody of the minor children, DANIEL
COMES and JENNIFER COMES, to both Plaintiff, GREGORY A, COMES and
Defendant, SILVIA COMES.
