I. ADMITTED that Plainliff filed a Complaint. It is specifically DENIED thai Defendant was in any way negligent in causing the parking lot "fender bender" which is the subject of this lawsuit or that Plaintiff sustained any personal injuries. 2, DENIED AS STATED, Plaintiff filed preliminary objections to Paragraphs 17, 18,20 and 21 pursuant to Pa, R.C,P, 1028 (a)(3) which requires damages to be pled in accordance with Pa, R,C.P, 1019, 3, ADMITTED, 4, ADMITTED, 5, ADMITTED. .-" ...... 6, DENIED, Defendanl ineorporates by reference his New Matter, Paragraphs 14 through 28 as though fully set forth, By way of further cxplanation, it is absolutely DENIED that Defendant did not have exisling case law, Ireatisc and law review authority fully supporting the Preliminary Objeclions as set forth in New Mutter, 7, DENIED AS STATED, Paragraph 7 is a conclusion oflaw 10 which no response is required, Ifa response were required, Pennsylvania Rule of Civil Procedure 1019 speaks for itself and Weiss v, Equibank, which is cited by Plainliff, is irrelevant since il does not concern a personal injury action nor the type of damages and allegations challenged by Defendant through his Preliminary Objections, 8, DENIED AS STATED, Paragraph 8 is a conclusion of law 10 which no response is required, If a response were required, Commonweallh v. Sunnybrook Dairies, which is cited by Plaintiff, is irrelevant since il does not concern a personal injury aclion nor the type of damages and allegations challenged by Defendant through his Preliminary Objeclions, 9, DENIED AS STATED, Paragraph 9 is unintelligible since it does not end with a complele sentence, To the extenl that it is intelligible, Paragraph 9 is a conclusion oflaw 10 which no response is required, Ifa response were required, Pa. R.C.P, 1019 (I) speaks for itself and Defendant incorporates by reference his response sel forth in New Matter. 10, DENIED AS STATED, Paragraph 10 is a conclusion of law 10 which no response is required, If a response were required, Donlin v. J.J. Newberry Company, which is cited by Plainliff, is irrelevanl since il does nol concern Preliminary Objections, 2 daily occupation 10 her great financial loss and damage", Paragraph 21 of Plainlifl's Complaint reads "[pJlaintifThas been, and probably will in the fulure be, hindered from allending 10 her daily duties, to her great detriment, humiliation and embarrassment" There is no difference belween Paragraph 2 I and Ihat struck by the Monroe Counly Court of Common Pleas because the paragraph does not slate the nalure of the plaintifl's oecupalion, earning capacity or the tolal amounl of time losl from her oecupalion from the lime of the injury unlil the date of swearing 10 the Complaint Id, al200, A true and correcl copy of this Opinion is allached hereto as Exhibil "A", 17. In RI,ine v, Arnold, 34 Lehigh Law Journal 461, 462-463 (1971), the court of common pleas suslained a preliminary objection to a paragraph stating that "plainliff has been unable to attend 10 his employment for various periods of time", Paragraph 18 of Plainlifl's Complaint reads "Plainliff .., has suffered lost wages and will in the future continue to suffer a loss of income and/or loss of earning capacity," There is no difference between Paragraph 18 and that struck by the Lehigh County Court of Common Pleas, As the court observed: "the overwhelming weight of authority in Pennsylvania is that past loss of earnings is an item of special damages and accordingly mllst be pleaded with particularity. " Id. al 462-463, See also 75 Dickinson Law Review 325,345, A true and correcl copy of this Opinion is attached hereto as Exhibit "B", . 18, In Simko v. Eugene LaBuz, M.D., 65 Luzerne Legal Reports 57 (1972), the court of common pleas suslained a preliminary objection to a paragraph which asserted that a personal injury plaintiff was unable 10 return to work pursuant 10 Rule 1019, The court ordered the personal injury plaintiff 10 "sel forth Ihe Iype of employment she is engaged in and what injuries 4 or condilions prevent her from perfonning her work and why," Id, al 60, ^ Irue and correct copy Oflhis Opinion is attached herelo as Exhibit "C", 19, In Moyer v. Dallago, 7 D, & C, 2nd 76 (1956), the court of common pleas suslained a preliminary objection to a paragraph which slated "plaintitT sustained severe and pennanenl injuries as follows: abrasions and conlusions of the face, head and right ann; fracture of the righl wris!." Paragraph 17 oflhc Complaint reads "PlaintitT ,., sutTered extensive and serious personal injuries, including, but nOllimited to, a severe injury to her neck and back, left shoulder separalion, decreased range of movement, TMJ, and acute emotional and psychological tunnoil." As the Schuylkill Court of Common Pleas noted: "Defendant is entitled 10 know, wilh reasonable particularity what pennanent consequences, if any, have resulted from the alleged abrasions and contusions," Id. at 79, In this case Defendanl is entitled to know which injuries are alleged 10 be pennanenl in nalure and their consequences as well as Ihe alleged pennanency ofplainlitrs "psychologicaltunnoil". 20, In Dauphin County the court discussed general and special damages in light of Rule I 019 (I) and stated: "Although Rule 1019 (f) requires only ilems of special damage be specifically staled, the great majority of courts require general damages to be particularized in so far as reasonably practicable when such is requested in the fonn of a preliminary objection," Fahrney v. Food Fair Stores II/C., 81 Dauphin County Reports I at 6 (1963). This language as well as Ihe Commentary in Goodrich-Amram was quoted by the Erie Court of Common Pleas in Maril/e Bank v, Or/aI/do, 25 D, & C. 3d 264 at 268 (1982). 5 2 \. As the Monroe County Court of Common Pleas observed: "There is a difference i I , I I !J l' , between the rlgllt of plaintiff to offer proof under a general avermellt of damages where defendant has not ask ell for a more specific complal/lt, and the right of a defendant to be advised of plaintiff's claim {through tI,e jilillg of a preliminary objection/", Kowaf.~kl v. Walker Estates, Inc., at 202, 22, As late as 1996 President Judge Robert A, Freedberg of the Northampton County Court of Common Pleas sustained a similar preliminary objection in a personal injury action as follows: "Defelldant's next preliminary objection cOlltends that the complalntfails to plead properly the amount of special damages claimed by plallltlff, as required by Pa. R.C.P. 1019 (j). In their respOllSlve brief, Plaintiffs have agreed to provide defelldants with a detailed list of property damages, medical bills alld lost wages illeluding damages updated to mid-January, 1996. As such, the preliminary objections is sustained, but plaintiffs are givell leave to jile an amended pleading ineluding such a listing of special damages." Smickle v. Pugliese and the Township of Palmer, No, 1995. C - 9036, The official citation will be provided at a later date but a copy ofthe published opinion obtained from the official web site of the Northampton County Court of Common Pleas is auached hereto as Exhibit "0". 23. In fact, the following counties have sustained preliminary objections like the one filed by Defendant Hazzard: Adams, Beaver, Centre, Dauphin, Lackawanna, Luzeme, Mercer, Mimin, Monroe, Montgomery, Northumberland and Schuylkill. See Pittmall v. Powell, 9 Adams 113 (1967), Bowers v. Borough of New Brlghtoll, 14 Beaver 200 (1965), Sprout v. Veterans Home Club, 2 Centre LJ, 79 (1961), Withers v. Plaintiffs counscl kncw or should havc known that Pennsylvania Rule of Civil Procedure 1028 permits a Defendant to file a preliminary objection in the form of a more specific pleading regarding special and gencral damagcs, 25, Plainliffs counsel knew or should have known that Ihere is a difference between the right of a plaintiff 10 offer proof at trial under a general avtrment of damages where the defendant has not asked for a more specific complaint and the righl of a defendant to file preliminary objections seeking such informalion, 26, Pennsylvania Rule of Civil Procedure 1019 has remained essenlially unchanged since 1947 and the cases ciled herein remain valid case precedent. 27, Plaintiffs counsel was advised of the relevant case law, trealise and law review article on January 21, 2000 by way of a Ihree (3) page leiter, 28, Despile being informed of the relevanl case law which starts in the lale I 930s and ends in 1996, as well as a treatise and law review article, Plaintiffs counsel chose to Iitigale this Motion for Sanclions instead of allowing Ihe Preliminary Objections 10 be briefed and argued in the ordinary course of business, 7 E III W I- III o .. w III ~ w ... w o III ~ 2E (.,j Z - I~ ..'1c C ~ I ~ :g > 0 '<C',:: !.l '~ ~Co ~~ 001 Ig>" Ill,S " C Co.. The applicalion of Ihe Field holding is clear in Ihis malter: in order to aver properly Iheir claims for punitive dalllages, plaintiffs' complainlmust establish thai Pugliese knew or had reasollto know thnt his actions embodied n high risk of harm to Ihe Smickles, and thai Pugliese nCled in spile of this knowledge. An analysis of eoullls !, II and Ill, as well as a consideration of the nature of Pugliese's actions themselves, show that while plaintiffs aver that Pugliese knew or should havc known that his actions would altcr the flow of water across his land. plaintiffs do Ilot aver that Pugliese fully appreciated a high risk of physicnl hann that his i1ctions presented to plaintiff, nor that Pugliese acted despite this apprcciation of risk, 1 The averments support a claim for negligent misconduct. but not outragcous misconduct. Therefore. thc defcndant's preliminary objcction to plaintiffs' claim of punitive damilgcs is sustained: plaintiff is hcrcby granted leave to file an amended complaint in confonnity with this order.
