17. In RI,ine v, Arnold, 34 Lehigh Law Journal 461, 462-463 (1971), the court of
common pleas suslained a preliminary objection to a paragraph stating that "plainliff has been
unable to attend 10 his employment for various periods of time", Paragraph 18 of Plainlifl's
Complaint reads "Plainliff .., has suffered lost wages and will in the future continue to suffer a
loss of income and/or loss of earning capacity," There is no difference between Paragraph 18
and that struck by the Lehigh County Court of Common Pleas, As the court observed: "the
overwhelming weight of authority in Pennsylvania is that past loss of earnings is an item of
special damages and accordingly mllst be pleaded with particularity. " Id. al 462-463, See also

18, In Simko v. Eugene LaBuz, M.D., 65 Luzerne Legal Reports 57 (1972), the court
of common pleas suslained a preliminary objection to a paragraph which asserted that a personal
injury plaintiff was unable 10 return to work pursuant 10 Rule 1019, The court ordered the
personal injury plaintiff 10 "sel forth Ihe Iype of employment she is engaged in and what injuries

or condilions prevent her from perfonning her work and why," Id, al 60, ^ Irue and correct

19, In Moyer v. Dallago, 7 D, & C, 2nd 76 (1956), the court of common pleas
suslained a preliminary objection to a paragraph which slated "plaintitT sustained severe and
pennanenl injuries as follows: abrasions and conlusions of the face, head and right ann; fracture
of the righl wris!." Paragraph 17 oflhc Complaint reads "PlaintitT ,., sutTered extensive and
serious personal injuries, including, but nOllimited to, a severe injury to her neck and back, left
shoulder separalion, decreased range of movement, TMJ, and acute emotional and psychological
tunnoil." As the Schuylkill Court of Common Pleas noted: "Defendant is entitled 10 know,
wilh reasonable particularity what pennanent consequences, if any, have resulted from the
alleged abrasions and contusions," Id. at 79, In this case Defendanl is entitled to know which
injuries are alleged 10 be pennanenl in nalure and their consequences as well as Ihe alleged
pennanency ofplainlitrs "psychologicaltunnoil".
20, In Dauphin County the court discussed general and special damages in light of
Rule I 019 (I) and stated: "Although Rule 1019 (f) requires only ilems of special damage be
specifically staled, the great majority of courts require general damages to be particularized in so
far as reasonably practicable when such is requested in the fonn of a preliminary objection,"
Fahrney v. Food Fair Stores II/C., 81 Dauphin County Reports I at 6 (1963). This language as
well as Ihe Commentary in Goodrich-Amram was quoted by the Erie Court of Common Pleas in
Maril/e Bank v, Or/aI/do, 25 D, & C. 3d 264 at 268 (1982).

22, As late as 1996 President Judge Robert A, Freedberg of the Northampton County
Court of Common Pleas sustained a similar preliminary objection in a personal injury action as
follows: "Defelldant's next preliminary objection cOlltends that the complalntfails to plead
properly the amount of special damages claimed by plallltlff, as required by Pa. R.C.P. 1019
(j). In their respOllSlve brief, Plaintiffs have agreed to provide defelldants with a detailed list
of property damages, medical bills alld lost wages illeluding damages updated to mid-January,
1996. As such, the preliminary objections is sustained, but plaintiffs are givell leave to jile an
amended pleading ineluding such a listing of special damages." Smickle v. Pugliese and the

23. In fact, the following counties have sustained preliminary objections like the one
filed by Defendant Hazzard: Adams, Beaver, Centre, Dauphin, Lackawanna, Luzeme, Mercer,

since 1947 and the cases ciled herein remain valid case precedent.
27, Plaintiffs counsel was advised of the relevant case law, trealise and law review
article on January 21, 2000 by way of a Ihree (3) page leiter,
28, Despile being informed of the relevanl case law which starts in the lale I 930s and
ends in 1996, as well as a treatise and law review article, Plaintiffs counsel chose to Iitigale this

4, At all times material hereto, Plaintiff, Linda M, Morrison, was the operator of a 1995
Ford Probe owned by Linda M, Morrison bearing Pennsylvania Reg. AJL5783 (hereinafter
"Plaintiffs vehicle").
5. At all times material hereto. Defendant. David E, Hazzard. was the operatorofa 1984
Volkswagon Rabbit owned by Paul J, Siska bearing Pennsylvania Reg. BDR4633 (hereinafter
"Siska's vehicle"),
6. At all times material hereto. Defendant. David E, Hazzard. was employed by

operating the Siska vehicle in the parking lot of 313 South 10th Street. Lemoyne. Cumberland

the parking lot with the right of way. when suddenly and without warning. Defendant Hazzard failed
to stop at the end of a row of parked cars, failing to yield the right-of-way to Plaintiff and impacted
the driver's side of Plaintiffs vehicle as Plaintiff was traveling down the right-of way through the
parking lot.

(j) In driving his vehicle upon the highway in a manner endangering persons and
property and in a manner with careless disregard to the rights and safety of others
in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvllnia: and
(k) In flliling to yicld the right-of~way to Plaintiff's vehicle,
27, As a direct and proximate result of the negligence of Defendant, Oliver
Enterprises, by and through its agent, servant, and/or employee, Defendant, David Hazzard,
Plaintiff, Linda M, Morrison, has saffered extensive and serious personal injuries, including, bat
not limiled to, a severe injury to her neck and back, left shoulder separation, decreased range of
movement, TMJ, and acute emotional and psychological turmoil.
28, As a result oflhe negligence oflhc Defendant, Oliver Enterprises, by and through
ils agent, servant, and/or employee, Defendanl, David Hazzard, Plaintiff, Linda M, Morrison, has
suffered great physical pain, discomfort, and mental anguish, and will continue to cndure the same
for an indefinite period of time in the fUlure, to her great physical, emotional, and financial
detriment and loss,
29, As a result of the negligence of Defendant, Oliver Enterprises, by and through its
agent, servant, and/or employee, Defendant, David Hazzard, the Plaintiff, Linda M, Morrison, has
suffered lost wages and will in the future continue to suffer a loss of income and/or loss of earning
capacity,
30, As a result of the negligence of Defendant, Oliver Enterprises, by and through its
agent, servant, and/or employee, Defendant, David Hazzard, the Plaintiff, Linda M. Morrison, has
been compelled, in order to effect a cure for the aforesaid injuries, to spend money for medicine
