PETITION FOR SUPERSEDEAS

AND NOW, comes the Petitioner, Cumberland Valley Motors, by its attorneys, Mette,
Evans & Woodside, and avers the following in support of this Petition for Supersedeas:
1. The Appellant is Cumberland Valley Motors of 6720 Carlisle Pike,
Meehanicsburg, Pennsylvania, 17055, official inspection station number D/304.
2. Appellee is the Commonwealth of Pennsylvania, Department of Transportation,
vehicle inspection division, P.O. Box 68697, Harrisburg, Pennsylvania, 17106-8697.
3. By appeal filed concurrently with this Petition, Cumberland Valley Motors has
appealed the Department of Transportation's action in suspension of its official inspection station
license, number 0-304, raising procedural and factual defects in the Department of
Transportation's action. A copy of the appeal is attached hereto and incorporated by reference as
if fully set forth at length.
4. Cumberland Valley Motors' privileges to operate as an official inspection station
lapse automatically on April 5, 1999 as a result of the actions undertaken improperly and in
contravention of Commonwealth law by the Vehicle Inspection Division of the Department of
Transportation.
5. Suspension ofCumbcrland Vallcy Motors' liccnsc undcr thc circumstances
dcscribcd in thc attachcd appcal would constitutc a violation of applicablc Commonwcalth law
and an unduc and unnccessary hardship upon Cumbcrland Vallcy Motors.
6. Thc complaint prosccutcd by thc Vchicle Inspcction Division against a single
Cumberland Valley inspection mechanic was not the subjcct of and did not result in any dangcr
to the public safety.
7. The Vehicle Inspection Division has independcntly conductcd an investigation of
Cumberland Valley Motors' policies and procedures in the inspection ofncw and used motor
vehicles and, upon information and belief, has determined that Cumberland Valley Motors is in
compliance with all applicable state laws.
8. Therefore, the public health, safety and welfare and order will not be negatively
affected in any manner by this Court's issuing an order of supersede as pending final disposition
of Cumberland Valley Motors' appeal.
WHEREFORE, the Petitioner, Cumberland Valley Motors, respectfully prays that this
Honorable Court will enter the attached order of supersedeas directing the Department of

Transportation to lift the suspcnsion ofCumbcrland Vallcy Motors' liccnsc pcnding final
outcome and disposition ofCumbcrland Valley Motors' appcals.

Pcnnsylvania, and no noticc was cvcr provided to Cumberland Valley Motors that its own Iiccnsc
might bc in jcopardy or under rcvicw in concert with the administrative procecding being
directed with regard to Mr. Morris's liccnse.
7. Upon information and belicf. Mr. Morris was bcing citcd for failure to pull wheels
as rcquired undcr statc and Cumberland Vallcy Mo:.>rs opcrating proccdures when inspecting a
vehicle.
8. Any failurc by Mr. Morris to follow state and Cumbcrland Valley Motors
mandatcd proccdures in the inspection of motor vehicles was undertaken without knowledge and
despite the supcrvision of Cumberland Valley Motors and was in the nature ofa violation which
Cumberland Valley Motors, under the circumstances, could not have prevented, and therefore
could not be held rcsponsible for.
9. The Commonwealth's action against Cumberland Valley Motors' license under
the circumstances failed to comply with the required procedures under the Administrative
Procedures Act and applicable administrative code sections.
10. Upon information and belief. if. given the opportunity to present testimony
relating to any failures alleged on the part of Mr. Morris, Cumberland Valley Motors would be
able to establish that it is not responsible under the law for any failure which might have been
undertaken by Mr. Morris.
II. Upon information and belief. the Vehicle Inspection Division conducted an
investigation of Cumberland Valley Motors and its related dealership entities in order to

determine whether or not Cumberland Valley Motors maintained policies in violation of

Pennsylvania statute and eode, and determined, as a result of that investigation, that Cumberland
Valley Motors' proeedures and practices are fully in compliance with stale law.
WHEREFORE, the Appellant, Cumberland Valley Motors, respectfully prays that this
Court will schedule a hearing at which evidence may be taken and at the close of that hearing
overturn the Department of Transportation 's suspension action against Cumberland Valley
Motors.

ORDER OF SUSPENSION OF OFFICIAL INSPECTION STATION
You are hereby notified that your Certificate of Appointment
as an official safety inspection ~tation is suspended, pur-
suant to Section 4724 of the Vehicle Code, No vehicle
safety inspections may be performed at your station during
the suspension. Pursuant to Departmental regulations, your
Certificate of Appointment will be suspended for two (2)
months for faulty inspection on a Dodge Avenger and one (1)
year for fraudulent record keeping by John G. Morris, Opr.
#24-798-857. Further, the Department is including in this
offense, the lesser included offenses of improper record
keeping and careless record keeping.
The suspension(s) will run concurrently X consec-
utively, for a total suspension of one (1) year-and two (2)
months. THE SUSPENSION WILL BE EFFECTIVE 30 DAYS FROM THE
MAIL DATE OF THIS ORDER. At the end of the 30 days, you are
ordered to surrender to the Quality Assurance Officer, who
is a representative of the Department of Transportation,
your Certificate(s) of Appointment and all safety inspection
stickers.
Two (2) weeks prior to the expiration of your suspension,
you may contact your Quality Assurance Officer for reap-
pointment. A complete and thorough investigation may be
conducted to determine if you are qualified for reappoint-

MOTION FOR CONTINUANCE
The Commonwealth ofPcnnsylvania, Department of Transportation, Bureau of Motor
Vehicles (Department), by and through its attorney, Barbara A. Darkcs, Esquire, respectfully
represents as follows:
I. On March 5, 1999, the Department mailed to Cumbcrland Valley Motors, O.I.S.
#D-304, a notice informing them that as a result of a violation offaulty inspection and fraudulent
recordkeeping, their certificate of appointment as an official safety inspection station was being
suspended for a total period of fourteen months..
2. On April I, 1999, Cumberland Valley Motors, by and through its learned counsel,
David A. Fitzsimons, Esquire, filed an appeal of the above mentioned suspension.
3. A hearing in the matter is scheduled for Monday, June 28, 1999, at I :30 p.m. in,
Courtroom No.5, Cumberland County Courthouse, Carlisle, PA.
4. Counsel for Cumberland Valley Motors and the Department have been in
consultation regarding a possible scttlement in this case and believe a settlement may be reached;
