COUNTERCLAIM
15. Defendant incorporates the Denials of paragraphs 1 through 14 as i(fully set forth herein.
16. During the period of Plaintiffs' tenancy in Defendant's building, Plaintiffs damaged numerous
items, including the ceiling fan and light, the garbage disposal, and Ihe sink.
17. Plaintiffs also failed to pay rent in the amount of $186.00.
18. Plaintiffs incurred late charges on seventeen (17) occasions, pursuant to Section G of the
Lease, as a result of Plaintiffs' failure to pay rent in a timely fashion.
19. Defendant is entitled to Judgment in the amount of $671.00 by reason of the foregoing:

13, Pursuant to the Landlord Tenant ACI, 68 Pa,C.S.A 250,511b, Plaintiffs are
entitled to interest on their deposit of SIX HUNDRED SEVENTY FIVE DOLLARS ($675 00)
from February of 1996, the second anniversary of the lease, through the dale ofpaymcm, or thc
additional approximate sum of THIRTY THREE DOLLARS AND SEVENTY-FIVE CENTS
($33,75) per annum, said costs to continue at approximately TWO DOLLARS AND EIGHT-
ONE CENTS ($2,81 per month) per month until payment.
14, Pursuant to the Landlord Tenant Act, 68 P,S, 250.512, Defendant has forfeited
any right to withhold the security deposit or any portion thereof. Plaintiffs are entitled to double
the security deposit or the sum of THIRTEEN HUNDRED FIFTY DOLLARS ($1,350,00)
because of Defendant's failure to return the security deposit within the thirty days required under
the act or 10 otherwise comply with the terms of the Act.
WHEREFORE. Plaintiffs requests judgement in the amount of ONE THOUSAND
FOUR HUNDRED FIFTY-SIX DOLLARS AND EIGHTY-SEVEN CENTS ($1,456,87),
together with continuing interest at TWO DOLLARS AND EIGHT-ONE CENTS ($2,81 per
month) per month and all costs of suit, including District Justice fees, untillhe date of payment of
judgment.
