voluntarily but, rather, was given to Plaintiff by one of Defendant's flcor captains, and not by
Defendant's management. pursuant to a demand therefor by a representative of Plaintiff who stated
that Plaintiff would not return to the stage and would not perform until receipt of the check,
6, Denied, To the contrary, Plaintifl's performance throughout the evening was
sporadic and interrupted by periods of time wherein Plaintiff shut down its faulty and malfunctioning
equipment,
7, Admined in part, denied in part, It is admitted that Defendant stopped payment of
the check and that Defendant did not inform Plaintiff. After reasooable investigation, Defendant is
without knowledge or information sufficient to form a belief as to the truth of the remaining
averments,

hotel.

16, According to the terms of the Contract, Defendant was to make the facility
available to Plaintiff at least five (5) hours prior to the desired set-up completion time,
17, The facility was available at least five (5) hours prior to the set.up completion
time, However, Plaintiff did not arrive until about 3:00 p,m" three (3) hours prior to door opening
of 6:00 p,m, for a dinner which was to commence at 6:30 p,m, and to be followed by Plaintiff's
performance at 9:00 p,m,

18, After approximately one.haJf(I/2) hourofperl"ormance, Plaintiffstopped playing
due to vollage fluctuations caused by its defective equipment
19, Plaintiff indicated to Defendant's Chief Engineer that they had not checked out
their equipment prior to performance because they did not have the ti/lle to do so,
20, Plaintiff, after it shut down its performance, demanded and received payment from
one of Defendant's floor captains, claiming that they would not continue any performance without
payment.
21, Plaintiff, after it shut down its performance, hard.wired its power cable directly
into a panel in Defendant's generator room which bypassed the facility's electrical distribution lines,
22, Despite Plaintiffs said hard-wiring, its faulty and malfunctioning equipment
continued to shut down throughout its performance,
23, Defendant's Chief Engineer offered Plaintiffs Production Manager the opportunity
to use a different electrical panel within the facility's generator room, to which Plaintiff refused,
24, Defendant provided the proper electrical supply to Plaintiff at all times,
25, Plaintiff was aware that Defendant's power supply was adequate since they had
performed on two previous occassions in the exact same room of Defendant's facility,
26, Plaintiff's personnel appeared on stage and announced to the public that the
Defendant was to blame for problems in the performance,
27, Prior to commencement of and during its performance, Plaintiff's personnel had
more than one fan running on stage to keep at least one piece of its equipment cool.
28, Plaintiff's personnel admitted to Defendant's Assistant Engineer that the band had
experienced the same problem only a few months' previous thereto at another performance,

and against Plaintiff in the amount of S15,257,00 plus interest, COSIS, allorneys fees and such

of the allegation is delliI'd, Plaintiffs' Production Manager arrived at
Defendilnl's fdcility at approximately 12:30 p,m, Plaintiffs' Productiol1
Manager immediately began unloading the truck upon arrival. Set up was
completed by 6:00 p.m, and dinner music by compact discs, (.CDs. herein),
were playing as guests entered the room,
18, Denied, This allegation is specifically denied, The entire first set was
completed in its entirety, that set being fifty (50) minutes, Concerns regarding
technical problems were not addressed until the first scheduled break, It is
specifically denied that Plaintiffs' equipment was defective in any manner, The
voltage fluctuations were a result of an outside power source, The Plaintiffs'
equipment does not provide voltage and operates off of the voltage supplied to
it by an outside source,
19, Denied, It is specifically denied that anyone connected with the Plaintiffs
indicated to Defendant's Chief Engineer that they had not checked out their
equipment prior to the performance because they did 110t have the time to do
so. The Plaintiffs' Production Manager checked all of their equipment prior to
performance and it was operating by 6:05 p,m, when CDs were playing,
20, Admitted in part, denied in part, It is specifically del1ied that Plaintiffs shut
down its performal1ce to demand al1d receive payment from one of Defendant's
floor captains, c1aimil1g that they would not continue any performance without
payment. It is admitted thaI the contract states that: "the balance due is to be
paid prior to the performance at the engagemel1t site," This payment had not
been made and, at a point in mid-evening, Plaintiffs's President, James Simon,
asked one the Defendant's representatives for the balance of the engagement
fee, The representative of the Defendant told Mr, James Simon that she would
be right back with it and, after several minutes, returned and presented the

21. Admitted in part, denied in part, It is denied that Plaintiffs' shut down its
performance, It is admitted that Plaintiffs, in an attempt to resolve the voltage
situation, hard wired its power cable directly into a panel in Defendant's
generator room, bypassing the facility's electrical distribution lines,
22. Denied, It is specifically del1ied that Plaintiffs had any faulty or malful1ctioning
equipment. The problem with the equipment shut down was the failure of the
facility to be able to supply the proper voltage,
23, Denied, It is specifically del1ied that Plaintiffs' Production Manager refused to
use a different electrical panel within the facility's generator room, The
Plaintiffs' Production Manager, along with the Defendant's Assistant El1gineer,
attempted to tie in at different times to a different electrical panel.
24, Denied, It is specifically denied that Defendant supplied the proper electrical
supply to Plail1tiffs at all times and proof is demanded, The voltage supplied to
Plaintiffs by Defendant's facility was improper.
25, Admitted in part, denied ill part, It is admitted that Plaintiffs' had performed in
Defendant's facility 011 two (2) previous occasions in the same room, It is
specifically denied that the Defendant's power supply was adequate, as the
power supply can vary from a prior performance to the current performance,
26, Del1ied. One of the band members did appear on stage and offer an apology
to the public and state that it was not the fault of the Plaintiffs, None of the
Plaintiffs' personnel have any recollection stating that Defendant was to blame
for the problems during the performance, It is further averred that

demanded, It is further averred that none of the problems experienced on this
occasion were ever experienced before,
WHEREFORE, Plaintiffs respectfully request that Defendant's New Malter be dismissed
and judgment be entered in favor of Plaintiffs and against Defel1dant as prayed for in Plaintiffs'
Complaint.

Plaintiffs's Complaint and the New Matter which has previously been replied
