WHEREAS, JAMES A SCHUCK, (the "Owner"), has executed or is about to e"ecute
contemporaneously herewith a contract with WHEATLAND CUSTOM HOMES. a Pennsylvania
contractor, (the "Contractor"), for construction of a single family dwelling (collectively the
"Improvements") on a tract ofland located on Abington Way, situate in Hampden Township.
Cumberland County. Pennsylvania, known as 1320 Abington Way, Meehanicsburg. and more
particularly described in E"hibit A attached hereto, incorporated herein by reference and made a
pan hereof (the "Premises"),
NOW, March 31-, 1999, before any authority has been given by the Owner to the
Contractor to commence work on the Improvements, or to purchase materials for the same, or to
enter into any contracts with any subcontractors or materialmen. or to authorize any purchases by
or through any subcontractors or materialmen, in consideration of the making of said contract
with the Owner and the further consideration of One ($1.00) Dollar, to Contractor paid by
Owner, and with the intent of all ponies to be legally bound hereby, it is agreed that no lien shall
be tiled against the Improvements, the Premises, or any pan thereof, by the Contractor or any
subcontractor, or by any of the materialmen or workmen or any other person for any labor, or
materials purchased, or e"tra labor or materials purchased, for the Improvements to the Premises
(including hereafter changes made thereto), the right to file liens being expressly waived,
It is the full intent of the Contractor. for himself and for any subcontractors or material
men claiming for themselves, or by. through or under the contract or the Contractor, that the right
to file a mechanic's lien. under the provisions of law and/or of Acts of Assembly in such cases
made and provided, for work done or materials furnished in ad about the eonstruction of the
Improvements to the Premises is hereby waived,

Description
All THAT CERTAIN parcel of land situate in Hampden Township, Cumberland County,
Commonwealth of Pennsylvania, more particularly bounded and described to wit:
BEGINNING at a concrete monument on line of lot No. 143 and corner common to the
southeasterly corner of lot No. 16 of Hampden Hearth Phase I Subdivision, said point being
located,
South 020 14' 10" West, a distance of 178.01 feet, from a concrete monument at the corner
common to lot No. 16 and Lot No. 17 of the said Phase I Subdivision; thence, leaving the said
lot No. 143 and extending along the lot No. 144,
South 01 028' 10" West, a distance of 134.21 feet to an iron pin and corner common to lot
No. 144, Lot No. 145 and Lot No. 164; thence; leaving the said lot No. 144 and Lot No. 145
and extending along the said lot No. 164,
North 840 44' 07" West, a distance of 121.07 feet to an iron pin on the easterly right-of-way
of a 50.0 foot street known as Abington way; thence, leaving the said lot No. 164 and
extending along the said right-of-way,
North 01 0 36' 47" East, a distance of 227.33 feet to a concrete monument; thence in a curve
to the left, having a radius of 175.0 feet and a chord of,
