8. The aforemcntioned dispatchers notified the Plaintiff that the infonnation
would bc turned over to Dcfendants' insurance company and that the insurance company would
"take core of it."
9. A lawsuit was intitiated against the Plaintiff as a result of the incident in
Virginia and a judgment was obtained on April 5, 1995, in the amount of $1,164.00.
10. On or about October 27, 1998, Plaintiff discussed the judgment with the
Defendant Harry Grossman and the Defendant Grossman advised the Plaintiff that he should
submit it to the Defendants' insurance company, National Continental/Progressive Claims Group.
II. On or about November 12, 1998, Plaintiff was advised by the
Commonwealth of Pennsylvania, Department of Transportation that his license was being
suspended until he satisfied the judgment obtained in Virginia.
12. Plaintiff submitted the claim to the aforementioned insurance company and
was notified on or about January 15,1999, that Defendants' policy with the insurance company
was canceled as of 12:01 a.m. on January 9, 1993.
13. Upon information and belief, at the time of the aforementioned accident,
Defendants did not have financial responsibility as required by the Motor Vehicle Financial
Resonsibilily Law.
14. In order to prevent the loss of his license, the Plaintiff was required to pay

the judgment in thc amount of SI,197.63.

17. Defendant failed to include Plaintiff and/or the commercial motor vehicle
operated by the Plaintiff under an insurance poliey as required by the Motor Vehiele Financial
Responsibility Law and its agreement with the Plaintiff.
18. Defendant is liable over to the Plaintiff for eontribution or indemnity with
respect to the judgment against Plaintiff in the underlying aetion.
19. As a direct result of Defendant's breach of the law and its agreement with
the Plaintiff, the Plaintiff has incurred damages as set forth herein.
WHEREFORE, Plaintiff demands judgment against Defendant in the amount of
$1,197.63, plus interests, cost of suit, attorney's fees and sueh other relief the Court finds just and
appropriate.
COUNT II - BREACH OF CONTRACT
TEZAK V. ATLANTIC FREIGHT SYSTEMS, INC.
20. Plaintiff incorporates by referenee paragraphs 1- 19 as though set forth
fully herein.

TO PLAINTIFF'S AMENDED COMPLAINT
AND NOW comes the above-named Defendant, Harry Grossman, and makes the
following Answer to Plaintiff's Amended Complaint:
1. Admitted.
2. Denied as stated. Harry Grossman is an adult individual who resides in New
Cumberland. Grossman denies that he has ever done business as, traded as, or operated
under the name of "Atlantic Freight Systems" or any similar title.
3. Admitted.
4. Denied. Plaintiff was never employed by Grossman.
5. Denied. Plaintiff was never employed by Grossman and Grossman was never
obligated to obtain or maintain financial responsibility or any other item for Plaintiff or his
benefit or for vehicles operated by Plaintiff.
6. It is admitted that Plaintiff was involved in a motor vehicle accident in 1994 but
denied that he was in the employment of Grossman at such time.

7. Denied. Don Wick and Dick Charlos woro not employed by Grossman, were not
agents, servants, or omployees of Grossman and woro not acting within the scope of any
employment or authority of Grossman.
8. Denied. Grossmen does not know what such persons told Plaintiff because that
information is within the exelusive control of Plaintiff and third parties and so Grossman
denies same and demands proof thereof at triel.
9. Admitted.
10. Denied as stated. Grossman, in his capacity as an officer or employee of
Atlantic Freight Systems, Inc., advised Plaintiff that the corporation had insurance and
suggested that Plaintiff file a claim with that insurance company. Grossman at no time
stated that he was insured or that he had any liability or that Plaintiff had any claim against
Grossman.
11. Denied. Plaintiff is without information as to the averments in this paragraph
because such information is within the exclusive control of Plaintiff and so Grossman
denies same and demands proof thereof at trial.
12. Denied for the reasons set forth in Paragraph 13 above. By way of further
answer, Grossman denies that the policy of insurance in question was issued to, owned by,
or insured him.
13. Denied as stated. Grossman did not have insurance which extended coverage
to Plaintiff or the motor vehicle being operated by Plaintiff at the time of the accident
involved in this action. However, Grossman had no obligation to provide such financial

responsibility or any other insurance or protection to Plaintiff beceuse Plaintiff was
employed by Atlantic Freight Systems, Inc., and not by Grossman.
14. Denied for the reasons set forth in the answer to Paragraph 11 abuve, which
averments are incorporated herein.
15. Grossman admits that he has refused to reimburse Plaintiff but states that he is
not obligated to reimburse Plaintiff.
COUNT I - BREACH OF CONTRACT
16. No answer required. To the extent a factual response is required, Grossman
incorporates herein the averments set out in the foregoing paragraphs of this answer.
17. Denied as stated. Grossman had no agreement with Plaintiff. Grossman had
no insurance policy and was not required by the Motor Vehicle Financial Responsibility Law
to have such insurance policy, and Grossman could not, therefore, "include" Plaintiff in
such policy.
18. Denied. Grossman is not liable to Plaintiff for contribution, indemnity, or for
any other reason.
19. Denied. Grossman did not breach the law, Grossman did not breach any
agreement with Plaintiff, and Grossman is not obligated to Plaintiff in any way. At all times
relevant to this action, Plaintiff was employed by and operated under the control of Atlantic
Freight Systems, Inc., and was well-aware that he was employed solely by that
corporation.

AMENDED COMPLAINT
I. Plaintiff, Thomas Tezak, ia an adult individual residing at 717 South Front
Street, Steellon, Pennsylvania, 17113.
2. Defendant, Harry Grossman, trading and doing business as Atlantie Freight
Systems, is an adult individual doing business at S 18 Bridge Street, New Cumberland,
Cumberland County, Pennsylvania, 17070.
3. Defendant, Atlantic Freight Systems, Inc. is a corporation incorporated
under the laws of the Commonwealth of Pennsylvania with a prieipal place of business at S 18
Bridge Street, New Cumberland, Cumberland County, Pennsylvania, 17070.
4. In 1994, Plaintiff was employed by the Defendants as a truck driver.
S. According to the tenns of the employement agreement and Pennsylvania
law the Defendants were required to obtain and maintain financial repsonsibility over the
commercial motor vehicles operated by the Plaintiff.
6. In the course and scope of his employment, Plaintiff was involved in an
accident in Virginia in 1994 while driving Defendants' commercial motor vehicle.
7. Plaintiffpromptly informed Defendants' dispatchers, Don Wick and/or Dick
Charlesworth, who are the agents, servants, and/or employees of the Defendanls and were aeting
within the course of Iheir employment and within the scope of their authority.
8. The aforementioned dispatchers notified the PlainlilT that the information
would be turned over to Defendants' insurance company and that the insurance eompany would

5. Defendant does not know the details of the alleged accident In which the
Plaintiff was Involved because that Information is within the exclusive control of the
Plaintiff and others with interest adverse to Defendant and so Defendant denies same
and demands proof thereof at trial. Defendant specifically denies that Plaintiff was
driving a commercIal motor vehicle owned by Defendant.
6. Denied. The Individuals named were not employed by Defendant and were
not authorized to act for the Defendant.
7. Denied. Plaintiff believes the individuals notified Atlantic Freight Systems. Inc.
8. Admitted.
9. Denied. Although it is admitted that Plaintiff attempted to make demands
upon Defendant to pay Plaintiff's debt, Defendant denies that he gave Plaintiff any
advice as described in Paragraph 9 of Plaintiff's Complaint.
10. Denied. Defendant has no knowledge of such action because that is within
the control of the Plaintiff and other parties with interest adverse to Defendant and so
Defendant denies same and demands proof at trial.
11. It is admitted that Plaintiff submitted a claim to the insurance company but
denied that Defendant had any policy of insurance with that company. To the extent
that there was a policy issued. it was not issued to Defendant but was issued to Atlantic
Freight Systems, Inc.

Information or other financial responsibility for the vehicle owned by another party and
operated by the Plainllff.
13. Denied for the reasons set forth In the answer to Paragraph 10 above.
14. It Is admllled that Defendant has failed to pay the sums demanded by Plaintiff
but Defendant denies any liability for such sums or any obligation to pay them.
15. No answer required.
16. Denied. Defendant never had an agreement with the Plaintiff. Plaintiff's
dealings were all with Atlantic Freight Systems. Inc. Defendant had no obligation to
"include" Plaintiff or the commercial motor vehicle operated by Plaintiff under any
insurance policy.
17. Denied. Defendant is not liable to Plaintiff in any way for any reason.
Plaintiff's claims in this matter should be directed against the corporation with which
Plaintiff had his dealings.
18. Denied. Defendant has not breached the law. Defendant has not breached
any agreement with Plainllff. Defendant had no contract with Plaintiff. Any damages
suffered by Plainllff are a result of Plaintiff's own conduct or the conduct of other parties
and not the Defendant.

"take care of it."
8. A lawsuit was inliliated againstlhe I'llIintiff liS a rcsult of lhe ineident in
Virginia and ajudgmelll was obtain cd on April S, 1995, in thc amount ofSI,164.00.
9. On or about Oetobcr 27, 1998, Plaintiff discusscd the judgment with the
Defendant and the Defendant advised the Plaintiff that hc should submit it to the Defendant's
insurance eompany, National Contincntal/Progrcssivc Claims Group.
10. On or about Novcmber 12, 1998, Plaintiff was adviscd by the
Commonwealth of Pennsylvania, Department of Transportation that his license was being
suspended until he satisfied the judgment obtained in Virginia.
II. Plaintiff submitted the claim to the aforementioned insuranee company and
was notified on or about January IS,1999, that Defendant's policy with the insurance company
was canceled as of 12:01 a.m. on January 9, 1993.
12. Upon information and belief, at the time of the aforementioned aecident,
Defendant did not have financial responsibility as required by the Motor Vehicle Financial
ResonsibiIity Law.
13. In order to prevent the loss of his license, the Plaintiff was required to pay
the judgment in the amount of $1,197.63.
14. Defendant has refused to reimburse the Plaintiff for the aforementioned
amount.
