" . MARITAL SE1TI.EMENT AGREEMENT THIS AGREEMENT, made this/C&> -ll.d3y of oct~c.....-' ,2000, by and between RICHARD S. DUNLAP, hereinafter referred to as "HUSBAND", and KIM E. DUNLAP, hereinafter referred to as "WIFE". WITNESSETH, That: WHEREAS, the parties hereto are husband and wife, having been lawfully joined in marriage on June 3, 1989, in Harrisburg, Dauphin County, Pennsylvania; WHEREAS, two (2) ehildren were bom of this marriage; Blain Stuart Dunlap born February 6, 1992 and Mia Ann Dunlap born July 26, 1994; WHEREAS, it is the intention of the parties to settle fully and finally their respective finaneial and property rights and obligations as between each other arising out of the marriage rela1ionship or otherwise, including without limitation (1) the settling of all matters between them relating to the ownership of real and personal property; (2) the settling of all matters between them relating to the past, present and future support and/or maintenance of HUSBAND and WIFE; and (3) the settling of all matters between them relating to any and all rights, titles and interests, claims and possible claims in or against the estate of the other. NOW THEREFORE, with the foregoing recitals being hereinafter incorporated by reference and deemed an essential part hereof in consideration of the foregoing recitals, the mutual promises, covenants and undertakings herein set forth, and for good and valuable - . . considemtion, receipt of which is herehy acknowledged hy each of the parties hereto, HUSBAND and WIFE, euch intending to be legally bound hereby. covenant and agree as follows: I, AI>VICE OF eOlJNSEL IIUSBAND and WIFE declure that they have each had a full and fair opportunity to obtain independent legllllldvice of counsel of their selection. WIFE has been independently represented hy Barhara Sumple-Sullivan, Esquire. IlUSBAND is cognizant of his right to legal representation and declares that he has chosen not to retain an attorney notwithstanding the fact that attorney for WIFE has told him that he has an absolute right to be represented by an attorney. HUSBAND has chosen instead to negotiate directly with counsel and/or with his WIFE. HUSBAND hereby acknowledges that he has done so willingly and the he fully understands the facts and has been fully infonned and understands that, had a Court decided this matter, he may have received more or less than is provided for in this Agreement. HUSBAND knowingly waives his rights, if any, to utilize the lack of his legal representation as a basis to attack the validity of this Agreement. Both parties further acknowledge and agree that each has fully disclosed their respective financial situations to the other, including their assets, liabilities and income. Each of the parties acknowledge and agree that, after having received such infonnation and with such knowledge, 2 . this Agreement is fair, reasonable and equitable and that it is being entered into freely, voluntarily and in good faith and that the execution of this Agreement is not the rcsult of any duress, undue influence, coereion, collusion and/or improper or illegal ^grecment, 2. PERSONAL RIGHTS HUSBAND and WIFE may and shall, at all times hereafter, five separate and apart. Eaeh shall be free from all control, restraint, interference or authority, direet or indirect, by the other in all respects as if she or he were unmarried, except as may be necessary to carry out the provisions of this Agreement. Each may reside at such place or places as she or he may select. Eaeh may, for his or her separa1e use or benefit, conduct, carry on and engage in any business, occupation, profession or employment which to him or her may seem advisable. This provision shall not be taken, however, to be an admission on the part of either HUSBAND or WIFE of1he lawfulness of the causes which led to, or resulted in, the continuation of their living apart. HUSBAND and WIFE shall not molest, harass, or malign the other or the respective families of each other, nor compel the other to cohabit or dwell in any manner with him or her, nor in any way interfere with the peaceful existence, separate from each other. 3. DEBTS Each party represents that they'have not contracted any debt or liability for the other for which the estate of the other party may be responsible or liable except as otherwise provided herein, and that except only for the rights arising out of this Agreement, neither party will 3 . hcreullcr incur uny liubility whatsuever for whieh the other party or the cstate of the other party will he Iillhle. IlUSBAND agrces to indcmnify and hold WIFE hurmless from each of the aforcmentioned dcbts. HUSBAND furthcr agrees to be rcsponsihle for nllauorneys' fees incurrcd by WIFE in defcnsc of any claim or suit brought against her arising from uny debt ineurrcd during thc murriagc, HUSBAND funhcr agrecs to pay one-half(I/2) of WIFE's attorncy fees, costs and cxpcnses ussociated with this divorcc action. HUSBAND shall pay said fces within sixty (60) days of presentation of dcmand by WIFE. The parties acknowledge 1hat sincc scparation WIFE has paid all dcbts associated with the marital residcnce. This includes but is not Iimitcd to all utilitics, improvcments, all taxes (including the taxes that wcre delinqucnt as of the parties' separation for the years 1997, 1998, and 1999 and the currcnt taxes) and any other expenses associated with the marital residence, Said payments made by WIFE on the delinquent taxes werc in excess 01'$3,500.00. Presently, all taxcs associated with the martial residence are currcnt.ÿ 4 .. To the best of the parties' kllowledge, the parties amnn no joint debts exist except the for the first mortgage associated with thc marital residence which are addressed in Paragraph 6 of Ihis Agreement. 4. WAIVER OF APPRAISAL AND INVENTORY The parties acknowledge and agree that they have each had an opportunity to value or have appraised any and all marital property, and they do hereby waive a fonnal appraisal and inventory of same, and no statement or representation by either party as to value shall be deemed a misstatement or misrepresentation to the other or be deemed fraudulent. 5. MARITAL AND NON-MARITAL ASSETS HUSBAND and WIFE do hereby acknowledge that they have heretofore divided the non- marital assets and marital assets including but without limitation, jewelry, clothes, furniture, and other assets wherever situated whether real, personal or mixed, tangible or intangible. HUSBAND agrees that with the exception of a stereo, a grandfather's clock, dishes, and certain pieces of furniture that his family gave to him, all assets in the possession of WIFE shall be the sole and separate property of WIFE. HUSBAND agrees that he shall remove from the marital residence the stereo, grandfather's clock, dishes and furniture given to him by his family within sixty (60) days of the execution of this Agreement. If HUSBAND does not remove these items within this specified time, it is agreed that he shall relinquish any interest, right or entitlement he may have in same and WIFE shall be free to dispose of these items as she sees fit. 5 .. WIFE ag=s that all assets in the possession of IIUSBAND shall be the sole and separate property of HUSBAND. Each of the panics do hereby specifically waive, release, renounce and forever abandon whatever claims, ifany, he or she may have with respect to any of the above said items which arc the sole and separate property of the other, This document shall constitute a bill of sale for said sole property. 6, REAL ESTATE The panies built a home on a tract of land th.t WIFE had received as a gift from her parents, Richard and Barbara Banks. Said property is held jointly by WIFE and her parents. This property is subjec1 to a mortgage with Harris Savings with an approximate balance of FIFTY- THREE THOUSAND FIVE HUNDRED DOLLARS ($53,500.00). HUSBAND is jointly obligated on this debts with WIFE and her parents. It is acknowledged that WIFE has been paying these obligations since the parties' separation as well as all taxes associated with this property. HUSBAND agrees to convey any interest, right or title he may have in this real estate to WIFE, HUSBAND agrees to execute a deed simultaneously with the execution of this Agreement wherein he quitclaims, assigns, conveys and transfers to WIFE all of his interest, right and title in the marital residence. WIFE agrees to assume responsibility for 1he payment of the unpaid balance of the mortgage, together with any interest, penalties and costs as well as any 6 -...----.____....____.h .-.,-__._....u '_'__ ___...______. . other taxes and insurance and associated with the real estate. WIFE hereby agrees 10 indemnify and hold IIUSBAND harmless from uny and nllliahility as a result (lfnon.payment of the mongage or any other dehts associated with the real estate. All rights, title and interest of HUSBAND, or any payments made by him shall be credited to WIFE in the event WIFE must file litigation to clear Richard and Barbara Banks' ownership interest from the property. 7. MOTOR VEHICLES WIFE shall have sole title and ownership of her 1986 Toyota 4x4 Truck which was sold for $1.00 as scrap after separation as inoperable. WIFE shall also have sole title and ownership of the parties 1982 Ford Econoline Van. The title for this vehicle is lost. HUSBAND agrees to sign any and all documents necessary to obtain a new title and to transfer his interest in this vehicle to WIFE. Neither of these vehicles are encumbered. HUSBAND shall have sole title and ownership of the parties' Lincoln Town Car which is presently at Shover's salvage due to an accident HUSBAND had shonly before his relocation. This vehicle is not encumbered. WIFE agrees to sign any and all documents necessary to transfer her interest in this vehicle to HUSBAND. HUSBAND shall be solely responsible for any and all costs, including storage and towing, etc. associated with this vehicle as well as indemnify and hold WIFE harmless from any and all costs arising out of the accident, towing, or storage ofthe vehicle. 7 . 8. PENSION Each pany hereby waives any and all claims that he or she may have against the other to any pension, employee saving, stock benefit program or any other employment benefit of the other, if applicable, 9. BANK ACCOUNTS. INVESTMENTS AND LIFE INSURANCE Each pany shall have sole possession of the bank accounts, investments and/or life insurance in 1hcir own names. HUSBAND will transfer his interest in his life insurance policies and bonds to WIFE for the benefit of his children, Blain and Mia. 10, MUTUAL WAIVER AND RELEASE OF RIGHTS AND CLAIMS CONFERRED BY THE PENNSYLVANIA DIVORCE ACT OF 1980. AS AMENDED HUSBAND and WIFE acknowledge and agree that the provisions of this Agreement ore fair, adequate and satisfactory to them. Both panies agree to accept the provisions set fonh in this Agreement in lieu of and in full and final settlement and satisfaction of all claims and demands that either may now or hereafter have against the other for equitable distribution, alimony, alimony pendente lite, counsel fees, costs and expenses or other provisions for their suppon and maintenance before, during and after the commencement of any proceeding for , divorce or annulment between the panies. 8 . II, AFTER ACOlJlREn P.:RSONAI. PROPERTV/FIITURE EARNINGS Each of thc parties shall hereafter own 1I1ld enjoy independently of any claim or right of the other, all items of personal property, tangible or intangible, hercafter acquired by HUSBAND or WIFE, with full power in him or her to dispose of the same as fully and effectively, in nil respects and for all pUrposes, as though he or she were unmarried. 12. ALlMONV. SUPPORT AND MAINTENANCE Both parties acknowlcdgc and agrcc that thc provisions of this Agrcement providing for equitable distribution of marital property are fair, adequate and satisfactory to them and are accepted by them in lieu of and in full and final satisfaction of any claims or demands that either may now or hereafter have against the other for support, maintenance or alimony. HUSBAND and WIFE further, voluntarily and intelligently, waive and relinquish any right to seek from the other any payment for spousal support, alimony and maintenance. 13. CUSTODY AND VISITATION Legal and primary custody of the children shall be in WIFE. HUSBAND shall have flexible rights of visitation, as the parties can agree. 14. SUBSEOUENT DIVORCE A decree in divorce, entered by a court of competent jurisdiction to either party, shall not suspend, supersede or affect the terms of this Agreement. Both parties agree to enter a Consent 9 . Decree concerning the provisions of this Agreement in the Court of Common Pleas of Cumberland County, Pennsylvania, or any other Court of competent jurisdiction, as a part of a resolution of any divorce action filed. This Agreement, and the terms and conditions contained herein, as well as the enforcement of said tenns and conditions, shall not be contingent upon the granting of a Divorce Decree to either party by the Court of Common Pleas of Cumberland County, Pennsylvania, or any other Court of competent jurisdiction. Furthermore, simultaneously with this agreement, both parties hereto agree to execute the appropriate affidavits and consents to secure a No-Fault Divorce as may be required by the Divorce Code of 1980, as wnended. Both parties hereto agree that this Agreement may be incorporated for purposes of enforcement into a separate Court Order but shall not merge in such order in the Court of Common Pleas of Cumberland County, Pennsylvania. 15. OTHER DOCUMENTATION HUSBAND and WIFE covenant and agree that upon request of the other party, they will forthwith execute and deliver 10 the other party, any and all written instruments, assignments, releases, satisfactions, deeds, notes or such other writings as may be necessary or desirable for the proper effectuation of this Agreement. 16. MUTUAL W AIVER AND RELEASE OF RIGHTS AND CLAIMS IN ESTATE Each party hereby releases, waives and relinquishes any and all rights which he or she 10 may now have, or may hereafter have, against the other pany under the present or future laws of any jurisdiction (a) to share in the estale orlhe other pany upon the olher pany's death and (b) to act as executor/rix or administrator/rix of the other pany's estate. 17, MUTUAL RELEASE HUSBAND and WIFE each do hereby mutually remise, release, quitclaim and forever discharge the other and the estate of such other, for all time to come, and for all purposes whatsoever, of and from any and all rights, title and interests, or claims in or against the property (including income and gain from propeny hereafter accruing) of the other or against the estate of such other, of whatever nature and wheresoever situate, which she or he now has or at any time hereafter may have against such other, the estate of such other or any part thereof, whether arising out of any fonner acts, contracts, engagements or liabilities of such other or by way of equitable distribution, dower or curtesy, or claims in the nature of dower or curtesy of widow's or widower's rights, family exemption or similar allowance, or under the intestate laws, or the righ1 to take against the spouse's will, or the right to treat a lifetime conveyance by the other as testamentary, or all other rights of a surviving spouse to participate in a deceased spouse's estate, whether arising under the laws of (a) Pennsylvania, (b) any Slate, commonwealth or territory of the United States, or (c) any other country, or and rights which HUSBAND or WIFE may have or at any time hereafter have for the past;present or future support or maintenance, alimony, alimony pendente lite, counsel fees, costs or expenses, whether arising as a result ofL'le marital relation or otherwise, except, and only except, all rights and Agreements and obligations of 11 f"' .. whatsoever nature: lIfisinll or which may arise undcr this ^llfCCmcnt or for the breach of any thereof. Each of the parties hereto further covenants and allrecs for himself and herself llI1d his or her heirs, executors, administrators and assigns, that he or she will never, atlll1Y time hereafter, sue the other pnrty or his or her heirs, executors, administrators and assigns, for the purpose of enforcing any of1he rights relinquished under this paragraph, Each of the parties further covenants llI1d agrees that he or she will pennitlll1Y will of the other to be probated llI1d allow administration upon his or her personal, real or mixed estate llI1d allow effects to be taken out by the person or persons who would have been entitled to do so had HUSBAND or WIFE died during the lifetime of the other. Each of the parties hereby releases, relinquishes and waives llI1Y llI1d all right to act as executor or executrix or administrator or administratrix of the other's estate. It is the intention of HUSBAND llI1d WIFE to give to each other by the execution of this Marital Settlement Agreement a full, complete and general release with respect to llI1Y and all property of any kind or nature, real, personal or mixed, which the other now owns or may hereafter acquire, except and only except all rights and Agreements and obligations of whatsoever nature arising or which may arise under this Agreement or for the breach of any thereof. 18. DUNLAP, Defendant IN DIVORCE RE: Pre-Hearing Conference Memorandum DATE: Thursday, April 6, 2000 Present for the Plaintiff, Kim E. Dunlap, is attorney Barbara Sumple-Sullivan. The Defendant has not appeared nor has any attorney appeared on his behalf, This action was commenced by the filing of a divorce complaint on April 9, 1999, raising grounds for divorce of irretrievable breakdown of the marriage and indignities. We are not certain as to whether or not husband will sign an affidavit of consent so that counsel for wife is going to file an affidavit under Section 3301(d) averring a separation of two years. This affidavit can be filed after August 31, 2000, when the parties will have been separated for the two year period. The parties were married on June 3, 1989, and are the natural parents of two minor children, Blain 5., born February 6, 1992, and Mia Ann, born July 26, 1994. The complaint also raised the economic claim of equitable distribution. No other claims have been filed in the action. Wife is 38 years of age and resides at 8 Amity Lane, Mechanicsburg, Pennsylvania. She shares the residence with the children and her husband, who is also living in the house, although the parties are living separate lives. Wife is a high school graduate and is a computer specialist with the Naval facility in Mechanicsburg. Her annual gross income is around $35,000,00. She has not raised any health issues. Husband is 38 years of age and resides at 8 Amity Lane, Mechanicsburg, Pennsylvania, with the wife and the children, although he is living in a separated status. He is a high school graduate and works as a computer operator for Book-of-the-Month, His annual gross income is around $35,000.00. He has not raised any health issues, although counsel for wife has indicated that one of the problems in this marital relationship has been husband's addictive personality related to his abuse of alcohol. The home where the parties are living is owned by wife and her parents. Wife has a one half interest in the property and her parents have a one half interest, Attorney Sumple-Sullivan has a market analysis showing a value of between $113,000.00 and $121,500,00. An appraisal was done of the property on February 10, 1989, showing a value of $75,000,00. The Master is going to have attorney Sumple-Su1livan address how she intends to approach, from an evidentiary point of view, the marital interest in this property. The parties have three vehicles, a 1982 Econoline Van, a 1986 Lincoln, and a 1986 Toyota truck, Counsel are going to determine whether we need to consider any values for these vehicles in the equitable distribution computation, Counsel have indicated that no values for household tangible personal property will be used in the equitable distribution computation, Wife is a participant in the FERS Retirement System and counsel for wife has indicated that the distribution of that pension should be by a Qualified Domestic Relations Order. Wife also has a thrift savings plan with a value of around $11,000.00. Husband has a 401(k) plan and counsel does not yet have a value for that plan and, if necessary, will have to file a petition with the Court demanding discovery to determine the amount of that plan. To date husband has not been forthcoming in providing that information. Counsel also need to determine whether there is any cash value in life insurance policies owned by the parties. There are certain marital. debts which wife is claiming credit for payment of including real estate taxes and mortgage payments. Apparently husband has been living in the residence at 8 Amity Lane, Mechanicsburg, Pennsylvania, since the parties separated, August 31, 1998, and to date has only made two of the mortgage payments. The property is mortgaged with Harris Savings Bank and had a lien with Member's 1st Credit Union, The mortgage with Harris Savings Bank is around $54,000.00. The Member's 1st line of credit, which constituted a lien against the real .~ . estate, was paid off two months after the separation. Wife has been making the payments on the mortgage except for the two payments which husband has made as previously noted. Attorney Sumple-Sullivan is going to do an analysis to show what credits she believes her client should be entitled to based on the payment of marital obligations, Attorney Sumple-SUllivan is also going to place on the record how she intends to approach, from an evidentiary point of view, the marital interest in the real estate, MS. SUMPLE-SULLIVAN: In regards to the marital home, it is our intention to put on the valuation of what the current value of the property is to set a baseline figure, We would then go back and determine what the value of the property was at the time the one half undivided interest was gifted by Richard D. Banks and Barbara D. Banks to their daughter, the Plaintiff in this case. We would then look at the debt that has been put on this property for construction of the home and how that debt has been paid, and we believe that husband would be entitled to the increase in value on the one half of the net increase value of the real estate from date of the marriage to the date of separation, which was August 31, 1998, THE MASTER: Counsel, as noted, included a count for indignities. Because of the process in the Divorce Master's office, we will not schedule a hearing on indignities inasmuch as the time will have passed wherein the parties will have been separated for two years in September 2000, The complaint was filed in April of 1999. The Master was not appointed until August 30, 1999, The Master sent a certification document to counsel and husband which was ultimately returned, The Master then scheduled pretrial statements to be filed by November 5, 1999. In December the pre-hearing was scheduled for March 13, 2000, and then that conference was continued at the request of counsel to April 6, 2000. Inasmuch as the two year separation will have passed by the time this case gets scheduled for trial, the Master has indicated that counsel for wife should file a (d) affidavit averring the two year separation and we will move forward with a hearing in September. Dunlap (w/enc,) " " t, I. consideration, receipt of which is hereby acknowledged by each of the parties hereto, HUSBAND and WIFE, each intending to be legally bound hereby, covenant and agree as follows: 1. ADVICE OF COIJNSEL HUSBAND and WIFE declare that they have each had a full and fair opportunity to obtain independent legal advice of counsel of their selection. WIFE has been independently represented by Barbara Sumple-Sullivan, Esquire. HUSBAND is cognizant of his right to legal representation and declares that he has chosen not to retain an attorney notwithstanding the fact that attorney for WIFE has told him that he has an absolute right to be represented by an attorney. HUSBAND has chosen instead to negotiate directly with counsel and/or with his WIFE. HUSBAND hereby acknowledges that he has done so willingly and the he fully understands the facts and has been fully infonned and understands that, had a Court decided this matter, he may have received more or less than is provided for in this Agreement. HUSBAND knOwingly waives his rights, if any, to utilize the lack of his legal representation as a basis to attack the validity of this Agreement. Both parties further acknowledge and agree that each has fully disclosed their respective financial situations to the other, including their assets, liabilities and income. Each of the parties acknowledge and agree that, after having received such infonnation and with such knowledge, 2 " this Agreement is fair, reasonable and equitable and that it is being entered into freely, voluntarily and in good faith and that the execution of this Agreement is not the result of any duress, undue influence, coercion, collusion and/or improper or illegal Agreement. 2, PERSONAL RIGHTS HUSBAND and WIFE may and shall, at nil times hereaf!er,live separate and apart. Each shall be free from all control, restraint, interference or authority, direct or indirect, by the other in all respects as if she or he were unmarried, except as may be necessary to carry out the provisions of this Agreement. Each may reside at such place or places as she or he may select. Each rnay, for his or her separate use or benefit, conduct, carry on and engage in any business, occupation, profession or employment which to him or her may seem advisable. This provision shall not be taken, however, to be an admission on the part of either HUSBAND or WIFE of the lawfulness of the causes which led to, or resulted in, the continuation of their living apart. HUSBAND and WIFE shall not molest, harass, or malign the other or the respective families of each other, nor compel the other to cohabit or dwell in any rnanncr ....ith him or her, nor in any way interfere with the peaceful existence, separate from each other. 3. DEBTS Each party represents that they'have not contracted any debt or liability for the other for which the estate of the other party may be responsible or liable except as otherwise provided herein, and that except only for the rights arising out of this Agreement, neither party ....ill 3 hereafter incur any liability whatsoever for which the other party or the estate of the other party will be liable. Each party agrees to indemnifY and hold harmless from and against all future obligations of every kind incurred by thcm, including thosc for necessities, Additionally, HUSBAND shall be solely liable and responsible for the Sears credit card and PP&L liabilities which are in his name alone, HUSBAND agrees to indemnitY and hold WIFE harmless from each of the aforementioned debts. HUSBAND further agrees to,be responsible for all attorneys' fees incurred by WIFE in defcnse of any claim or suit brought against hcr arising from any debt incurred during the marriage. HUSBAND further agrees to pay one-half (1/2) of WIFE's attorney fees, costs and expenses associated with this divorce action, HUSBAND shall pay said fees within sixty (60) days of presentation of demand by WIFE, The parties acknowledge that since separation WIFE has paid all debts associated with the marital residence. This includes but is not limited to all utilities, improvements, all taxes (including the taxes that were delinquent as of the parties' separation for the years 1997, 1998, and 1999 and the current taxes) and any other expenses associated with the marital residence, Said payments made by WIFE on the delinquent taxes were in excess of $3,500,00. Presently, all taxes associated with the martial residence are current. 4 . To the best of the parties' knowledge, the parties affirm no joint debts exist except the for the first mongage associated with the marital residence which are addressed in Paragraph 6 of this Agreement. 4, WAIVER OF APPRAISAL AND INVENTORY The parties acknowledge and agree that they have each had an opportunity to value or have appraised any and all marital property, and they do hereby waive a formal appraisal and inventory of same, and no statement or representation by either party as to value shall be deemed a misstatement or misrepresentation to the other or be deemed fraudulent, 5. MARITAL AND NON.MARITAL ASSETS HUSBAND and WIFE do hereby acknowledge that they have heretofore divided the non- marital assets and marital assets including but without limitation, jewelry, clothes, furniture, and other assets wherever situated whether real, personal or mixed, tangible or intangible. HUSBAND agrees that with the exception of a stereo, a grandfather's clock, dishes, and certain pieces offumiture that his family gave to him, all assets in the possession of WIFE shall be the sole and separate property of WIFE. HUSBAND agrees that he shall remove from the marital residence the stereo, grandfather's clock, dishes and furniture given to him by his family within sixty (60) days of the execution of this Agreement. If HUSBAND does not remove these items within this specified time, it is agreed that he shall relinquish any interest, right or entitlement he may have in same and WIFE shall be free to dispose of these items as she sees fit. 5 WIFE agrees that all assets in the possession of HUSBAND shall be the sole arid separate property of HUSBAND, Each orthe ponies do hereby specifically waive, release, renounce and forever abandon whatever claims, if any, he or she may have with respect to any of the above said items which are the sole and separate propeny of the other, This document shall constitute 3 bill of sale for said sole property. 6, REAL ESTATE The parties built a home on a tract ofland that WIFE had received as a gift from her parents, Richard and Barbara Banks, Said property is held jointly by WIFE and her parents. This property is subject to a mongage with Harris Savings with an approximate balance of FIFTY- THREE THOUSAND FIVE HUNDRED DOLLARS ($53,500,00), HUSBAND is jointly obligated on this debts with WIFE and her parents, It is acknowledged that WIFE has been paying these obligations since the parties' separation as well as all taxes associated with this property, HUSBAND agrees to convey any interest, right or title he may have in this real estate to WIFE. HUSBAND agrees to execute a deed simultaneously with the execution of this Agreement wherein he quitclaims, assigns, conveys and transfers to WIFE all of his interest, right and title in the marital residence. WIFE agrees to assume responsibility for the payment of the unpaid balance of the rnongage, together with any interest, penalties and costs as well as any 6 other taxes and insurance and associated with the real estate. WIFE hereby agrees to indemnify and hold HUSBAND harmless from any and all liability as a result ofnon-pnyment of the mongnge or any other debts associated with the real estate, All rights, title and interest of HUSBAND, or any payments made by him shall be credited to WIFE in the event WIFE must file litigation to clear Richard and Barbara Banks' ownership interest from the propeny, 7, MOTOR VEHICLES WIFE shall have sole title and ownership of her 1986 Toyota 4x4 Truck which was sold for $1,00 as scrap after separation as inoperable. WIFE shall also have sole title and ownership of the parties 1982 Ford Econoline Van. The title for this vehicle is lost. HUSBAND agrees to sign any and all documents necessary to obtain a new title and to transfer his interest in this vehicle to WIFE. Neither of these vehicles are encumbered. HUSBAND shall have sole title and ownership of the parties' Lincoln Town Car which is presently at Shover's salvage due to an accident HUSBAND had shonly before his relocation. This vehicle is not encumbered. WIFE agrees to sign any and all documents necessary to transfer her interest in this vehicle to HUSBAND, HUSBAND shall be solely responsible for any and all costs, including storage and towing, etc. associated with this vehicle as well as indemnify and hold WIFE harmless from any and all costs arising out of the accident, towing, or storage of the vehicle. 7 . _.~-_._.... . -. II. AFTER ACOIlIREO PERSONAl. PROPERTYIFIJTURE EARNINGS Each of the parties shall hereafter o\\n and enjoy independently of any claim or right of the other, 1111 items of personal propeny, tangible or intangible, hereafter acquired by HUSBAND or WIFE, with full power in him or her to dispose of the same as fully and effectively, in all respects and for all purposes, as though he or she were unmarried, 12. ALIMONY. SUPPORT AND MAINTENANCE Both parties acknowledge and agree that the provisions of this Agreement providing for equitable distribution of marital property are fair, adequate and satisfactory to them and are accepted by them in lieu of and in full and final satisfaction of any claims or demands that either may now or hereafter have against the other for suppon, maintenance or alimony. HUSBAND and WIFE funher, voluntarily and intelligently, waive and relinquish any right to seek from the other any payment for spousal suppon, alimony and maintenance, 13. CUSTODY AND VISITATION Legal and primary custody of the children shall be in WIFE. HUSBAND shall have flexible rights of visitation, as the parties can agree, 14. SUBSEOUENT DIVORCE A decree in divorce, entered by a court of competent jurisdiction to either party, shall not suspend, supersede or affect the terms of this Agreement. Both parties agree to enter a Consent 9 Decree concerning the provisions or this Agreement in the Court of Common Pleas of Cumberland County, PeMsylvnnia, or any other Coun of competent jurisdiction, as a part ora resolution of any divorce action filed, This Agreement, and the terms and conditions contained herein, as well as the enforcement of said terms and conditions, shall not be contingent upon the granting of a Divorce Decree to either party by the Court of Common Pleas of Cumberland County, Pennsylvania, or any other Court of competent jurisdiction, Furthermore, simultaneously with this agreement, both parties hereto agree to execute the appropria1e affidavits and consents to secure a No-Fault Divorce as may be required by the Divorce Code of 1980, as amended. Both parties hereto agree that this Agreement may be incorporated for purposes of enforcement into a separate Court Order but shall not merge in such order in the Court of Common Pleas of Cumberland County, PeMsylvania, 15, OTHER DOCUMF.NT A nON HUSBAND and WIFE covenant and agree that upon request of the other party, they will fonhwith execute and deliver to the other party, any and all written instruments, assignments, releases, satisfactions, deeds, notes or such other writings as may be necessary or desirable for the proper effectuation of this Agreement. 16. MUTUAL W AIVER AND RELEASE OF RIGHTS AND CLAIMS IN ESTATE Each party hereby releases, waives and relinquishes any and all rights which he or she 10 may now have, or may hereafter have, against the other party under the present or future laws of any jurisdiction (a) to share in the estate of the other party upon the other party's death and (b) to act as executor/rix or administrDtor/rix of the other party's estate, 17. MUTUAL RELEASE HUSBAND and WIFE each do hereby mutually remise, release, quitclaim and forever discharge the other and the estate of such other, for all time to come, and for all purposes whatsoever, of and from any and all rights, title and interests, or claims in or against the property (including income and gain from property hereafter accruing) of the other or against the estate of such other, of whatever nature and wheresoever situate, which she or he now has or at any time hereafter may have against such other, the estate of such other or any part thereof, whether arising out of any former acts, contracts, engagements or liabilities of such other or by way of equitable distribution, dower or curtesy, or claims in the nature of dower or curtesy of widow's or widower's rights, family exemption or similar allowance, or under the intestate laws, or the right to take against the spouse's will, or the right to treat a lifetime conveyance by the other as testamentary, or all other rights ofa surviving spouse to participate in a'deceased spouse's estate, whether arising under the laws of (a) Pennsylvania, (b) any State, commonwealth or territory of the United States, or (c) any other country, or and rights which HUSBAND or WIFE may have or at any time hereafter have for the past,'present or future suppon or maintenance, alimony, alimony pendente lite, counsel fees, costs or expenses, whether arising as a result of the marital relation or otherwise, except, and only except, all rights and Agreements and obligations of 11 whatsoever nature arising or which may arisc under this Agrcement or for the breach or any thereof, Each of the ponies hereto further covenants and agrees for himself and herself and his or her heirs, executors, administrators and assigns, that he or she will never, at any time hereafter, sue the other party or his or her heirs, executors, administmtors and assigns, for the purpose of enforcing any of the rights relinquished under this paragmph, Each of the parties funher covenants and agrees that he or she will permit any will of the other to be probated and allow administration upon his or her personal, real or mixed estate and allow effects to be taken out by the person or persons who would have been entitled to do so had HUSBAND or WIFE died during the lifetime of the other. Each of the panies hereby releases, relinquishes and waives any and all right to act as executor or executrix or administrator or administratrix of the other's estate, It is the intention of HUSBAND and WIFE to give to each other by the execution of this Marital Settlement Agreement a full, complete and general release with respect to any and all property of any kind or nature, real, personal or mixed, which the other now owns or may hereafter acquire, except and only except all rights and Agreements and obligations of whatsoever nature arising or which may arise under this Agreement or for the breach of any thereof. 18. SUCCESSOR'S RIGHTS AND LIABILITIES This Agreement shall, except as otherwise provided herein, be binding upon and inure to 12 '. the benefit of the parties hereto, their respective heirs, executors, administrators, successors or assigns. 19. SEVERABIUTY If any provision in this Agreement is held by a coun of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless continue in full force and effect without being impaired or invalidated in any way. 20. ENTIRE AGREEMENT HUSBAND and WIFE do hereby covenant and warrant that this Agreement contains all of the representations, promises and Agreements made by either of them to the other for the purposes set forth in the preamble hereinabove; that there are no claims, promises or representations not herein contained, either oral or written, which shall or may be charged or enforced or enforceable unless reduced to writing and signed by both of the parties hereto, 21. BINDING EFFECT OF AGREEMENTIW AIVER This Agreement shall remain in full force and effect unless and until terminated under and pursuant to the terms of this Agreement. The failure of either party to insist upon strict performance of the provisions of this Agreement shall not be construed as a waiver of any subsequent default of the same or similar nature, nor shall such failure be construed as a waiver of any other tenn, condition, clause or provision of this Agreement. 13 I. ., 22, BREACH If either party breaches any provision of this Agreement, the other party shall have the right, at his or her election, to suc ror damages for such breach or seek such other remedies or relief as may be available to him or her, and the party breaching this contract shall be responsible for payment of reasonable legal fees and costs incurred by the other in enforcing their rights under this Agreement. 23. CONTROLLING LAW This Agreement shall be construed and govemed in accordance with the laws of the Commonwealth of Pennsylvania. 24.
