STIPULATION AGAINST LIENS
THIS AGREEMENT made this l day of

hereinafter referred to as Contractor,

AND
ROGER D. LEKBERG AND DEBORAH J. LEKBURG, husband and wife,
hereinafter referred to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Hampden Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as Lot #24 Sand Pine, Pinehurst, Phase v, Mechanicsburg,
Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
tinder them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in Hampden Township,
Cumberland County, Pennsylvania, being Lot NO. 24 as shown on the
Plan entitled Pinehurst Final Subdivision Plan Phase V, dated
January 19, 1998, and recorded in Cumberland County Plan Book 76,
Page 112, more particularly bounded and described as follows:
BEGINNING at an iron pin, being an easterly corner of Lot No. 23
and lying in a southerly right of way line of Red Spruce Lane (50-
foot right of way); thence along said right of way line, along a
curve to the left, having a chord bearing of North 56 degrees 32
minutes 50 seconds East, a chord distance of 17.09 feet, a radius
of 225.00 feet, and an arc length of 17.10 feet to an iron pin,
lying in said right of way line and being a westerly corner of the
Sand pine Court (50-foot right of way); thence along said right of
way line, along a curve to the right, having a chord bearing of
South 86 degrees 23 minutes 54 seconds East, a chord distance of
31.62 feet, a radius of 25.00 feet, and an arc length of 34.24 feet
to an iron pin, lying in a southerly line of said right of way;
thence along said right of way line, South 47 degrees 10 minutes 00
seconds East, 23.47 feet to an iron pin; thence continuing along
said right of way line, along a curve to the left, having a chord
bearing of South 52 degrees 26 minutes 25 seconds East, a chord
distance of 96.51 feet, a radius of 525.00 feet, and an arc length
of 96.65 feet to an iron pin; thence continuing along said right of
way line, South 57 degrees 42 minutes 51 seconds East, 8.70 feet to
an iron pin, lying in said right of way line and being a northerly
corner of Lot No. 25; thence along Lot No. 25, South 14 degrees 02
minutes 09 seconds West, 464.90 feet to an iron pin, being a
westerly corner of said lot and lying in a northerly lot of lands
now or formerly of Susquehanna Enterprises, Inc; thence along said
lands, North 77 degrees 11 minutes 41 seconds West, 160.00 feet to
an iron pin, lying in a northerly line of said lands and being a
southerly corner of Lot No. 23; thence along Lot No. 23, North 14
degrees 02 minutes 09 seconds East, 502.56 feet to an iron pin,
being the place of BEGINNING.
BEING the same premises which pamay Development Co., Inc. a
Pennsylvania Corporation, granted and conveyed to Roger D. Lekberg
and Deborah J. Lekberg, husband and wife.
