PRELIMINARY OBJECTION IN TIlE NATURE OF
A MOTION TO DISMISS FOR LACK OF VENUE
AND NOW. this 17'" day of May, 1999, comes the Defendant, Cathy M, Broughton.
and preliminarily objects as follows, pursuant to Pa. R.C.P. ~lOO6, ~1028 (a)(1), and
~1920.2:
I. This Court is not the proper venue for this matter because neither Plaintiff nor
Defendant resides in Cumberland County, Pennsylvania.
2. Altematively. if this Court detennines that Plaintiff s temporary living
arrangements are sufficient to establish venue in Cumberland County, then. pursuant to Pa.
R.C.P. ~1920.2 (c). Defendant respectfully requests that this action be stayed so that the
action Defendant brought in Adams County, Pennsylvania, can proceed.
3, Adams County, Pennsylvania, is the county "in which the last family domicile was
located and in which one of the parties continues to reside," therefore. the Court of the county
of the last family domicile "shall detennine, based upon the purposes of the Divorce Code,
which of the two actions shall be stayed and which shall proceed," pursuant to Pa. R.C.P.
