COMPLAINT
AND NOW, comes the Plaintiff, Edna L, Guido, by and through
her attorneys, Addams & Rundle, and files the following
Complaint:
1, The plaintiff is Edna L, Guido, an adult individual
residing at 23 Peebles Road, Newburg, Cumberland County,
Pennsylvania.
2. The defendant is John Shirk, an adult individual
residing at R,R, #1, Box 598, Martinsburg, Pennsylvania 16662,
3. On December 8, 1998, the plaintiff was the owner of a
1989 Ford Bronco, which at about 5:30 p,m. was being operated by
Matthew N. Guido, the plaintiff's son, in Blue Mountain Plaza, a
rest area of the Pennsylvania Turnpike in Hopewell Township,
Cumberland County, Pennsylvania.
4, At said time and place the defendant was operating a
1996 Dodge van.
5, At said time and place Matthew N. Guido was proceeding
West toward the Plaza exit to depart the rest area when his
vehicle was struck from the left rear by the vehicle negligently
operated by the Defendant, who was also approaching the Plaza
exit.
6. The defendant was negligent and careless in:
A, Failing to observe the plaintiff's vehicle;
B, Failing to have his vehicle under control;
C, Operating his vehicle too fast for conditions; and
D. Failing to yield the right of way,
7. As a result of the negligence and carelessness of the
defendant, the plaintiff's vehicle was damaged and required
repairs in the amount of $2,290,48 as more fully set forth on the
estimate of repairs attached hereto as Exhibit "A" and
incorporated herein,
8, The defendant has refused and continues to refuse to pay
the costs of repairs.
WHEREFORE, the plaintiff demands judgment against the
defendant in the amount of $2,290.48 plus interest and costs of
suit, an amount within the jurisdiction of arbitration under the
local rules of court.
