IN THE COURT OF COMMON PLEAS
CUMBERLAND COUNTY, PENNSYLVANIA
STIPULATION AGAINST LIENS
WHEREAS, Eric L. Zimmerman and Kathleen M. Zimmerman, of Eklins Park,
Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael L. Martin,
Inc., a Pennsylvania Corporation of York County, Pennsylvania, for the erection of a dwelling upon
a lot of land situate as follows:
ALL THAT CERTAIN piece or parcel of land, situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, bounded and described in accordance with
Final Subdivision Plan prepared by Hartman & Associates, a copy of which in recorded in the
Recorder of Deeds Office in and for Cumberland County, Pennsylvania in Plan Book 84, Page 80,
bounded and described as follows, to wit:
BEGINNING at a point on the western right-of-way line of Cherokee Drive at the
common front property corner of Lot No. 2 and Lot No. 3 as shown on the above referenced plan of
lots; thence along said right-of-way line of Cherokee Drive South 34 degrees 16 minutes 45 seconds
East, a distance of 79.95 feet to a point; thence continuing by a curve having a radius of 500.00 feet
and an arc length of 28.61 feet to a point at the dividing line between Lot No. 3 and Lot No. 4; thence
along said dividing line South 58 degrees 59 minutes 58 seconds West, a distance of 149.43 feet to
a point; thence North 34 degrees 16 minutes 45 seconds West, a distance of 100.00 feet to a point
at the dividing line between Lot No. 2 and Lot No, 3; thence along said dividing line North 55
degrees 43 minutes 15 seconds East, a distance of 150.00 feet to a point, said point being the Place
of BEGINNING.
BEING Lot No. 3 on the Final Subdivision Plan of Michael A. Ryan and Joyce M.
Ryan, said plan recorded December 27, 2001 in Plan Book 84, Page 80.
CONTAINING 15,636.642 square feet or 0.3590 acres.
NOW, the / ~0.,_ day of June, 2003, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Eric L.
Zimmerman and Kathleen M. Zimmerman, to the said Michael L. Martin, Inc., a Pennsylvania
Corporation to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with Michael L. Martin, Inc., a Pennsylvania
Corporation and the further consideration of One Dollar, to Michael L. Martin, Inc., a Pennsylvania
Corporation paid by Eric L. Zimmerman and Kathleen M. Zimmerman, it is agreed that no lien shall
be filed against the building by the contractor, or any sub-contractor, nor by any of the material men
or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
