AND NOW, comes Plaintiff, PNC Bank, National Association,
Successor by Merger to The First Bank & Trust Company of
Mechanicsburg, by its attorneys, Saidis, Shuff and Masland, and
files this Complaint, alleging in support thereof the following:
1. Plaintiff, PNC Bank, National Association, Successor by
Merger to The First Bank & Trust Company of Mechanicsburg ("Bank ") ,
is a national banking association organized and existing under the
banking laws of the United States of America with a principal
regional office located at 4242 Carlisle Pike, Camp Hill,
Cumberland County, Pennsylvania 17011,
2. The Defendant, Allenview, Inc., is a Pennsylvania business
corporation with a principal office located at 5001 Carlisle Pike,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On or about June 30/ 1989, Defendant borrowed from and
agreed to repay to Bank the sum of One Million Nine Hundred Eighty
Thousand and 00/100 Dollars ($1,980,000.00) ("Loan"). As security
for the Loan, Defendant executed and delivered to Bank a mortgage
("Mortgage") on, inter alia, that tract of land together with the
buildings and improvements erected thereon located in Silver Spring
Township, Cumberland County, Pennsylvania, containing 52.13 acres

of land pursuant to the survey made by Whittock and Hartman (Robert
G. Hartman, Jr., P.E" R,S.l dated November 24/ 1986 (the
"Property"). A description of the Property is attached hereto,
made a part hereof and marked Exhibit "A". All of the Property has
been released from the lien of the Mortgage except for two tracts
known and numbered as Lots 50 ("Lot 50") and 51 ("Lot 51") as set
forth on the Final Major Subdivision Plan for Konhaus Estates
(Section II, Phase 3) recorded in the Cumberland County Recorder of
Deeds Office at Plan Book 68, Page 39-C, and as more particularly
set forth and described on Exhibit "B" attached hereto and made
part hereof. Lot 51 and Lot 52 are referred to herein collectively
as the "Mortgaged Property". At all times relevant hereto,
Defendant was and remains the record :md sole owner of the
Mortgaged Property. A copy of the Note ("Note"), evidencing the
Loan is attached hereto, made a part hereof and marked Exhibit "C".
4. On June 30, 1989, the Mortgage was recorded in the Office
of the Recorder of Deeds of Cumberland County in Mortgage Book 944,
Page 420. A copy of the Mortgage is attached hereto, made a part
hereof and marked Exhibit "D".
5. The Mortgage was never assigned by Bank and is still held
by it as a valid and subsisting obligation of Defendant.
6. Under the terms and conditions of the Note, Defendant
agreed to pay to Bank monthly interest payments on the 30th day of
each calendar month on all sums advanced under the Note with the
outstanding principal to be due and payable on September 30/ 1993,
7, Defendant has breached the terms and conditions of the
Mortgage and Note and is in default under such te~ms and conditions

because Defendant haD failed to make the payments required in
accordance with the terms thereof, and Plaintiff has demanded
payment in full of all outstanding principal and interest as
provided in the Note. A copy of Plaintiff/s demand is attached
hereto liS Exhibit "E" and made part hereof,
8. Defendant is presently indebted to Bank, as of April 12,
1999/ in the amount of One Hundred Thirty-Eight Thousand Eight
Hundred Twenty-Five and 93/100 Dollars ($138/825.93) itemized as
follows:

9. Defendant also agreed under the terms of the Mortgage that
in the event of default thereunder Defendant would pay, in addition
to the charges listed in paragraph 8 above, costs incurred by Bank
as a result of the institution of these legal proceedings.
10. The obligation owed by Defendant to Bank continues to
accrue interest thereon at the rate of Thirty and la/lOa Dollars
($30.10) per day, through the date of payment, including on and
after the entry of judgment on this Complaint, and continues to
accrue late charges, and attorneys' fees.
11. Plaintiff is not seeking foreclosure on the basis of a
"residential mortgage" obligation, as that term is defined in Act
No, 6 of 1974/ 41 P.S. ~101 et seq" and plaintiff is therefore not
required to give the notice required by Section 403(a) of said Act.

12. As set forth above, Bank has mac~ demand upon Defendant
to make payment in full of all amounts due to Plaintiff under the
aforesaid Mortgage and Note. However, Defendant has refused and
failed and continues to refuse and fail to make payment to
Plaintiff.
WHBREFORE, Plaintiff,
PNC Bank, National ABlJociation,
Successor by Merger to The First Bank & Trust Company of
Mechanicsburg, demands judgment against Allenview, Inc., Defendant,
in the amount of One Hundred Thirty-Eight Thousand Eight Hundred
Twenty-Five and 93/100 Dollars ($138/825.93), plus interest at the
rate of Thirty and 10/100 Dollars ($30.10) per day, through the
date of payment, including on and after the date of entry of
judgment on this Complaint, and costs, and for foreclosure and sale
of the mortgaged property.

mailed. The Bank or Note holder may exercise this option to
accelerate during any default by Borrower regardless of any prior
forbearance. If suit is brought to collect this Note, the Bank
or Note holder shall be entitled to collect all reasonable costs
and expenses of suit, inClUding, but not limited to, reasonable
attorney's fees.
Borrower shall pay to Bank or the Note holder a late charge
of Five percent (5%) of any monthly installment not received by
the Bank or the Note holder within Fifteen (15) days after the
installment is due.
Borrower may prepay the principal amount outstanding in
whole or in part. Any partial prepayment shall be applied first
against interest accrued and the balance against the principal

amount outstanding and shall not postpone the due date of any
subsequent monthlY installments or change the amount of such
installments unless the Dank or Note holder shall otherwise agree
in writing.
Presentment, notice of dishonor, and protest are hereby
waived by all makers, sureties, guarantors and endorsers hereof.
This Note shall be binding upon Borrower and its successors and
assigns.
Any notice to Borrower provided for in this Note shall be
given by mailing such notice by certified mail addressed to
Borrower at the Address stated below, or to such other address as
Borrower may designate by notice to Bank or the Note holder. Any
notice to Bank or the Note holder shall be given by r.. \iling such
notice by certified mail, return receipt requested, to Bank or
the Note holder at the address stated in the first paragraph of
this Note or at such other address as may have been designated by
notice to BorrOWer.
The principal sum hereunder shall be advanced to Borrower
only in accordance with the terms of the Construction Loan
Agreement mentioned above, all of the terms, conditions and
provisions of which Construction Loan Agreement are incorporated
herein by reference thereto.
The indebtedness evidenced by this Note is secured by a
Mortgage, dated June 30, 1989, and reference is made to the
Mortgage for rights as to acceleration of the indebtedness
