set forth in the following pages. you must take action within twenty (20) days after this
complaint and notice are served, by entering a written appearance personally or by
attorney and filing in writing with the court your defenses or objections to the claims set
forth against you. You are warned that if you fail to do so the case may proceed
without you and a judgment may be entered against you by the court without further
notice for any rnoney claimed in the cornplaint or for any other claim or relief requested

4, Defendant. Cumberland Valley School District Board of School Directors
is comprised of the following members: Audrey A. Hanna, President; Maryellen M,
Mclane, Vice President; David R. Gelz, Assistant Secretary; Karen Christie. Member;
Earnest Garvin. Member; Stephen Grose, Member; Christopher P. Markley, Member;
Bud R. Shaffner, Member; and Kenneth L, Shur, Member.
5. Dr. Anthony J. Colistra is the superintendent of the Cumberland Valley
School District.
6. Harold O. Bricker is the Director of Secondary Education of the
Cumberland Valley School District.
7. Timothy L. Ritter is the principal of the Good Hope Middle School of the
Cumberland Valley School District.
8. The Good Hope Middle School of the Cumberland ValIev School District
is located at 451 Skyport Road. Mechanicsburg, Pennsylvania 17055.
9. Plaintiffs reside within the geographical boundary of the Cumberland
Valley School District.
10. Plaintiff Amy Young, age 13, is a seventh grade student enrolIed at the
Good Hope Middle School of the Cumberland Valley School District.
11. Kelly Stepalovitch, age unknown, is a seventh grade student enrolIed at
the Good Hope Middle School of the Cumberland ValIey School District.

12. During school hours and whilc under the exclusive supervision of the
Cumberland Valley School District on Dcccmber 15. 1998, Kclly Stcpalovitch threatencd
to stab Plaintiff Amy Young in the stomach and kill her.
13. This threat occurred while the students were on school property at the
Good Hope Middle School of the Cumberland Valley School District during normal
hours of operation.
14. This threat was observed by several of Plaintiff Amy Young's classmates.
15. Plaintiff Amy Young's classmates perceived the threat to be real and
considered Kelly Stepalovitch capable of carrying out the threat.
16. Plaintiff Amy Young had done nothing that day or in the past to have
provoked the physical assault and death threat from Kelly Stepalovitch.
17. This threat is a culmination of a long history of emotional and verbal
abuse and physical aggression perpetrated against Plaintiff Amy Young by Kelly
Stepalovitch during school hours or pre-and post-school travel.
18. The Cumberland Valley School District through its teachers,
administration and agents had notice of the pattern of emotional and verbal abuse, and
physical aggression perpetrated against Plaintiff Amy Young by Kelly Stepalovitch.
19. The December 15. 1998, threat was irnmediately brought to the attention
of the Cumberland Valley School District and Principal Ritter and to Plaintiffs James C.
and Susan M. Young.

20. No immediate action was taken by the Cumberland Valley School District
or Principal Ritter to guarantee a safe school environmcnt for Plaintiff Amy Young
which was shared with Plaintiffs.
21. On Tucsday, Dccember 15, Plaintiff Young filed a criminal report of this
matter .....ith the Hampden Township Police.
22. Upon information and belief, that evening Kelly Stepalovitch admitted her
actions to Corporal Lunquest of the Hampden Township Police and because of the
young age of Stepalovitch this matter was referred by the police to Defendant
Cumberland Valley School District for investigation and further action.
23. Cumberland Valley School District, Principal Ritter and Director Bricker
had knowledge that Plaintiff Amy Young is under an 1ndividual Education Plan ("lEP")
due to her attention deficit disorder (" ADD").
24. As a result of having ADD, Plaintiff Amy Young is particularly
susceptible to the emotional stress caused by the hostile school environment created
and/ or condoned by the Defendant Cumberland Valley School District.
25. Kelly Stepalovitch was suspended from school by the Cumberland Valley
School District for making the threat on Amy Young's life pursuant to the Cumberland
Valley School District's Code of Student Conduct. (See Exhibit" A.")
26. Cumberland Valley School District through Principal Ritter, Director
Bricker and Superintendent Colistra took no immediate action to dissipate the hostile

school environment which was created by Stepalovilch's acts other than as stated in the
above paragraph.
27, Cumberland Valley School District through Principal Ritter, Director
Bricker and Superintendent Colistra allowed Plaintiff Amy Young and Kelly
Stepalovilch to continue to attend the same class schedule in which they share most if
not all classes.
28. Kelly Stepalovitch's serious threat and continuing course of emotional and
verbal abuse and physical aggression perpetrated against Amy Young caused Arny
Young substantial and severe psychological, emotional, and physical harm during this
period.
29. While under the supervision of the Cumberland Valley School District on
January 6,1999, Plaintiff Amy Young was given a copy of a note from another student
of the Good Hope Middle School of the Cumberland Valley School District during a bus
ride home from school. (See Exhibit "B:')
30. The student providing Plaintiff Amy Young with the copy of the note
identified the author of the note as Kelly Stepalovitch.
31. The note stated in pertinent part. "amy the lebzian [sic] is in school today
the dumb bitch let me ask the big question:'
32. A copy of the note was provided to the Cumberland Valley School District
through Principal Ritter and Director Bricker by Plaintiff Youngs.

33. Plaintiffs James c. Young and Susan M. Young demanded that the
administration take action to stop the continued harassment of their daughter and to
eliminate the hostile educational environment.
34, Kelly Stepalovitch was assigned to the mandatory "Saturday Work
Program" by the Curnberland Valley School District for publishing the note about Amy
Young pursuant to the Cumberland Valley School District's Code of Student Conduct.
(See Exhibit "A.")
35. Kelly Stepalovitch's publication of the note containing libelous allegations
about Amy Young coupled with the continuing course of emotional and verbal abuse,
and physical aggression perpetrated against Amy Young have caused Amy Young
substantial and severe psychological, emotional, and physical harm.
36. After the note's publication and other subsequent interactions between
Plaintiff Amy Young and Kelly Stepalovitch, Arny has been unable to attend public
school due to a continued fear of Kelly Stepalovitch and has been forced to receive
home schooling and tutoring.
37. The Defendants have the ability and duty to enforce the provisions of the
Public School Code of 1949 and regulations adopted thereunder.
38. The Defendants have failed to enforce the following reguiations arising
from the Public School Code of 1949:

40, Plaintiffs have a direct interest in the Defendants' enforcement of the
provisions of the Public School Code of 1949 and regulations adopted thereunder
bccause Plaintiff Amy Young is unable, absent propcr enforcement, to receive a public
education.
41. Because of the Defendants failure to enforce the provisions of the Public
School Code of 1949 and regulations adopted thereunder Plaintiff Amy Young has been
directly harmed by the continuing course of emotional and verbal abuse and physical
aggression perpetrated against her person.
42. There is no adequate remedy available to Plaintiffs at law that would
compensate Plaintiff Amy Young for her substantial and severe psychological,
emotional, and physical harm.
43. There is no adequate remedy available to Plaintiffs at law that would
enable Plaintiff Amy Young to obtain a public education, to which she has a statutory
right, free of the continuing course of emotional and verbal abuse and physical
aggression perpetrated against Amy Young.
WHEREFORE, Plaintiffs pray that a judgment of rnandamus be entered
commanding the Defendants forthwith to (1) properly enforce the provisions of the
Public School Code of 1949 and regulations adopted thereunder (2) provide a safe
school environment to Plaintiff Amy Young by relocating the student who has
perpetrated the continuing course of emotional and verbal abuse and physical

aggression against Amy Young to another school; and (3) develop a new student code
of conduct that will ensurc that similar situations as thosc dcscribcd hcrein bc handled
more aggressively.

Cumberland Valley School District provides
Internet access for a1lstudcnts to use for school
related activities. The Internet is a global
"network of networks," linking thousands of
computer networks together, It provides access
to vast amounts of information from
univmities, governments, businesses,
researchers, newspapers, etc. that can be used to
supplement and update other resources.
Students must sign the CVSD use policy prior
to using the Internet resources, Along with the
right to use the Internet as an educational
resources, students must accept the
'responSibility for all material received.
STlmF.NT ASSJSTANCF. PROGRAM
A Student Assistance Program is a way to
identify students who are having problems in
school because of drug or alcohol use (or other
high-risk behaviors) and refer them for help. It
is an intervention, not a treatment, program. The
heart of the program is the Student Assistance
team, a core group of school personnel who are
specially trained to work with these students.
Core team members receive referrals from
administration, faculty and staff, parents, and
students themselves, ReferraIs can be initiated
by drug and alcohol policy violations, but more
commonly, they happen because of observed
changes in behavior or performance-which
mayor may not be drug related. With parental

the validity of the debt or any portion thereof. If

Judgment, and other costs and charges collectible under the
mortgage and for the foreclosure and sale of the mortgaged
