This action was commenced by the filing of a divorce complaint on April 15, 1999, raising grounds for divorce of irretrievable breakdown of the marriage. Although an affidavit under Section 3301(d) has been filed and a counter-affidavit in response filed, counsel have indicated that the parties will sign and file affidavits of consent and waivers of notice of intention to request entry of divorce decree so that the divorce can be concluded under Section 3301(c) of the Domestic Relations Code. The affidavits and waivers should be presented to the Master for filing at the settlement conference to be scheduled or filed previOUSly by counsel. On June 11, 1999, an amended complaint was filed raising the economic claim of equitable distribution. There are no claims pending for alimony or counsel fees and costs. Wife is 35 years of age and resides at 10 Riddle Road, Camp Hill, Pennsylvania, with a male friend and one child of the marriage. The child residing with wife is ten years of age. wife is a high school graduate and works at AAA in Harrisburg and nets $1,287.00 per month. She has not raised any health issues. Husband is 41 years of age and resides at 231 South 4th Street, Columbia, Pennsylvania, 17512 where he resides with a female friend and three children of the marriage. The children in husband's custody are ages 17, 15, and 8, Husband is employed in the delicatessen and nets monthly $1,700.00. He has not raised any health issues. Husband receives child support for the three children in his care in the amount of $396,00 per month. Neither party is paying nor receiving spousal support or alimony pendente lite. The parties own real estate at 231 South 4th Street, Columbia, Pennsylvania, where husband is residing with a female friend and the three children. That property is going to be appraised by the parties and perhaps counsel will be able to agree on an appraiser and share the costs. However, either party reserves the right to have the property appraised by their own appraiser if they do not agree or are not satisfied with the appraisal that is accomplished by the mutually selected appraiser. We also need to have provided a current payoff on the mortgage. Mr. Grab has indicated that he believes the mortgage payment is around $600.00 per month. With respect to other assets, except for the Army National Guard Defense Benefit Plan, the assets have been distributed previously. with respect to the Army National Guard pension plan, counsel are going to determine what the coverture fraction would be and whether or not there is a survivor benefit option and how that option may be affected by an agreement if wife chooses to make a request for that option to be selected at the time of retirement. There was some discussion about whether or not the Common Sense Trust IRAs have been distributed. That information was provided by Mr. Grab, and Mr. McBeth should have verification that those funds, either after discussion with his client or through the records that are available, have in fact been distributed. We note by looking at the pretrial statements that the 401(k) with Giant Food was liquidated but there did not seem to be any indication on the pretrial statements that the IRAs have been liquidated. The parties are going to file income and expense statements to be available at the time of the settlement conference in addition to the information with regard to the Army National Guard pension plan and the appraisal on the house and the mortgage payoff. Heiserman, Jr., and his assistant, patricia Shinkosky. The appraisal shows a market value of $52,500.00. Mr. McBeth has challenged the accuracy of the appraisal based on his concern that the parties 12 years ago paid $52,200.00 for the property. Mr. McBeth believes that the property should have appreciated more than $300.00 in 12 years. Consequently, Mr. McBeth is going to arrange to have his own appraisal of the property and then we will be able to either reconvene or the parties will settle the case based on that information. The parties also provided the Master income statements and the income that the Master derived from those statements is as follows: Husband's net income every two weeks is $664.00; wife's net income every two weeks is $706.00. wife does pay child support every month totalling around $425.00 to husband for the three children in husband's custody. The attorneys have looked at the pension information and need to determine yet what the costs will be for the survivor benefits which wife has indicated she would like to have provided. In any event, the pension is not going to be valued to show a present value but the parties will use a deferred distribution method using a coverture formula to provide wife a benefit upon husband's retirement. Real Estate Single family, semi-detached dwelling situate at 231 South Fourth St., Columbia, Lancaster County, PA 17512. Fair Market Value estimated to be between $52,200 and $56,000 as of date of separation (7/10/93). The real estate was purchased in July, 1989 for $52,200. The fair market value of the real estate, as of the date of separation was fully encumbered by a mortgage lien with a balance of $51,190 as of 7/10/93 2. Automobiles None. A 1989 Plymouth Ar Voy was repossessed by the York Bank & Trust Co. following the date of separation with a balance due on the loan account of $8,226.14. 3. Retirement Plans (A) Army National Guard Defined Benefit Plan Total points toward retirement pay as of 1/24/93 were 1,799. The corresponding monthly retirement benefit is unknown. A copy of the 1993 statement from the Army National Guard is attached hereto. (B) Giant Food Stores 401K Savings Plan Value as of 12/31/94 was $17,903.07. A component of this value was post separation contributions and/or increase in value. The funds in this retirement savings account were liquidated and disbursed to Kenneth M. Minnich, less the mandatory withholding and penalty. The proceeds were used to pay significant marital debts and marital household debts, including but not limited to a significant mortgage arrearage which had accrued prior to the date of separation, and significant household utility costs which had accrued prior to the date of separation. (C) Common Sense Trust IRA for Kenneth M. Minnich Value as of 12/31/92 was $1,978.12. As with the Giant 401K Plan, this IRA was liquidated, less the mandatory withholding, disbursed to Kenneth M. On February 4, 2000 the undersigned mailed to counsel for Defendant Plaintiff's Interrogatories Directed to Defendant _ Second Set. Despite your specific instructions when we had our earlier conference, the first time ihat I had heard ofthe identity ofa chosen real estate appraiser, was June 19,2001. At that time, Mr. Grab's seeretary informed me of the appraiser that had been chosen, and said that the appraiser needed to appraise the house the next day, June 20, Mr. Grab was on vacation at that time, and I am certain his absence contributed to the set of circumstances. But, the bottom line is that my entreaties regarding the choice ofan appraiser went unanswered until June 19, we had no opportunity for evaluation and, now, having agreed to the appraiser on the premise that the report would be done in time for the July 3 conference, we now find this morning that the report is not going to be done. It does appear fruitless to have the conference on July 3 iflhe report is not going to be done. This action was commenced by the filing of a On June 11, 1999, an amended complaint was divorce complaint on April 15, 1999, raising grounds for divorce of irretrievable breakdown of the marriage. No economic claims were filed with the complaint. With respect to grounds for divorce, the parties have previously signed affidavits of consent and waivers of notice of intention to request entry of divorce decree which were filed with the Prothonotary within thirty days of the signing. Consequently the divorce can be concluded under Section 3301(c) of the Domestic Relations Code. filed raising the economic claim of equitable distribution. There are no claims filed in this action for alimony or counsel fees and costs. The Master has been advised that the parties have reached an agreement with respect to the outstanding economic issue of equitable distribution. An agreement is going to be placed on the record in the presence of the parties. The agreement as placed on the record will be considered the substantive agreement of the parties not subject to any changes or modifications except for correction of typographical errors which may be made during the transcription. The agreement will be transcribed, sent to counsel to make any correction of typographical errors, and the parties will be asked to affix their signatures affirming the terms of settlement as stated on the record. The second and final payment will be made within sixty (60) days from today's date. In order to enforce this portion of the parties' agreement, counsel for Loretta L. Minnich will prepare a confession of judgment note for Kenneth M. Minnich's signature that will reflect the terms as previously stated herein. Mr. Minnich shall provide his signature on the judgment note within five (5) days of presentation of the note and related documents to his counsel. Mr. Minnich shall also sign the documents related to the confession of judgment note. At this point, the parties contemplate that the documents related to the confession of judgment note are a statement of disclosure and waiver and an affidavit to the effect that Mr. Minnich earns more than $10,000.00 per year and fully understands the terms of note that he is signing. Upon execution, the judgment note will be returned to counsel for Loretta L. Minnich, who will in turn transmit it to the Master. The note will then become a material part of the agreement that is being articulated herein. 2. With respect to the marital home and the equity payments for same as described above, counsel for Kenneth M. Minnich shall prepare a deed that transfers ownership interest in the marital home from Kenneth M. Minnich and Loretta L, Minnich to Kenneth M. Minnich. Loretta L. Minnich shall execute that new deed in front of a notary public. Her counsel shall then hold that deed in escrow pending receipt of all monies due for payment of Loretta L. Minnich's share of equity in the marital home and in accordance with the provisions of the note attached to the agreement. Upon receipt of the deed, husband agrees to indemnify and hold wife harmless on account of any claims which may be made against wife as a result of any outstanding liens against the premise including any mortgage liens. Husband shall also hold wife harmless from and fully indemnify her for any lienable claim made on the real estate after today's agreement. 3. The parties also acknowledge that Kenneth M. Minnich is the recipient or owner of pension benefits from the United States military, more specifically, including the pennsylvania Army National Guard. The parties also acknowledge that those benefits have fully vested to Mr. Minnich's favor as of August 23, 2001. The parties acknowledge and agree that a portion of those benefits constitute marital property. The parties therefore agree upon and will allow submission to the Court, an order commonly known as a Qualified Domestic Relations Order, The substance of the Qualified Domestic Relations Order will be that Loretta L. Minnich is entitled to receive one-third of each and every payment that Kenneth M. Minnich would otherwise receive, as part of his pension benefit as described above. Kenneth M, Minnich will take all steps necessary to designate Loretta L. Minnich as the beneficiary of any and all survivor benefits that may be available through the Pennsylvania Army National Guard pension, limited to the same proportion, namely one-third, as provided above with respect to her interest in the monthly payments that Mr. Minnich would be entitled to while he is living. Upon husband's retirement, he will provide verification that he has made the appropriate selection to provide for wife's survivor benefits in accordance with the provisions of this agreement and the Qualified Domestic Relations Order, 4. With respect to tangible personal property that would constitute marital property, the parties have already divided such items to their mutual satisfaction. 5. With respect to marital debt, other than the mortgage on the marital home as has been addressed above, the parties have already divided marital debt to their mutual satisfaction. 6. Should any party materially breach this agreement, the breaching party shall be responsible for payment of the non-breaching party's costs, counsel fees and any other related expenditure that the non-breaching party has incurred as a result of the breach. 7. Each party agrees to timely execute any additional necessary documents to effectuate the terms of this agreement. 8. Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate. Each will at the request of the other execute, acknowledge, and deliver any and all instruments which may be necessary or advisable to carry into effect this mutual waiver and relinquishment of all such interest, rights, and claims.
